(2)CA 健康与安全 Code § 17021.8(2) If the local government fails to provide the required documentation pursuant to paragraph (1), the development shall be deemed
to satisfy the requirements specified in paragraph (2) of subdivision (a).
(c)CA 健康与安全 Code § 17021.8(c) The local government’s planning commission or an equivalent board or commission responsible for review and approval of development projects, or the city council or board of supervisors, as appropriate, may conduct a development review or public oversight of the development. The development review or public oversight shall be objective and be strictly focused on assessing compliance with criteria required for streamlined projects, as well as any reasonable objective development standards described in this section. For purposes of this subdivision, “objective development standards” mean standards that involve no personal or subjective judgment by a public official and are uniformly verifiable by reference to an external and uniform benchmark or criterion available and knowable by both the development applicant or proponent and the public official prior to submission.
The development review or public oversight shall be completed as follows and shall not in any way inhibit, chill, or preclude the ministerial approval provided by this section or its effect, as applicable:
(1)CA 健康与安全 Code § 17021.8(c)(1) Within 90 days of submission of the development to the local government pursuant to this section if the development contains 50 or fewer housing units.
(2)CA 健康与安全 Code § 17021.8(c)(2) Within 180 days of submission of the development to the local government pursuant to this section if the development contains more than 50 housing units.
(d)CA 健康与安全 Code § 17021.8(d) An agricultural employee housing development that is approved pursuant to this section shall not be subject to the density limits specified in Section 17021.6 in order to constitute an agricultural land use for purposes of that section.
(e)CA 健康与安全 Code § 17021.8(e) Notwithstanding Section 17021.6, a local government may subject an agricultural employee housing development that is approved pursuant to this section to the following written, objective development standards:
(1)Copy CA 健康与安全 Code § 17021.8(e)(1)
(A)Copy CA 健康与安全 Code § 17021.8(e)(1)(A) A requirement that the development have adequate water and wastewater facilities and dry utilities to serve the project.
(B)CA 健康与安全 Code § 17021.8(e)(1)(A)(B) A requirement that the development be connected to an existing public water system that has not been identified as failing or being at risk of failing to provide an adequate supply of safe drinking water.
(C)CA 健康与安全 Code § 17021.8(e)(1)(A)(C) If the development proposes to include 10 or more units, a requirement that the development connect to an existing municipal sewer system that has adequate capacity to serve the project. If the local agency has adopted an approved local
agency management program for onsite wastewater treatment systems, those requirements shall apply to the development.
(2)CA 健康与安全 Code § 17021.8(e)(2) A requirement that the property on which the development is located be either:
(A)CA 健康与安全 Code § 17021.8(e)(2)(A) Within one-half mile of a duly designated collector road with an Average Daily Trips (ADT) of 6,000 or greater.
(B)CA 健康与安全 Code § 17021.8(e)(2)(B) Adjacent to a duly designated collector road with an ADT of 2,000 or greater.
(3)CA 健康与安全 Code § 17021.8(e)(3) A requirement that the development include off-street parking based upon demonstrated need, provided that the standards do not require more parking for eligible agricultural employee housing developments than for other residential uses of similar size within the jurisdiction.
(4)CA 健康与安全 Code § 17021.8(e)(4) Notwithstanding Section 17020 or any other law, health, safety, and welfare standards for agricultural employee housing, including, but not limited to, density, minimum living space per occupant, minimum sanitation facilities, minimum sanitation requirements, and similar standards.
(5)CA 健康与安全 Code § 17021.8(e)(5) Standards requiring that if a potential for exposure to significant hazards from surrounding properties or activities is found to exist, the effects of the potential exposure shall be mitigated to a level of insignificance in compliance with state and federal requirements.
(f)CA 健康与安全 Code § 17021.8(f) Neither the approval of a development pursuant to this section, including the permit processing, nor the application of development standards pursuant to this section shall be deemed to be discretionary acts within the meaning of the California Environmental Quality Act (Division 13 (commencing with Section
21000) of the Public Resources Code).
(g)CA 健康与安全 Code § 17021.8(g) Notwithstanding Section 17021.6, a local agency may impose fees and other exactions otherwise authorized by law that are essential to provide necessary public services and facilities to the eligible agricultural employee housing development.
(h)CA 健康与安全 Code § 17021.8(h) This section shall not be construed to:
(1)CA 健康与安全 Code § 17021.8(h)(1) 禁止地方机构要求符合条件的农业雇员住房开发项目遵守与 (e) 款一致,并适合且符合满足管辖区对农场工人住房需求(根据《政府法典》第 65583 条 (a) 款第 (7) 项确定)的客观、可量化、书面的开发标准、条件和政策。
(2)CA 健康与安全 Code § 17021.8(h)(2) 禁止地方机构不批准符合条件的农业雇员住房开发项目,如果拟议的符合条件的农业雇员住房开发项目将对公共健康或安全产生特定、不利的影响,并且没有可行的办法能够令人满意地减轻或避免该特定、不利的影响,而不使该开发项目对第 50079.5 条所定义的低收入家庭而言变得无法负担,或使该开发项目在财务上不可行。在本款中,“特定、不利影响”指基于客观、已确定的书面公共健康或安全标准、政策或条件,在申请被视为完整的日期时存在的重大、可量化、直接且不可避免的影响。
(3)CA 健康与安全 Code § 17021.8(h)(3) 禁止地方机构不批准符合条件的农业雇员住房开发项目,如果该项目将违反任何适用的州或联邦法律。
(4)CA 健康与安全 Code § 17021.8(h)(4) 改变遵守任何其他现有法律的任何义务,包括但不限于第 116527 条、《水法典》第 106.4 条、《水法典》第 7 编(自第 13000 条起)以及第 104 编第 12 部分(自第 116270 条起)。
(i)CA 健康与安全 Code § 17021.8(i) 就本条而言,“符合条件的农业雇员住房开发项目”指满足以下所有条件的农业雇员住房开发项目:
(1)CA 健康与安全 Code § 17021.8(i)(1) 该农业雇员住房不包含宿舍式住房。
(2)CA 健康与安全 Code § 17021.8(i)(2) 该开发项目不超过以下任一情况:
(A)CA 健康与安全 Code § 17021.8(i)(2)(A) 三十六个单元或空间,供单一家庭或住户使用。
(B)CA 健康与安全 Code § 17021.8(i)(2)(B) 一百五十个单元或空间,供单一家庭或住户使用,如果该开发项目位于圣克拉拉县或圣克鲁斯县。
(3)Copy CA 健康与安全 Code § 17021.8(i)(3)
(A)Copy CA 健康与安全 Code § 17021.8(i)(3)(A) 除非 (B) 项另有规定,该农业雇员住房将由根据第 17030.10 条获得认证的合格经济适用住房组织维护和运营。开发项目提案人应提交执法机构颁发合格经济适用住房组织认证的证明。该合格经济适用住房组织应提供开发项目的现场管理。
(B)CA 健康与安全 Code § 17021.8(i)(3)(A)(B) 对于由地方公共住房机构或经本款要求认证为合格经济适用住房组织的多县、州或多州机构维护和运营的农业雇员住房,该机构要么直接维护和运营该农业雇员住房,要么与根据第 17030.10 条获得认证的另一个合格经济适用住房组织签订合同。
(C)CA 健康与安全 Code § 17021.8(i)(3)(A)(C) 地方政府确保在物业上记录一份可负担性契约,以确保拟议的农业雇员住房对农业雇员而言在不少于 55 年内保持可负担性。就本款而言,“可负担性”指该农业住房以第 50053 条所定义的经济适用租金提供给第 50079.5 条所定义的低收入家庭。
(4)CA 健康与安全 Code § 17021.8(i)(4) 该农业雇员住房不属于根据第 50205 条 (b) 款第 (1) 项或第 50517.10 条 (b) 款第 (1) 项规定不符合州资助条件的范围。该开发项目中所有农业雇员住房的细分部分以及整个开发范围均不属于根据第 50205 条 (b) 款第 (1) 项或第 50517.10 条 (b) 款第 (1) 项规定不符合资助条件的范围。“单元或空间”一词的使用不应被解释为限制这些条款禁止使用州资助来支持 H-2A 雇主义务的规定。根据第 50205 条 (b) 款第 (2) 项和第 50517.10 条 (b) 款第 (1) 项,任何将州资助用于这些条款所禁止目的的雇主或其他州资助接受者,应向州或提供资助的州机构偿还用于这些禁止目的的州资助金额。
(j)CA 健康与安全 Code § 17021.8(j) 就本节而言,“农业雇员住房”指为农业雇员提供的雇员住房,这两个术语分别在第17008节和第17021节中定义。
(k)CA 健康与安全 Code § 17021.8(k) 就本节而言:
(1)CA 健康与安全 Code § 17021.8(k)(1) “专用于工业用途”指以下任何一种情况:
(A)CA 健康与安全 Code § 17021.8(k)(1)(A) 该面积目前正被用作工业用途。
(B)CA 健康与安全 Code § 17021.8(k)(1)(B) 该面积最近获准的用途是工业用途,且该场地在过去三年内曾被占用。
(C)CA 健康与安全 Code § 17021.8(k)(1)(C) 该场地在地方政府于2022年1月1日之前通过的最新版总体规划中被指定为工业用途,且住宅用途并非主要获准用途。
(2)Copy CA 健康与安全 Code § 17021.8(k)(2)
(A)Copy CA 健康与安全 Code § 17021.8(k)(2)(A) 除分段 (B) 另有规定外,“工业用途”指公用事业、制造业、运输储存和维护设施、仓储用途,以及任何其他属于须经区(在第39025节中定义)许可的来源的用途,根据第26部(自第39000节起)或联邦《清洁空气法》(42 U.S.C. Sec. 7401 et seq.)。
(B)CA 健康与安全 Code § 17021.8(k)(2)(A)(B) “工业用途”不包括以下任何一种情况:
(i)CA 健康与安全 Code § 17021.8(k)(2)(A)(B)(i) 变电站或公用事业输送设施,包括但不限于电力线、宽带线或管道。
(ii)CA 健康与安全 Code § 17021.8(k)(2)(A)(B)(ii) 区唯一许可的来源是应急备用发电机的用途。
(iii)CA 健康与安全 Code § 17021.8(k)(2)(A)(B)(iii) 建筑物居民的自助仓储。
(l)CA 健康与安全 Code § 17021.8(l) 立法机关特此声明,本州的政策是,每个县和市应允许并鼓励开发和使用数量和类型充足的农业雇员住房,以符合当地需求。立法机关进一步认定并声明,本节涉及全州关注的事项,而非《加利福尼亚州宪法》第十一条第5节所指的市政事务。因此,本节适用于所有城市,包括特许城市。
