(a)CA 公共合同 Code § 2000(a) 尽管有任何其他法律规定要求地方机构将合同授予最低负责任的投标人,地方机构可以要求将合同授予同时符合以下任一条件的最低负责任的投标人:
(1)CA 公共合同 Code § 2000(a)(1) 符合地方机构设定的关于少数族裔企业和女性企业参与合同的目标和要求。如果投标人不符合地方机构为该参与设定的目标和要求,地方机构应按照第 (2) 款的规定,评估投标人为遵守这些目标和要求所做的诚信努力。
(2)CA 公共合同 Code § 2000(a)(2) 在开标前,根据 (b) 款规定的标准,作出诚信努力,以遵守地方机构设定的关于少数族裔或女性企业参与合同的目标和要求。
(b)Copy CA 公共合同 Code § 2000(b)
(1)Copy CA 公共合同 Code § 2000(b)(1) 投标人参加了地方机构为告知所有投标人关于将授予合同的项目的少数族裔和女性企业计划要求而安排的任何预征集或投标前会议。如果地方机构认定投标人已了解这些计划要求,则可以免除此要求。
(2)CA 公共合同 Code § 2000(b)(2) 投标人确定并选择了将授予合同的项目中由少数族裔或女性企业执行的具体事项,以提供这些企业参与的机会。
(3)CA 公共合同 Code § 2000(b)(3) 投标人在开标日期前不少于 10 个日历日,在地方机构指定的面向有兴趣参与项目的少数族裔或女性企业的一份或多份日报或周报、行业协会出版物、少数族裔或行业导向出版物、行业期刊或其他媒体上进行了广告宣传。本款仅适用于地方机构在开标日期前不少于 15 个日历日发布了项目公告的情况。
(4)CA 公共合同 Code § 2000(b)(4) 投标人在开标前不少于 10 个日历日,书面通知了项目规范要求通知的少数族裔或女性企业数量,表明其对投标该合同的兴趣。在可能的情况下,地方机构应在开标日期前不少于 15 个日历日向投标人提供一份或多份经地方机构认证为少数族裔或女性企业的名单或名单来源。如果地方机构未向投标人提供该名单或名单来源,投标人可为此目的使用交通部根据《政府法典》第 14030.5 条编制的经认证的少数族裔或女性企业名单。
(5)CA 公共合同 Code § 2000(b)(5) 投标人对最初的意向征集进行了跟进,通过联系这些企业,以确定它们是否确实有兴趣执行项目的具体事项。
(6)CA 公共合同 Code § 2000(b)(6) 投标人向有兴趣的少数族裔和女性企业提供了关于所选分包或材料供应工作的计划、规范和要求的信息。
(7)CA 公共合同 Code § 2000(b)(7) 投标人请求了少数族裔和女性社区组织;少数族裔和女性承包商团体;地方、州或联邦少数族裔和女性企业援助办公室;或在招募和安置少数族裔或女性企业方面提供协助的其他组织(如果存在)的协助。
(8)CA 公共合同 Code § 2000(b)(8) 投标人与少数族裔或女性企业进行了诚信谈判,并且没有无故拒绝任何少数族裔或女性企业提交的投标(经地方机构认定为不满意)。
(9)CA 公共合同 Code § 2000(b)(9) 在适用情况下,投标人建议并努力协助有兴趣的少数族裔和女性企业获得地方机构或承包商要求的担保、信用额度或保险。
(10)CA 公共合同 Code § 2000(b)(10) 地方机构可以合理预期,投标人为获得少数族裔和女性企业参与所做的努力,能够达到足以满足地方机构目标和要求的参与水平。
(c)CA 公共合同 Code § 2000(c) 投标人履行 (b) 款中规定的所有标准,应产生一项可反驳的推定,影响举证责任,即投标人已作出诚信努力以遵守根据 (a) 款设定的关于少数族裔和女性企业参与的目标和要求。
(d)CA 公共合同 Code § 2000(d) “Local agency,” as used in this section, means a county or city, whether general law or chartered, city and county, school district, or other district. “District,” as used in this section, means an agency of the state, formed pursuant to general law or special act, for the local performance of governmental or proprietary functions within limited boundaries.
(e)CA 公共合同 Code § 2000(e) “Minority or women business enterprise,” as used in this section, means a business enterprise that meets both of the following criteria:
(1)CA 公共合同 Code § 2000(e)(1) A business that is at least 51 percent owned by one or more minority persons or women or, in the case of any business whose stock is publicly held, at least 51 percent of the stock is owned by one or more minority persons or women.
(2)CA 公共合同 Code § 2000(e)(2) A business whose
management and daily business operations are controlled by one or more minority persons or women.
(f)CA 公共合同 Code § 2000(f) “Minority person,” for purposes of this section, means Black Americans, Hispanic Americans, Native Americans (including American Indians, Inuit, Aleuts, and Native Hawaiians), Asian-Pacific Americans (including persons whose origins are from Japan, China, the Philippines, Vietnam, Korea, Samoa, Guam, the United States Trust Territories of the Pacific, Northern Marianas, Laos, Cambodia, and Taiwan), or any other group of natural persons identified as minorities in the project specifications by the local agency.
(g)CA 公共合同 Code § 2000(g) This section does not apply to any of the following:
(1)CA 公共合同 Code § 2000(g)(1) A contract, funded in whole or in part by the federal government, to the extent of any conflict between the requirements imposed by this section and any requirements imposed by the federal government relating to participation in a contract by a minority or women business enterprise as a condition of receipt of the federal funds.
(2)CA 公共合同 Code § 2000(g)(2) The San Francisco Bay Area Rapid Transit District, the Los Angeles County Transportation Commission, or any other local agency that has authority to facilitate the participation of minority or women business enterprises substantially similar to the authority granted to the San Francisco Bay Area Rapid Transit District pursuant to Section 20229 of this code or
the Los Angeles County Transportation Commission pursuant to Section 130239 of the Public Utilities Code.
