(a)CA 福利与机构 Code § 16809.4(a) 根据第16809节自愿参与县医疗服务计划的县,可以根据本节所载程序设立县医疗服务计划管理委员会。该管理委员会应管理县医疗服务计划。
(b)CA 福利与机构 Code § 16809.4(b) 管理委员会的成员构成应由以下所有人员组成:
(1)CA 福利与机构 Code § 16809.4(b)(1) 三名成员,每人应为县监事会成员。
(2)CA 福利与机构 Code § 16809.4(b)(2) 三名成员,应为县行政官员。
(3)CA 福利与机构 Code § 16809.4(b)(3) 两名成员,应为县福利主管。
(4)CA 福利与机构 Code § 16809.4(b)(4) 两名成员,应为县卫生官员。
(5)CA 福利与机构 Code § 16809.4(b)(5) 一名成员,应为卫生与福利局局长或其指定人员,并应作为当然的无投票权成员。
(c)CA 福利与机构 Code § 16809.4(c) 管理委员会可以制定自己的章程和操作程序。
(d)CA 福利与机构 Code § 16809.4(d) 管理委员会的投票成员应符合以下所有要求:
(1)CA 福利与机构 Code § 16809.4(d)(1) 所有成员应在参与县医疗服务计划的县任职或受雇。
(A)CA 福利与机构 Code § 16809.4(d)(1)(A) 三名县监事成员应由CMSP县的监事会选举产生,每个县拥有一票,并在管理委员会主席的召集下召开会议。
(B)CA 福利与机构 Code § 16809.4(d)(1)(B) 三名县行政官员应由CMSP县的行政官员在管理委员会主席的召集下召开会议选举产生。
(C)CA 福利与机构 Code § 16809.4(d)(1)(C) 两名县卫生官员应由CMSP县的卫生官员在管理委员会主席的召集下召开会议选出。
(D)CA 福利与机构 Code § 16809.4(d)(1)(D) 两名县福利主管应由CMSP县的福利主管在管理委员会主席的召集下召开会议选举产生。
(2)CA 福利与机构 Code § 16809.4(d)(2) 管理委员会成员的任期应为三年。
(3)CA 福利与机构 Code § 16809.4(d)(3) 来自同一县的两人不得同时担任管理委员会成员。
(4)CA 福利与机构 Code § 16809.4(d)(4) 管理委员会可以选举一名常任主席。
(e)Copy CA 福利与机构 Code § 16809.4(e)
(1)Copy CA 福利与机构 Code § 16809.4(e)(1) 特此设立管理委员会,具有以下权力:
(A)CA 福利与机构 Code § 16809.4(e)(1)(A) 确定计划资格和福利水平。
(B)CA 福利与机构 Code § 16809.4(e)(1)(B) 设立储备金和参与费。
(C)CA 福利与机构 Code § 16809.4(e)(1)(C) 制定县加入和退出县医疗服务计划的程序。退出程序应公平公正。
(D)CA 福利与机构 Code § 16809.4(e)(1)(D) 制定成本控制和病例管理程序,包括但不限于替代的医疗服务提供方式,以及与部门所用方式和费率不同的替代方式和费率。
(E)CA 福利与机构 Code § 16809.4(e)(1)(E) 以管理委员会的名义起诉和被起诉。
(F)CA 福利与机构 Code § 16809.4(e)(1)(F) 将管辖风险分配给每个县。
(G)CA 福利与机构 Code § 16809.4(e)(1)(G) 利用管理委员会选择的任何参与县的采购政策和程序。
(H)CA 福利与机构 Code § 16809.4(e)(1)(H) 制定规章制度。
(I)CA 福利与机构 Code § 16809.4(e)(1)(I) 为了管理或执行县医疗服务计划的目的,与公共机构或个人签订和订立任何性质的合同或约定。
(J)CA 福利与机构 Code § 16809.4(e)(1)(J) 购买用品、设备、材料、财产或服务。
(K)CA 福利与机构 Code § 16809.4(e)(1)(K) 任命和雇用工作人员协助管理委员会。
(L)CA 福利与机构 Code § 16809.4(e)(1)(L) 制定其议事规则。
(M)CA 福利与机构 Code § 16809.4(e)(1)(M) 为了本计划的目的,接受来自任何公共机构或个人的赠与、捐款、补助金或贷款。
(N)CA 福利与机构 Code § 16809.4(e)(1)(N) 与服务提供者谈判并设定费率、收费或费用,包括与部门所用方式不同的替代支付方式。
(O)CA 福利与机构 Code § 16809.4(e)(1)(O) 在与部门签订的任何管理县医疗服务计划的合同期限内,制定与部门财务中介机构的行政要求兼容的支付方式。
(P)CA 福利与机构 Code § 16809.4(e)(1)(P) 使用公认会计准则。
(Q)CA 福利与机构 Code § 16809.4(e)(1)(Q) 制定和实施程序和流程,以监督和执行费率、收费和费用的适当账单和支付。
(R)CA 福利与机构 Code § 16809.4(e)(1)(R) 调查并追讨通过不当手段开具账单和支付的费用,包括但不限于提供者的欺诈性账单和收款行为。
(S)CA 福利与机构 Code § 16809.4(e)(1)(S) 追讨第三方追偿和遗产追偿,以弥补在县医疗服务计划下提供的服务,包括提交和完善留置权,以确保报销所提供福利的合理价值。
(E)CA 福利与机构 Code § 16809.4(e)(1)(E) “Nonduplication” means that a regulation does not serve the same purpose as a state or federal statute or another regulation. This standard requires that the governing board identify any state or federal statute or regulation that is overlapped or
duplicated by the proposed regulation and justify any overlap or duplication. This standard is not intended to prohibit the governing board from printing relevant portions of enabling legislation in regulations when the duplication is necessary to satisfy the clarity standard in subparagraph (C). This standard is intended to prevent the indiscriminate incorporation of statutory language in a regulation.
(g)CA 福利与机构 Code § 16809.4(g) The requirements of the Ralph M. Brown Act (Chapter 9 (commencing with Section 54950) of Part 1 of Division 2 of Title 5 of the Government Code) shall apply to the meetings of the governing board, including meetings held pursuant to subdivision (i), except the board may meet in closed session to consider and take action on matters pertaining to contracts and contract negotiations with providers of health care services.

(1)Copy CA 福利与机构 Code § 16809.4(h)(1) The governing board shall comply with the following procedures for public meetings held to eliminate or reduce the level of services, restrict eligibility for services, or adopt regulations:
(A)CA 福利与机构 Code § 16809.4(h)(1)(A) Provide prior public notice of those meetings.
(B)CA 福利与机构 Code § 16809.4(h)(1)(B) Provide that notice not less than 30 days prior to those meetings.
(C)CA 福利与机构 Code § 16809.4(h)(1)(C) Publish that notice in a newspaper of general circulation in each participating CMSP county.
(D)CA 福利与机构 Code § 16809.4(h)(1)(D) Include in the notice, at a minimum, the amount and type of each proposed change, the expected savings, and the number of persons affected.
(E)CA 福利与机构 Code § 16809.4(h)(1)(E) Either hold those meetings in the county seats of at least four regionally distributed CMSP participating counties, or, alternatively, hold two meetings in Sacramento County.
(2)CA 福利与机构 Code § 16809.4(h)(2) For meetings held outside Sacramento County, the requirements for public meetings pursuant to this subdivision to eliminate or reduce the level of services, or to restrict the eligibility for services or hear testimony regarding regulations to implement any of these service charges, are satisfied if at least three voting members of the governing board hold the meetings as required and report the testimony from those meetings to the full governing board at its next regular meeting. No action shall be taken at any meeting held outside Sacramento County pursuant to this paragraph.
(i)CA 福利与机构 Code § 16809.4(i) Records of the County Medical Services Program and of the governing board that relate to rates of payment or to the board’s negotiations with providers of health care services or to the governing board’s deliberative processes regarding either shall not be subject to disclosure pursuant to the California Public Records Act (Division 10 (commencing with Section 7920.000) of Title 1 of the Government Code).
(j)CA 福利与机构 Code § 16809.4(j) The following definitions shall govern the construction of this part, unless the context requires otherwise:
(1)CA 福利与机构 Code § 16809.4(j)(1) “CMSP” or “program” means the County Medical Services Program, which is the program by which health care services are provided to eligible persons in those counties electing to participate in the
CMSP pursuant to Section 16809.
(2)CA 福利与机构 Code § 16809.4(j)(2) “CMSP county” means a county that has elected to participate pursuant to Section 16809 in the CMSP.
(3)CA 福利与机构 Code § 16809.4(j)(3) “Governing Board” means the County Medical Services Program Governing Board established pursuant to this section.
