Section § 4989.30

Explanation

This law states that any license given under this chapter will expire within 24 months after it's issued, with the exact expiration date decided by the board.

A license issued under this chapter shall expire no later than 24 months after its date of issue. The expiration date of the original license shall be set by the board.

Section § 4989.32

Explanation

If you want to renew your professional license before it expires, you need to fill out a renewal form, pay a renewal fee, report any criminal convictions or professional discipline actions, and complete the required continuing education.

To renew an unexpired license, the licensee shall, on or before the expiration date of the license, take all of the following actions:
(a)CA Business & Professions Code § 4989.32(a) Apply for renewal on a form prescribed by the board.
(b)CA Business & Professions Code § 4989.32(b) Pay a two-year renewal fee prescribed by the board.
(c)CA Business & Professions Code § 4989.32(c) Inform the board of whether the licensee has been convicted, as defined in Section 490, of any misdemeanor or felony and whether any disciplinary action has been taken by a regulatory or licensing board in this or any other state after the prior issuance or renewal of a license.
(d)CA Business & Professions Code § 4989.32(d) Complete the continuing education requirements described in Section 4989.34.

Section § 4989.34

Explanation

If you're renewing a psychology license in California, you need to confirm you've completed 36 hours of continuing education relevant to educational psychology over the past two years. These courses can come from an accredited university or a board-approved provider. The board ensures these providers follow set regulations and can revoke their approval if they don't comply. The education should cover key developments or essential aspects of educational psychology and may include courses on menopausal and maternal mental health. You must keep proof of your coursework for at least two years in case the board asks to see it. The board may make exceptions to these requirements for good reasons.

(a)CA Business & Professions Code § 4989.34(a) To renew a license, a licensee shall certify to the board, on a form prescribed by the board, completion in the preceding two years of not less than 36 hours of approved continuing education in, or relevant to, educational psychology.

(1)Copy CA Business & Professions Code § 4989.34(b)(1) The continuing education shall be obtained from either an accredited university or a continuing education provider as specified by the board by regulation.
(2)CA Business & Professions Code § 4989.34(b)(2) The board shall establish, by regulation, a procedure identifying acceptable providers of continuing education courses, and all providers of continuing education shall comply with procedures established by the board. The board may revoke or deny the right of a provider to offer continuing education coursework pursuant to this section for failure to comply with this section or any regulation adopted pursuant to this section.

(d)CA Business & Professions Code § 4989.34(d) Training, education, and coursework by approved providers shall incorporate one or more of the following:
(1)CA Business & Professions Code § 4989.34(d)(1) Aspects of the discipline that are fundamental to the understanding or the practice of educational psychology.
(2)CA Business & Professions Code § 4989.34(d)(2) Aspects of the discipline of educational psychology in which significant recent developments have occurred.
(3)CA Business & Professions Code § 4989.34(d)(3) Aspects of other disciplines that enhance the understanding or the practice of educational psychology.
(e)CA Business & Professions Code § 4989.34(e) The board may audit the records of a licensee to verify completion of the continuing education requirement. A licensee shall maintain records of the completion of required continuing education coursework for a minimum of two years and shall make these records available to the board for auditing purposes upon its request.
(f)CA Business & Professions Code § 4989.34(f) The board may establish exceptions from the continuing education requirements of this section for good cause, as determined by the board.
(g)CA Business & Professions Code § 4989.34(g) The continuing education requirements of this section shall comply fully with the guidelines for mandatory continuing education established by the Department of Consumer Affairs pursuant to Section 166.

Section § 4989.36

Explanation

If your professional license has expired, you can still renew it up to three years after the expiration by fulfilling the requirements outlined in Section 4989.32 and paying a late renewal fee.

A licensee may renew a license that has expired at any time within three years after its expiration date by taking all of the actions described in Section 4989.32 and by paying the delinquency fee.

Section § 4989.38

Explanation

If you have a suspended license, you can still renew it when it expires, but you can't use it to do the licensed activity until the suspension is lifted. Also, you're not allowed to break any rules set by the suspension order.

A suspended license is subject to expiration and shall be renewed as provided in this article, but such renewal does not entitle the licensee, while it remains suspended and until it is reinstated, to engage in the activity to which the license relates, or in any other activity or conduct in violation of the order or judgment by which it was suspended.

Section § 4989.40

Explanation

If your professional license is revoked, you can't renew it as usual. Instead, you need to apply for reinstatement. If your license is reinstated after it has expired, you'll have to pay a reinstatement fee that's the same as the last renewal fee, plus any late fees from when it was revoked.

A revoked license is subject to expiration as provided in this article and shall not be renewed. The applicant may apply to the board for reinstatement of their license. If it is reinstated after its expiration, the licensee shall, as a condition precedent to its reinstatement, pay a reinstatement fee in an amount equal to the renewal fee in effect on the last regular renewal date before the date on which it is reinstated, plus the delinquency fee, if any, accrued at the time of its revocation.

Section § 4989.42

Explanation

If your professional license lapses for more than three years, you can't simply renew it. Instead, to get a new license, you must ensure there's no reason it would be revoked or suspended, pay all the application fees, pass the current exam, and meet fingerprinting rules.

A license that is not renewed within three years after its expiration may not be renewed, restored, reinstated, or reissued thereafter. A former licensee may apply for a new license if he or she satisfies all of the following requirements:
(a)CA Business & Professions Code § 4989.42(a) No fact, circumstance, or condition exists that, if the license were issued, would constitute grounds for its revocation or suspension.
(b)CA Business & Professions Code § 4989.42(b) Payment of the fees that would be required if he or she were applying for a license for the first time.
(c)CA Business & Professions Code § 4989.42(c) Passage of the current licensure examination.
(d)CA Business & Professions Code § 4989.42(d) He or she complies with the fingerprint requirements established by board regulation.

Section § 4989.44

Explanation

If you're a licensed educational psychologist in California, you can ask the board to make your license inactive, meaning you can’t practice or work in the field. During this time, you pay only half of the usual renewal fee every two years. If you want to start working again, provided you haven't done anything that would cause a license denial, you can ask to switch your license back to active. You’ll need to pay the other half of the fee if it's between renewal periods. Also, if your license is due to expire in less than a year, you must do 18 hours of continuing education. If it’s more than a year, you need 36 hours of continuing education.

(a)CA Business & Professions Code § 4989.44(a) A licensee may apply to the board to request that his or her license be placed on inactive status.
(b)CA Business & Professions Code § 4989.44(b) A licensee on inactive status shall be subject to this chapter and shall not engage in the practice of educational psychology in this state.
(c)CA Business & Professions Code § 4989.44(c) A licensee who holds an inactive license shall pay a biennial fee of one-half of the amount of the standard renewal fee.
(d)CA Business & Professions Code § 4989.44(d) A licensee on inactive status who has not committed an act or crime constituting grounds for denial of licensure may, upon request, restore his or her license to practice educational psychology to active status. A licensee requesting that his or her license be placed on active status between renewal cycles shall pay the remaining one-half of his or her renewal fee. A licensee requesting to restore his or her license to active status, whose license will expire less than one year from the date of the request, shall complete 18 hours of continuing education as specified in Section 4989.34. A licensee requesting to restore his or her license to active status, whose license will expire more than one year from the date of the request, shall complete 36 hours of continuing education as specified in Section 4989.34.

Section § 4989.45

Explanation
If you're a licensed educational psychologist in California, you can apply for a retired license as long as your current license is active, not suspended, or facing disciplinary action. With a retired license, you can't practice as an active psychologist, nor do you have to renew this retired license. However, you can switch back to an active license within three years by paying a fee, taking continuing education courses, and submitting fingerprints. If it’s been more than three years, you'll also need to pass exams. Continuing education requirements vary: 18 hours if restored in less than a year and 36 hours if one year or more.
(a)CA Business & Professions Code § 4989.45(a) The board shall issue, upon application and payment of the fee fixed by this chapter, a retired license to a licensed educational psychologist who holds a license that is current and active or a license that is inactive, and whose license is not suspended, revoked, or otherwise punitively restricted by the board or subject to disciplinary action under this chapter.
(b)CA Business & Professions Code § 4989.45(b) The holder of a retired license issued pursuant to this section shall not engage in any activity for which an active educational psychologist license is required.
(c)CA Business & Professions Code § 4989.45(c) The holder of a retired license shall not be required to renew that license.
(d)CA Business & Professions Code § 4989.45(d) The holder of a retired license may apply to restore to active status his or her license to practice educational psychology if that retired license was issued less than three years prior to the application date, and the applicant meets all of the following requirements:
(1)CA Business & Professions Code § 4989.45(d)(1) Has not committed an act or crime constituting grounds for denial of licensure.
(2)CA Business & Professions Code § 4989.45(d)(2) Pays the renewal fee fixed by this chapter.
(3)CA Business & Professions Code § 4989.45(d)(3) Completes the required continuing education as specified in Section 4989.34.
(4)CA Business & Professions Code § 4989.45(d)(4) Complies with the fingerprint submission requirements established by the board in regulation.
(e)CA Business & Professions Code § 4989.45(e) An applicant requesting to restore his or her license pursuant to subdivision (d), whose license was issued in accordance with this section less than one year from the date of the application, shall complete 18 hours of continuing education as specified in Section 4989.34.
(f)CA Business & Professions Code § 4989.45(f) An applicant requesting to restore his or her license pursuant to subdivision (d), whose license was issued in accordance with this section one or more years from the date of application, shall complete 36 hours of continuing education as specified in Section 4989.34.
(g)CA Business & Professions Code § 4989.45(g) The holder of a retired license may apply to restore to active status his or her license to practice educational psychology if that retired license was issued three or more years prior to the application date, and the applicant meets all of the following requirements:
(1)CA Business & Professions Code § 4989.45(g)(1) Has not committed an act or crime constituting grounds for denial of licensure.
(2)CA Business & Professions Code § 4989.45(g)(2) Applies for licensure and pays the required fee.
(3)CA Business & Professions Code § 4989.45(g)(3) Passes the examinations required for licensure.
(4)CA Business & Professions Code § 4989.45(g)(4) Complies with the fingerprint submission requirements established by the board in regulation.
