(a)Copy CA 民事诉讼法 Code § 1277(a)
(1)Copy CA 民事诉讼法 Code § 1277(a)(1) 如果改名程序是通过提交申请书启动的,除(b)、(c)、(d)和(f)款或第1277.5条另有规定外,法院应随即发出命令,其中载明申请书的提交、提交申请书的人的姓名以及拟议的姓名。该命令应指示所有对此事感兴趣的人在指定的时间和地点出庭,该时间应自发出命令之时起不少于6周且不超过12周,除非法院另行指定时间,以说明为何不应批准改名申请的理由。该命令应指示所有对此事感兴趣的人,通过在事项预定审理日期前至少两个法院工作日向法院提交书面异议(其中应包括异议的理由),并在听证会上出庭说明为何不应批准改名申请的理由,以提出他们可能对批准改名申请持有的任何异议。该命令应声明,如果未及时提交书面异议,法院可以无需听证即批准申请。

(A)Copy CA 民事诉讼法 Code § 1277(a)(2)(A) 说明理由令的副本应根据《政府法典》第6064条的规定,在该县出版的、将在命令中指定的普遍发行的报纸上刊登。如果该县没有普遍发行的报纸,说明理由令的副本应由法院书记员在该法院所在县的三个最公共的场所张贴,期限相同。在申请听证时,须向法院提供令其满意的刊登或张贴证明。
(B)Copy CA 民事诉讼法 Code § 1277(a)(2)(A)(B)
(i)Copy CA 民事诉讼法 Code § 1277(a)(2)(A)(B)(i) 自2023年1月1日起,如果拟改名的人不居住在提交申请的县,根据第1276条(g)款,说明理由令的副本应根据《政府法典》第6064条的规定,在该人居住地所在县出版的普遍发行的报纸上刊登。如果该人居住地所在县没有普遍发行的报纸,说明理由令的副本应由法院书记员在该人居住地所在县或由具有类似职能的当地官员在该人居住地所在县的三个最公共的场所张贴,期限相同。如果寻求改名的人居住的地方没有县级行政区划,则应根据本段的要求在该人居住地的当地行政区划或区域进行刊登。在申请听证时,须向法院提供令其满意的刊登或张贴证明。
(ii)CA 民事诉讼法 Code § 1277(a)(2)(A)(B)(i)(ii) 如果该人无法根据(i)项刊登或张贴说明理由令的副本,法院可以允许采用替代的刊登或张贴方式,或者在提交了充分证据证明已尽力刊登或张贴该命令并令法院满意后,可以豁免此要求。
(3)CA 民事诉讼法 Code § 1277(a)(3) 每周刊登四次即为说明理由令的足够刊登。如果该命令在日报上刊登,则连续四周每周刊登一次即为足够。
(4)CA 民事诉讼法 Code § 1277(a)(4) 如果父母一方为未成年人提交了申请,且另一方父母(如果健在)未同意,申请人应在听证会前不少于30天,根据第413.10、414.10、415.10或415.40条,向另一方父母送达听证会的时间和地点通知或说明理由令的副本。如果根据第415.10或415.40条无法合理实现听证通知,法院可以命令以法院认为合理地旨在给予未同意的父母实际通知的方式发出通知。在这种情况下,如果法院认定通过刊登发出通知合理地旨在给予未同意的父母实际通知,法院可以认定根据本款规定刊登说明理由令即为对未同意的父母的足够通知。

(1)Copy CA 民事诉讼法 Code § 1277(b)(1) If the petition for a change of name alleges a reason or circumstance described in paragraph (2), and the petitioner has established that the petitioner
is an active participant in the address confidentiality program created pursuant to Chapter 3.1 (commencing with Section 6205) of Division 7 of Title 1 of the Government Code, and that the name the petitioner is seeking to acquire is on file with the Secretary of State, the action for a change of name is exempt from the requirement for publication of the order to show cause under subdivision (a), and the petition and the order of the court shall, in lieu of reciting the proposed name, indicate that the proposed name is confidential and is on file with the Secretary of State pursuant to the provisions of the address confidentiality program.
(2)CA 民事诉讼法 Code § 1277(b)(2) The procedure described in paragraph (1) applies to petitions alleging any of the following reasons or circumstances:
(A)CA 民事诉讼法 Code § 1277(b)(2)(A) To avoid domestic violence, as defined in Section 6211 of the Family Code.
(B)CA 民事诉讼法 Code § 1277(b)(2)(B) To avoid stalking, as defined in Section 646.9 of the Penal Code.
(C)CA 民事诉讼法 Code § 1277(b)(2)(C) To avoid sexual assault, as defined in Section 1036.2 of the Evidence Code.
(D)CA 民事诉讼法 Code § 1277(b)(2)(D) To avoid human trafficking, as defined in Section 236.1 of the Penal Code.
(3)CA 民事诉讼法 Code § 1277(b)(3) For any petition under this subdivision, the current legal name of the petitioner shall be kept confidential by the court and shall not be published or posted in the court’s calendars, indexes, or register of actions, as required by Article 7 (commencing with Section 69840) of Chapter 5 of Title 8 of the Government Code, or by any means or in any public forum, including a hardcopy or an electronic copy, or any other type of public media or display.
(4)CA 民事诉讼法 Code § 1277(b)(4) Notwithstanding paragraph (3), the court may, at the request of the petitioner, issue an order reciting the name of the petitioner at the time of the filing of the petition and the new legal name of the petitioner as a result of the court’s granting of the petition.
(5)CA 民事诉讼法 Code § 1277(b)(5) A petitioner may request that the court file the petition and any other papers associated with the proceeding under seal. The court may consider the request at the same time as the petition for name change, and may grant the request in any case in which the court finds that all of the following factors apply:
(A)CA 民事诉讼法 Code § 1277(b)(5)(A) There exists an overriding interest that overcomes the right of public access to the record.
(B)CA 民事诉讼法 Code § 1277(b)(5)(B) The overriding interest supports sealing the record.
(C)CA 民事诉讼法 Code § 1277(b)(5)(C) A
substantial probability exists that the overriding interest will be prejudiced if the record is not sealed.
(D)CA 民事诉讼法 Code § 1277(b)(5)(D) The proposed order to seal the records is narrowly tailored.
(E)CA 民事诉讼法 Code § 1277(b)(5)(E) No less restrictive means exist to achieve the overriding interest.
(c)CA 民事诉讼法 Code § 1277(c) If the petition is filed for a minor or nonminor dependent who is under the jurisdiction of the juvenile court, the action for a change of name is exempt from the requirement for publication of the order to show cause under subdivision (a).
(d)CA 民事诉讼法 Code § 1277(d) A proceeding for a change of name for a witness participating in the state Witness Relocation and Assistance Program established by Title 7.5 (commencing with Section 14020) of Part 4 of the Penal Code who has been approved for the change of name by the program is
exempt from the requirement for publication of the order to show cause under subdivision (a).
(e)CA 民事诉讼法 Code § 1277(e) If an application for change of name is brought as part of an action under the Uniform Parentage Act (Part 3 (commencing with Section 7600) of Division 12 of the Family Code), whether as part of a petition or cross-complaint or as a separate order to show cause in a pending action thereunder, service of the application shall be made upon all other parties to the action in a like manner as prescribed for the service of a summons, as set forth in Article 3 (commencing with Section 415.10) of Chapter 4 of Title 5 of Part 2. Upon the setting of a hearing on the issue, notice of the hearing shall be given to all parties in the action in a like manner and within the time limits prescribed generally for the type of hearing (whether trial or order to show cause) at which the issue of the change of name is to be decided.
(f)CA 民事诉讼法 Code § 1277(f) If a guardian files a petition to change the name of the guardian’s minor ward pursuant to Section 1276:
(1)CA 民事诉讼法 Code § 1277(f)(1) The guardian shall provide notice of the hearing to any living parent of the minor by personal service at least 30 days before the hearing.
