Section § 16440

Explanation

TL_This law is about challenging election results. TL_It can be used if someone believes the winner should not hold the office because they are ineligible, they committed election-related crimes, or they received votes that were illegal or fraudulent, and without those improper votes, they would not have won.

TL_This article applies only to contests on the grounds that:
(a)CA Halalan Code § 16440(a) TL_The defendant is not eligible to the office in dispute.
(b)CA Halalan Code § 16440(b) TL_The defendant has committed any offense against the elective franchise as defined in Division 18 (commencing with Section 18000).

Section § 16441

Explanation

Esta ley establece que si hay una disputa sobre una nominación para un cargo que abarca un área con más de un condado, cualquier tribunal superior en esa área puede encargarse del caso. Explanation
