(a)CA 健康与安全 Code § 103865(a) 主任应建立一个全州范围的系统,用于收集确定帕金森病发病率的信息。自2005年1月1日起,主任应开始分阶段推行全州帕金森病报告区域。截至2006年7月1日,所有县级或区域性登记处应已实施或启动。截至2007年7月1日,全州帕金森病报告系统应全面运行。在2005年6月1日或之前,主任应向立法机构提交一份实施和资金计划。
(b)CA 健康与安全 Code § 103865(b) 部门可将州的任何人口统计区域指定为区域性帕金森病发病率报告区,并可建立区域性帕金森病登记处,负责并有权在指定区域内执行本节的意图。指定的区域性登记处应及时向部门提供部门指定的帕金森病发病率数据。部门可与任何机构签订合同,包括但不限于卫生系统机构、单县卫生部门、多县卫生部门联合体或非营利性专业协会,代表指定的帕金森病报告区域,以收集和整理帕金森病发病率数据。
(c)CA 健康与安全 Code § 103865(c) 主任应将帕金森病指定为在本州或本节规定收集帕金森病信息的任何人口统计区域内必须报告的疾病。此后,在报告区域内诊断或治疗的所有帕金森病病例,均应报告给经授权负责汇编帕金森病数据的部门代表,或任何指定与该代表合作的个人、机构或组织。

(1)Copy CA 健康与安全 Code § 103865(d)(1) 任何在指定为帕金森病报告区域内为帕金森病患者提供治疗的医院或其他机构,应按照部门规定的格式向部门或部门授权代表报告每例帕金森病病例。如果医院或其他机构未能按照部门规定的格式报告,部门的授权代表可以从该医院或机构获取信息,并以适当的格式进行报告。在这种情况下,医院或其他机构应向部门或授权代表偿付其获取和报告信息的费用。
(2)CA 健康与安全 Code § 103865(d)(2) 任何诊断或治疗帕金森病患者的医生、药剂师或其他医疗保健执业者,应向部门或部门授权代表报告每例帕金森病病例,但直接转诊至治疗机构的病例,或此前已因该帕金森病病例的诊断或治疗而入住治疗机构的病例除外。
(e)CA 健康与安全 Code § 103865(e) 所有医生、医院、门诊诊所以及所有其他向帕金森病患者提供诊断或治疗服务的机构、个人或组织,均应允许部门或授权代表查阅所有能够识别帕金森病病例、确定帕金森病特征、帕金森病治疗情况或任何已识别帕金森病患者医疗状况的记录。故意拒绝查阅这些记录的,每日可处以最高五百美元(500美元)的民事罚款。根据本款收取的任何民事罚款应由部门存入普通基金。
(f)Copy CA 健康与安全 Code § 103865(f)
(1)Copy CA 健康与安全 Code § 103865(f)(1) 除本节另有规定外,根据本节收集的所有信息均应保密。就本节而言,此信息应被称为“保密信息”。
(2)CA 健康与安全 Code § 103865(f)(2) 部门和部门指定的任何区域性帕金森病登记处应使用这些信息来确定帕金森病的来源。
(3)CA 健康与安全 Code § 103865(f)(3) 具有有效科学兴趣、从事人口统计学、流行病学或其他类似健康相关研究,并符合部门确定资格且书面同意保密的人员,可被授权查阅保密信息。
(4)CA 健康与安全 Code § 103865(f)(4) The department and any regional Parkinson’s disease registry designated by the department may enter into agreements to furnish confidential information to other states’ Parkinson’s disease registries, federal Parkinson’s disease control agencies, local health officers, or health researchers for the purposes of determining the sources of Parkinson’s disease and evaluating measures designed to eliminate, alleviate, or ameliorate their effect. Before confidential information is disclosed to those agencies, officers, researchers, or out-of-state registries, the requesting entity shall agree in writing to maintain the confidentiality of the information, and in the case of researchers, shall also do both of the following:
(A)CA 健康与安全 Code § 103865(f)(4)(A) Obtain approval of their committee for the protection of human subjects established in accordance with Part 46 (commencing with Section 46.101) of Title 45 of the Code of Federal Regulations.
(B)CA 健康与安全 Code § 103865(f)(4)(B) Provide documentation to the department that demonstrates to the department’s satisfaction that the entity has established the procedures and ability to maintain the confidentiality of the information.
(5)CA 健康与安全 Code § 103865(f)(5) Notwithstanding any other provision of law, any disclosure authorized by this section shall include only the information necessary for the stated purpose of the requested disclosure, used for the approved purpose, and not be further disclosed.
(6)CA 健康与安全 Code § 103865(f)(6) The furnishing of confidential information to the department or its authorized representative in accordance with this section shall not expose any person, agency, or entity furnishing information to liability, and shall not be considered a waiver of any privilege or a violation of a confidential relationship.
(7)CA 健康与安全 Code § 103865(f)(7) The department shall maintain an accurate record of all persons who are given access to confidential information. The record shall include: the name of the person authorizing access; name, title, address, and organizational affiliation of persons given access; dates of access; and the specific purpose for which information is to be used. The record of access shall be open to public inspection during normal operating hours of the department.
(8)CA 健康与安全 Code § 103865(f)(8) Notwithstanding any other provision of law, no part of the confidential information shall be available for subpoena, nor shall it be disclosed, discoverable, or compelled to be produced in any civil, criminal, administrative, or other proceeding, nor shall this information be deemed admissible as evidence in any civil, criminal, administrative, or other tribunal or court for any reason.
(9)CA 健康与安全 Code § 103865(f)(9) Nothing in this subdivision shall prohibit the publication by the department of reports and statistical compilations that do not in any way identify individual cases or individual sources of information.
(10)CA 健康与安全 Code § 103865(f)(10) Notwithstanding the restrictions in this subdivision, the individual to whom the information pertains shall have access to his or her own information in accordance with Chapter 1 (commencing with Section 1798) of Title 1.8 of the Civil Code.
(g)CA 健康与安全 Code § 103865(g) For the purpose of this section, “Parkinson’s disease” means a chronic and progressive neurologic disorder resulting from deficiency of the neurotransmitter dopamine as the consequence of degenerative, vascular, or inflammatory changes in the area of the brain called the basal ganglia. It is characterized by tremor at rest, slow movements, rigidity of movement, droopy posture, muscle weakness, and unsteady or shuffling gait.
(h)CA 健康与安全 Code § 103865(h) Nothing in this section shall preempt the authority of facilities or individuals providing diagnostic or treatment services to patients with Parkinson’s disease to maintain their own facility-based Parkinson’s disease registries.
