定义。就本章而言,下列术语具有以下含义:
(a)CA 健康与安全 Code § 25991(a) “种猪”指为商业繁殖目的饲养的任何六个月或以上或怀孕的猪科雌性猪。
(b)CA 健康与安全 Code § 25991(b) “企业主或经营者”指拥有或控制企业运营的任何人。
(c)CA 健康与安全 Code § 25991(c) “散养系统”指为蛋鸡提供的室内或室外受控环境,在该环境中,蛋鸡可以自由无限制地活动;获得使其能够表现自然行为的丰富设施,至少包括抓扒区、栖息处、产蛋箱和沙浴区;并且农场员工可以在蛋鸡的可用地面空间内站立提供照护。散养系统包括,在符合本款要求的情况下,以下各项:
(1)CA 健康与安全 Code § 25991(c)(1) 多层禽舍,其中蛋鸡可以进入多个高架平台,这些平台在平台上方和下方都为蛋鸡提供了可用地面空间。
(2)CA 健康与安全 Code § 25991(c)(2) 部分板条系统,其中蛋鸡可以进入高架平板平台,粪便通过地板落入下方的粪坑或垫料清除带。
(3)CA 健康与安全 Code § 25991(c)(3) 单层全垫料地板系统,其中蛋鸡对高架平板平台的接触有限或没有。
(4)CA 健康与安全 Code § 25991(c)(4) 任何符合本款要求的未来系统。
(d)CA 健康与安全 Code § 25991(d) “饲养用于生产小牛肉的犊牛”指为生产被称为小牛肉的食品而饲养的任何牛科犊牛。
(e)CA 健康与安全 Code § 25991(e) “残忍限制”指以下任何一种行为:
(1)CA 健康与安全 Code § 25991(e)(1) 以阻止动物躺下、站立、完全伸展四肢或自由转身的方式限制受涵盖动物。
(2)CA 健康与安全 Code § 25991(e)(2) 在2019年12月31日之后,限制饲养用于生产小牛肉的犊牛,使其每头犊牛的可用地面空间少于43平方英尺。
(3)CA 健康与安全 Code § 25991(e)(3) 在2021年12月31日之后,限制种猪,使其每头猪的可用地面空间少于24平方英尺。
(4)CA 健康与安全 Code § 25991(e)(4) 在2019年12月31日之后,限制蛋鸡,使其每只鸡的可用地面空间少于144平方英寸。
(5)CA 健康与安全 Code § 25991(e)(5) 在2021年12月31日之后,限制蛋鸡,使其每只鸡的可用地面空间少于2017年版《美国蛋鸡动物饲养指南:散养指南》所要求的数量,或将其限制在散养系统以外的围栏中。
(f)CA 健康与安全 Code § 25991(f) “受涵盖动物”指在农场饲养的任何用于生产小牛肉的犊牛、种猪或蛋鸡。
(g)CA 健康与安全 Code § 25991(g) “蛋鸡”指为产蛋目的饲养的任何雌性家养鸡、火鸡、鸭、鹅或珍珠鸡。
(h)CA 健康与安全 Code § 25991(h) “围栏”指用于限制一只或多只受涵盖动物的结构。
(i)CA 健康与安全 Code § 25991(i) “农场”指全部或部分用于商业生产用于食品或纤维的动物或动物产品的土地、建筑物、辅助设施和其他设备;不包括活体动物市场、根据《联邦肉类检查法》(21 U.S.C. Sec. 601 et seq.)提供强制性检查的机构,或根据《联邦蛋制品检查法》(21 U.S.C. Sec. 1031 et seq.)维持强制性检查的官方工厂。
(j)CA 健康与安全 Code § 25991(j) “农场主或经营者”指拥有或控制农场运营的任何人。
(k)CA 健康与安全 Code § 25991(k) “完全伸展动物四肢”指完全伸展所有四肢,而不触及围栏侧面或另一只动物。
(l)CA 健康与安全 Code § 25991(l) “液态蛋”指从蛋壳中取出、供人类食用、蛋黄和蛋清按自然比例混合,或蛋黄和蛋清分离、混合或混合并过滤的蛋鸡的蛋。液态蛋不包括复合食品产品,包括煎饼粉、蛋糕粉、饼干、披萨、曲奇面团、冰淇淋或类似的加工或预制食品产品,这些产品除了液态蛋外,还包含糖、盐、水、调味料、色素、香料、防腐剂、稳定剂和类似的食品添加剂。
(m)CA 健康与安全 Code § 25991(m) “人”指任何个人、商号、合伙企业、合资企业、协会、有限责任公司、公司、遗产、信托、接管人或财团。
(n)CA 健康与安全 Code § 25991(n) “猪肉”指根据《加利福尼亚州法规》第3篇第900节(截至2017年8月)的定义,猪科动物的肉,旨在供人类食用。
(o)CA 健康与安全 Code § 25991(o) “Sale” means a commercial sale by a business that sells any item covered by this chapter, but does not include any sale undertaken at an establishment at which mandatory inspection is provided
under the Federal Meat Inspection Act (21 U.S.C. Sec. 601 et seq.), or any sale undertaken at an official plant at which mandatory inspection is maintained under the federal Egg Products Inspection Act (21 U.S.C. Sec. 1031 et seq.). For purposes of this section, a sale shall be deemed to occur at the location where the buyer takes physical possession of an item covered by Section 25990.
(p)CA 健康与安全 Code § 25991(p) “Shell egg” means a whole egg of an egg-laying hen in its shell form, intended for use as human food.
(q)CA 健康与安全 Code § 25991(q) “Turning around freely” means turning in a complete circle without any impediment, including a tether, and without touching the side of an enclosure or another animal.
(r)CA 健康与安全 Code § 25991(r) “Uncooked” means requiring cooking prior to human consumption.
(s)CA 健康与安全 Code § 25991(s) “Usable floorspace”
means the total square footage of floorspace provided to each covered animal, as calculated by dividing the total square footage of floorspace provided to the animals in an enclosure by the number of animals in that enclosure. In the case of egg-laying hens, usable floorspace shall include both groundspace and elevated level flat platforms upon which hens can roost, but shall not include perches or ramps.
(t)CA 健康与安全 Code § 25991(t) “Veal meat” means meat, as defined in Section 900 of Title 3 of the California Code of Regulations as of August 2017, of a calf raised for veal intended for use as human food.
(u)CA 健康与安全 Code § 25991(u) “Whole pork meat” means any uncooked cut of pork, including bacon, ham, chop, ribs, riblet, loin, shank, leg, roast, brisket, steak, sirloin, or cutlet, that is comprised entirely of pork meat, except for seasoning, curing agents, coloring, flavoring, preservatives, and similar meat additives. Whole
pork meat does not include combination food products, including soups, sandwiches, pizzas, hotdogs, or similar processed or prepared food products, that are comprised of more than pork meat, seasoning, curing agents, coloring, flavoring, preservatives, and similar meat additives.
(v)CA 健康与安全 Code § 25991(v) “Whole veal meat” means any uncooked cut of veal, including chop, ribs, riblet, loin, shank, leg, roast, brisket, steak, sirloin, or cutlet, that is comprised entirely of veal meat, except for seasoning, curing agents, coloring, flavoring, preservatives, and similar meat additives. Whole veal meat does not include combination food products, including soups, sandwiches, pizzas, hotdogs, or similar processed or prepared food products, that are comprised of more than veal meat, seasoning, curing agents, coloring, flavoring, preservatives, and similar meat additives.
