(a)CA 政府 Code § 66484.5(a) 地方机构的立法机构可以采纳一项条例,要求支付费用作为细分地块(需要最终地块图或宗地地块图)批准的条件,或作为在根据本条规定采纳的地下水补给设施计划下的受益区域内颁发建筑许可证的条件,目的是在该受益区域内建设补给设施以补充地下水供应。如果支付时满足以下所有要求,该条例可以要求根据本条支付费用:
(1)CA 政府 Code § 66484.5(a)(1) 受益区域的地下水补给设施计划已由地方机构的立法机构采纳。立法机构在采纳该计划之前,应通知并咨询当时有义务向受益区域供水的供水机构,且该供水机构已正式书面批准该计划。
(2)CA 政府 Code § 66484.5(a)(2) 在提交暂定地块图、宗地地块图(如果不需要暂定地块图)或建筑许可证申请之前,该条例已生效至少30天。
(3)CA 政府 Code § 66484.5(a)(3) 该条例规定,在采纳任何地下水补给设施计划之前,立法机构将为拟议的受益区域举行公开听证会。
关于拟议受益区域听证会的通知应根据第65091条发出,并应包括有关地下水补给设施计划的初步信息,包括受益区域的拟定边界、地表水的可用性、受益区域的规划设施、估计成本以及拟定的费用分摊方法。
公开听证会的书面通知应在通过邮寄或发布和张贴发出通知之前或同时,通过专人送达或邮寄方式发送给负责向听证会所涉受益区域供水的供水机构。邮寄、发布或张贴的通知中包含的提案应由地方机构和供水机构在发出通知之前共同准备并达成一致。供水机构可以参与听证会。
(4)CA 政府 Code § 66484.5(4) 该条例规定,地下水补给设施计划应在公开听证会上确定,如果获得批准,则由立法机构采纳。该计划应包括受益区域的边界、地表水的可用性、受益区域的规划设施及其估计成本、在受益区域内公平分配成本的方法以及在该区域内的费用分摊。由地方机构采纳并由供水机构批准的计划,应纳入立法机构的决议中,并且该计划的经认证副本应向县记录员备案。分摊的费用应适用于受益区域内的所有财产,并应作为最终地块图或宗地地块图批准的条件,或作为为该财产或该财产部分颁发建筑许可证的条件而支付。如果受益区域包括根据本条规定不需支付费用的其他土地,立法机构应通过其他方式规定支付分配给该土地的改善成本份额。
(5)CA 政府 Code § 66484.5(5) 该条例规定,如果在根据条例规定可以提交抗议的时间内,受益于该改善项目的财产面积超过一半的业主向立法机构书记员提交了书面抗议,并且未撤回足够的抗议以使所代表的面积减少到受益财产面积的一半以下,则拟议程序应予放弃,并且立法机构自该书面抗议提交之日起一年内,不得根据本条规定启动或进行任何针对相同改进或收购的程序。
(b)CA 政府 Code § 66484.5(b) 任何抗议均可由提出抗议的业主在根据条例举行的公开听证会结束之前的任何时间以书面形式撤回。
(d)CA 政府 Code § 66484.5(d) Nothing in this section precludes the processing and recordation of maps in accordance with other provisions of this division if proceedings are abandoned.
(e)CA 政府 Code § 66484.5(e) Subsequent to the adoption of a plan, the local agency may itself construct, operate, and maintain the groundwater recharge facilities, or it may designate the water agency furnishing the water or designate or create another agency to do all or any one of these things as authorized by law. In the event any agency other than the local agency adopting such ordinances is so designated, the services so rendered shall be pursuant to a written agreement entered into between the local agency and the other agency.
(f)CA 政府 Code § 66484.5(f) Fees paid pursuant to an ordinance adopted pursuant to this section shall be deposited in a planned recharge facility fund. A fund shall be established for each area of benefit. Money in the fund shall be expended solely for the construction or reimbursement for construction of the improvement serving the area to be benefited.
The fees shall not be expended to reimburse the cost of recharge facilities in existence prior to the adoption of the groundwater recharge facility plan for that area.
(g)CA 政府 Code § 66484.5(g) An ordinance adopted pursuant to this section may provide for the acceptance of considerations in lieu of the payment of fees.
(h)CA 政府 Code § 66484.5(h) A local agency imposing fees pursuant to this section may advance money from its general fund to pay the cost of constructing the improvements and may reimburse the general fund for those advances from planned recharge facility funds collected to finance the construction of these improvements.
(i)CA 政府 Code § 66484.5(i) A local agency imposing fees pursuant to this section may incur an interest-bearing indebtedness for the construction of recharge facilities. However, the sole security for repayment of that indebtedness shall be money in planned recharge facility funds.
(j)CA 政府 Code § 66484.5(j) Recharge facilities shall not be constructed unless the water agency approves the design of the facilities to be constructed and has reached an agreement with the local agency establishing the terms and conditions under which the water will be furnished. If the water agency finds that the facilities have been constructed in accordance with the approved design, the agency shall furnish water for the groundwater recharge facilities.
(k)CA 政府 Code § 66484.5(k) If the water agency is an irrigation district or other entity obligated by law to apportion water among the landowners within the area of benefit, the water agency shall receive credit upon the obligation for any water delivered for groundwater recharge under the agreement and shall be relieved of any further obligation to deliver the amount of water for which it has received such credit to the landowners or lands within that area.
(l)CA 政府 Code § 66484.5(l) Nothing contained in this section entitles a local agency to collect a fee from a landowner who presently receives and continues to receive and use the landowner’s pro rata share of surface water from the agency responsible for that area or from a landowner who has not applied for approval of a final or parcel map or a building permit.
(m)CA 政府 Code § 66484.5(m) A credit for fees paid as authorized by this section shall be applied against any assessment levied by the local agency to construct the planned recharge facilities.
(n)CA 政府 Code § 66484.5(n) The term “construction,” as used in this section, includes design, acquisition of land or easements, administration of construction contracts, and actual construction.
(o)CA 政府 Code § 66484.5(o) The term “water agency,” as used in this section, means the public or other entity that will furnish water for the operation and use of a recharge facility under a groundwater recharge facility plan adopted by a local agency pursuant to this section.
(p)CA 政府 Code § 66484.5(p) Nothing in this section precludes a county or city from providing funds for the construction of recharge facilities to defray costs not allocated to the area of benefit.
