Explanation

本法律为“受保障贷款”设定了规则,这些贷款具有特定的保护和限制。首先,提前还款费仅在最初36个月内允许收取,且仅在特定条件下,例如提供无费用替代方案并向借款人清晰披露。贷款的还款计划应公平,不应旨在随着时间推移增加债务,也不应使用贷款收益预付未来的款项。

负摊销(即本金增加)大部分被禁止,除非明确披露。也不允许因违约而提高利率,除非是已在文件中设定的浮动利率贷款。

贷款人必须确保借款人能够实际偿还贷款,并考虑到他们的收入和债务。不得有允许贷款人随意要求全额还款的条款,除非有特定条件,如违约或欺诈。

贷款人不能强迫消费者拖欠现有贷款,也不能提供对借款人无益的再融资。房屋装修付款结构受到控制,以确保透明度和公平性。在消费者签署贷款文件之前,必须向他们提供特定的警示通知,概述风险。

该法律还禁止引导借款人选择不利的贷款产品,以及任何构成欺诈或试图规避法律的行为。

以下是受保障贷款的禁止行为和限制:
(a)Copy CA 金融 Code § 4973(a)
(1)Copy CA 金融 Code § 4973(a)(1) 受保障贷款在贷款完成日后的最初36个月后,不得包含提前还款费或罚金。
(2)CA 金融 Code § 4973(a)(2) 受保障贷款在贷款完成日后的最初36个月内,可以包含提前还款费或罚金,但须符合以下条件:
(A)CA 金融 Code § 4973(a)(2)(A) 促成受保障贷款的人也向消费者提供了不含提前还款费或罚金的另一种产品选择。
(B)CA 金融 Code § 4973(a)(2)(B) 促成受保障贷款的人在贷款完成前至少三个工作日,已书面告知消费者接受包含提前还款罚金的受保障贷款所涉及的提前还款费或罚金条款,以及消费者在接受不含提前还款罚金的受保障贷款时可获得的利率、点数和费用。
(C)CA 金融 Code § 4973(a)(2)(C) 促成受保障贷款的人已将提前还款费或罚金的金额限制为不超过六个月的预付利息,该利息按当时有效的合同利率计算,针对任何12个月期间内,超出原始本金金额20%部分的提前还款金额。
(D)CA 金融 Code § 4973(a)(2)(D) 如果受保障贷款因违约而加速到期,则受保障贷款不会施加提前还款费或罚金。
(E)CA 金融 Code § 4973(a)(2)(E) 促成受保障贷款的人不会通过由同一人促成的新贷款来为提前还款罚金提供融资。
(b)Copy CA 金融 Code § 4973(b)
(1)Copy CA 金融 Code § 4973(b)(1) 期限为五年或更短的受保障贷款,在贷款发放时不得规定还款计划,该计划的定期分期付款合计后未能截至贷款到期日完全摊销本金余额。
(2)CA 金融 Code § 4973(b)(2) 对于为适应消费者季节性或不规律收入而调整的还款计划,任何一年内的总分期付款额不得超过该贷款一年份的还款额。此禁令不适用于过桥贷款。就本款而言,“过桥贷款”是指期限少于18个月的贷款,该贷款仅要求支付利息,直至全部未偿余额到期应付时。
(c)CA 金融 Code § 4973(c) 受保障贷款不得包含负摊销条款,以致于定期月供还款计划导致本金余额增加,除非受保障贷款是第一抵押贷款,且促成贷款的人向消费者披露该贷款包含可能增加贷款余额本金的负摊销条款。
(d)CA 金融 Code § 4973(d) 受保障贷款不得包含以下条款:贷款项下要求的定期付款从贷款收益中合并并预付。
(e)CA 金融 Code § 4973(e) 受保障贷款不得包含因违约而提高利率的条款。此条款不适用于浮动利率贷款中与贷款文件条款一致的利率变动,前提是利率变动并非由违约事件或债务加速到期触发。
(f)Copy CA 金融 Code § 4973(f)
(1)Copy CA 金融 Code § 4973(f)(1) 促成受保障贷款的人不得发放或安排受保障贷款,除非在贷款完成时,该人合理地相信消费者(或多个消费者在集体考虑时)将能够根据其当前和预期收入、当前债务、就业状况以及其他财务资源(消费者用于担保贷款偿还的住房产权除外)按期偿还债务。对于结构设计为在申请日期起不超过37个月的特定预定日期,按数字或公式表示的特定指定利率增加的受保障贷款,此评估应基于在申请时计算的贷款完全指数利率。
如果贷款完成时,消费者的每月总债务(包括贷款项下所欠金额)不超过消费者每月总收入的55%(经信用申请、消费者财务报表、信用报告、消费者或其代表向促成贷款的人提供的财务信息,或任何其他合理方式核实),则应推定消费者能够按期偿还债务。
(2)CA 金融 Code § 4973(2) 不得仅因在贷款完成时,消费者的每月总债务(包括贷款项下所欠金额)超过消费者每月总收入的55%这一事实,而推定无法按期偿还债务。
(3)CA 金融 Code § 4973(3) In the case of a stated income loan, the reasonable belief requirement in paragraph (1) shall apply, however, for stated income loans that belief may be based on the income stated by the consumer, and other information in the possession of the person originating the loan after the solicitation of all information that the person customarily solicits in connection with loans of this type. A person shall not knowingly or willfully originate a covered loan as a stated income loan with the intent, or effect, of evading the provisions of this subdivision.
(g)CA 金融 Code § 4973(g) A person who originates a covered loan shall not pay a contractor under a home-improvement contract from the proceeds of a covered loan other than by an instrument payable to the consumer or jointly to the consumer and the contractor or, at the election of the consumer, to a third-party escrow agent for the benefit of the contractor in accordance with terms and conditions established in a written escrow agreement signed by the consumer, the person who originates a covered loan, and the contractor prior to the disbursement of funds. No payments, other than progress payments for home-improvement work that the consumer certifies is completed, shall be made to an escrow account or jointly to the consumer and the contractor unless the person who originates the loan is presented with a signed and dated completion certificate by the consumer showing that the home-improvement contract was completed to the satisfaction of the consumer.
(h)CA 金融 Code § 4973(h) It is unlawful for a person who originates a covered loan to recommend or encourage a consumer to default on an existing consumer loan or other debt in connection with the solicitation or making of a covered loan that refinances all or any portion of the existing consumer loan or debt.
(i)CA 金融 Code § 4973(i) A covered loan shall not contain a call provision that permits the lender, in its sole discretion, to accelerate the indebtedness. This prohibition does not apply if repayment of the loan has been accelerated in accordance with the terms of the loan documents (1) as a result of the consumer’s default, (2) pursuant to a due-on-sale provision, or (3) due to fraud or material misrepresentation by a consumer in connection with the loan or the value of the security for the loan.
(j)CA 金融 Code § 4973(j) A person who originates a covered loan shall not refinance or arrange for the refinancing of a consumer loan such that the new loan is a covered loan that is made for the purpose of refinancing, debt consolidation or cash out, that does not result in an identifiable benefit to the consumer, considering the consumer’s stated purpose for seeking the loan, fees, interest rates, finance charges, and points.
(k)Copy CA 金融 Code § 4973(k)
(1)Copy CA 金融 Code § 4973(k)(1) A covered loan shall not be made unless the following disclosure, written in 12-point font or larger, has been provided to the consumer no later than three business days prior to signing of the loan documents of the transaction:
If you obtain this loan, the lender will have a mortgage on your home. You could lose your home, and any money you have put into it, if you do not meet your obligations under the loan.
Mortgage loan rates and closing costs and fees vary based on many other factors, including your particular credit and financial circumstances, your earnings history, the loan-to-value requested, and the type of property that will secure your loan. Higher rates and fees may be justified depending on the individual circumstances of a particular consumer’s application. You should shop around and compare loan rates and fees.
This particular loan may have a higher rate and total points and fees than other mortgage loans and is, or may be, subject to the additional disclosure and substantive protections under Division 1.7 (commencing with Section 4970) of the Financial Code. You should consider consulting a qualified independent credit counselor or other experienced financial adviser regarding the rate, fees, and provisions of this mortgage loan before you proceed. For information on contacting a qualified credit counselor, ask your lender or call the United States Department of Housing and Urban Development’s counseling hotline at 1-888-995-HOPE (4673) or go to hud4.my.site.com/housingcounseling/ for a list of HUD-approved housing counseling agencies.
You are not required to complete any loan agreement merely because you have received these disclosures or have signed a loan application.

(l)Copy CA 金融 Code § 4973(l)
(1)Copy CA 金融 Code § 4973(l)(1) 贷款发起人不得引导、建议或指示任何潜在消费者接受风险等级低于该消费者根据该发起人当时现行的、审慎应用的承保指南(并考虑该发起人可获得的信息,包括消费者提供的信息)所能获得的风险等级的贷款产品。
如果对消费者应用的风险等级确定是合理地基于该发起人的承保指南,并且是消费者在该发起人处符合资格的适当风险等级类别,则该发起人不得被视为违反本节规定。
(2)CA 金融 Code § 4973(2) 如果经纪人发起一项受涵盖贷款,该经纪人不得引导、建议或指示任何潜在消费者接受成本高于该消费者根据该经纪人经常与之开展业务的人员所提供的贷款产品所能获得的贷款产品。
(m)CA 金融 Code § 4973(m) 贷款发起人不得通过以下方式规避或试图规避本分部的适用:
(1)CA 金融 Code § 4973(m)(1) 将贷款交易构造成开放式信贷计划,以规避本分部,如果该贷款若被构造成封闭式贷款则会成为受涵盖贷款。
(2)CA 金融 Code § 4973(m)(2) 将任何贷款交易分成独立的部分,以规避本分部。
(3)CA 金融 Code § 4973(m)(3) 实施《刑法典》第 532f 条所定义的抵押贷款欺诈。
(n)CA 金融 Code § 4973(n) 贷款发起人不得以构成欺诈的方式行事,无论该行为是否被本节明确禁止,或具有不同性质。
