个人物品应从抵押品中移走,包括任何已安装但可通过释放机制从抵押品上拆卸的个人物品。应制作一份完整准确的个人物品清单,并且个人物品应由被许可人贴上标签并以安全方式存放至少60天,但债务人或在收回抵押品时占有抵押品的一方移走或在其在场情况下移走的个人物品除外。如果被许可人或其代理人无法确定附着在抵押品上的财产是个人物品还是抵押品的一部分,则应在清单上注明该事实,且被许可人或代理人没有义务将该物品从抵押品中移走,除非该物品无需使用工具即可移走,在这种情况下,该物品应被移走并列入清单。被许可人或其代理人应通知债务人,如果债务人认为某物品是个人物品,则债务人应联系合法所有人解决该问题。
(a)CA 商业与专业 Code § 7507.9(a) 应注明制作清单的日期和时间。被许可人的永久记录应注明执行清单制作的员工或注册人的姓名。
(b)CA 商业与专业 Code § 7507.9(b) 以下个人物品被确定为被许可人收回时存在危险或健康危害的物品,应按以下方式处置:
(1)Copy CA 商业与专业 Code § 7507.9(b)(1)
(A)Copy CA 商业与专业 Code § 7507.9(b)(1)(A) 致命武器和危险药物应移交给任何执法机构保管。这些物品应列入清单,并注明致命武器或危险药物移交给执法机构的日期、时间、地点,且执法机构的收据应保存在收回机构的记录中。
(B)CA 商业与专业 Code § 7507.9(b)(1)(A)(B) 任何其他工具或武器,包括但不限于通常称为短棍、弹弓、警棍、沙棒、沙袋、金属指虎、短剑、匕首、刀刃长于五英寸的任何刀具、无护刃的任何剃刀,以及用作或拟用作棍棒的任何金属管或金属棒,应列入清单并注明为“已处置,危险装置”,且该物品应以合理安全的方式处置。
(2)CA 商业与专业 Code § 7507.9(b)(2) 易燃物应列入清单并注明为“已处置,危险易燃物”,且该物品应以合理安全的方式处置。
(3)CA 商业与专业 Code § 7507.9(b)(3) 食物和其他健康危害物品应列入清单并注明为“已处置,健康危害”,并以合理安全的方式处置。
(c)CA 商业与专业 Code § 7507.9(c) 个人物品在存放至少60天后方可处置。清单以及关于个人物品如何、何时、向谁处置的充分信息,应归档在被许可人的永久记录中并保存四年。
(d)CA 商业与专业 Code § 7507.9(d) 清单应包括收回机构的名称、地址、营业时间以及联系电话,以便取回个人物品,并列明收回机构将收取的所有个人物品移走和存储费用。清单还应包含以下声明:“请注意,本清单所列财产若在通知日期起60天内无人认领,将由收回机构处置。”
(e)CA 商业与专业 Code § 7507.9(e) 清单应在收回抵押品后不迟于48小时内提供给债务人,但以下情况除外:
(1)CA 商业与专业 Code § 7507.9(e)(1) 如果48小时期间包含周六、周日或邮政假日,则清单应在收回抵押品后不迟于72小时内提供。
(2)CA 商业与专业 Code § 7507.9(e)(2) 如果48小时期间包含周六或周日以及一个邮政假日,则清单应在收回抵押品后不迟于96小时内提供。
(3)CA 商业与专业 Code § 7507.9(e)(3) 如果收回游艇、房车或旅行拖车所产生的清单制作需要至少4小时,则清单应在收回抵押品后不迟于96小时内提供。当96小时期间包含周六、周日或邮政假日时,清单应在收回抵押品后不迟于120小时内提供。
(4)CA 商业与专业 Code § 7507.9(e)(4) 如果被许可人无法打开作为抵押品一部分的锁闭隔间,则现有清单应在收回抵押品后不迟于96小时内提供。当96小时期间包含周六、周日或邮政假日时,清单应在收回抵押品后不迟于120小时内提供。
(f)CA 商业与专业 Code § 7507.9(f) Environmental, Olympic, special interest, or other license plates issued pursuant to Article 8 (commencing with Section 5000), Article 8.4 (commencing with Section 5060), or Article 8.5 (commencing with Section 5100) of Chapter 1 of Division 3 of the Vehicle Code that remain the personal effects of the
debtor shall be removed from the collateral and inventoried pursuant to this section. If the plates are not claimed by the debtor within 60 days, they shall either (1) be effectively destroyed and the licensee shall, within 30 days thereafter, notify the Department of Motor Vehicles of their effective destruction on a form promulgated by the chief that has been approved as to form by the Director of the Department of Motor Vehicles; or (2) be retained by the licensee indefinitely to be returned to the debtor upon request, in which case the licensee shall not charge more than 60 days’ storage on the plates.
(g)CA 商业与专业 Code § 7507.9(g) The notice may be given by regular mail addressed to the current address of the debtor, if known, or by personal service, at the option of the repossession agency.
(h)CA 商业与专业 Code § 7507.9(h) With the consent of the licensee, the debtor waives the preparation and presentation of an inventory if the
debtor redeems the personal effects or other personal property not covered by a security interest within the time period for the notices required by this section and signs a statement that the debtor has received all the property.
(i)CA 商业与专业 Code § 7507.9(i) If personal effects or other personal property not covered by a security agreement are to be released to someone other than the debtor, the repossession agency must receive written authorization to do so from the debtor.
(j)CA 商业与专业 Code § 7507.9(j) A licensee shall not sell personal effects or other personal property not covered by a security agreement and remit money from the sale to a third party, including, but not limited to, any lending institution.
(k)CA 商业与专业 Code § 7507.9(k) The inventory shall be a confidential document. A licensee shall only disclose the contents of the inventory under the following circumstances:
(1)CA 商业与专业 Code § 7507.9(k)(1) In response to the order of a court having jurisdiction to issue the order.
(2)CA 商业与专业 Code § 7507.9(k)(2) In compliance with a lawful subpoena issued by a court of competent jurisdiction.
(3)CA 商业与专业 Code § 7507.9(k)(3) When the debtor has consented in writing to the release and the written consent is signed and dated by the debtor subsequent to the repossession and states the entity or entities to whom the contents of the inventory may be disclosed.
(4)CA 商业与专业 Code § 7507.9(k)(4) To the debtor.
