本部分所用术语:
(a)CA 福利和机构 Code § 10213.5(a) “替代性支付”包括由一个托儿机构向另一个机构或托儿服务提供者支付的用于提供托儿和发展服务的款项,以及由机构向家长支付的用于家长购买托儿和发展服务的款项。
(b)CA 福利和机构 Code § 10213.5(b) “替代性支付计划”是指根据第10225.5节与本部门签订合同的地方政府机构或非营利组织,或根据第6章(自第10235节起)的流动人口替代性支付计划,旨在提供替代性支付并向家长和提供者提供支持服务。
(c)CA 福利和机构 Code § 10213.5(c) “申请或签约机构”是指经授权根据本章设立、维持或运营服务的学区、社区大学区、学院或大学、县教育总监、县、市、公共机构、非免税私营机构、免税私营机构或其他实体。依法获得许可的私营机构和家长合作社,应获得与任何其他授权实体相同的考量,且不丧失与本章规定一致的家长决策特权。
(d)CA 福利和机构 Code § 10213.5(d) “指定报销费率”是指与该机构签订的合同所确定的费率,通过将合同总金额除以所需服务的最低平均每日入学儿童天数得出。
(e)CA 福利和机构 Code § 10213.5(e) “出勤”是指在托儿和发展机构中儿童的在场人数。为报销目的,“出勤”包括儿童因疾病、隔离、其家长疾病或隔离、家庭紧急情况,或根据法院要求或明显符合儿童最佳利益而与家长或其他亲属共度时光的获准缺勤。
(f)CA 福利和机构 Code § 10213.5(f) “资本支出”是指为使托儿和发展以及学前教育设施符合州和地方健康与安全标准而进行的翻新和维修所支付的金额,以及为州购买可移动托儿和发展以及学前教育设施以租赁给符合条件的签约机构所支付的金额。
(g)CA 福利和机构 Code § 10213.5(g) “照护者”是指在托儿和发展机构中直接照护、监督和指导儿童的人员。
(h)CA 福利和机构 Code § 10213.5(h) “托儿和发展机构”是指提供托儿和发展服务的住宅或建筑物或其一部分。
(i)CA 福利和机构 Code § 10213.5(i) “托儿和发展计划”是指由公共或私营机构在中心和家庭托儿所中,为从婴儿期到13岁儿童提供全天任何时段的全面服务的计划。这些计划包括但不限于以下所有内容:
(1)CA 福利和机构 Code § 10213.5(i)(1) 普通托儿和发展。
(2)CA 福利和机构 Code § 10213.5(i)(2) 流动人口托儿和发展。
(3)CA 福利和机构 Code § 10213.5(i)(3) 由加州学龄家庭教育计划提供的托儿服务 (《法典》第2卷第4部第29章第9节第7.1条(自第54740节起))。
(4)CA 福利和机构 Code § 10213.5(i)(4) 资源和转介。
(5)CA 福利和机构 Code § 10213.5(i)(5) 针对有特殊需求儿童的托儿和发展服务。
(6)CA 福利和机构 Code § 10213.5(i)(6) 家庭托儿所教育网络。
(7)CA 福利和机构 Code § 10213.5(i)(7) 替代性支付。
(8)CA 福利和机构 Code § 10213.5(i)(8) 学龄社区托儿服务。
(j)CA 福利和机构 Code § 10213.5(j) “托儿和发展服务”是指旨在满足儿童及其家庭各种需求的那些服务,当其父母或监护人正在工作、接受培训、寻找工作、丧失能力或需要喘息时。这些服务可能包括直接照护和监督、教学活动、资源和转介计划以及替代性支付安排。
(k)CA 福利和机构 Code § 10213.5(k) “面临虐待、忽视或剥削风险的儿童”是指在法律、医疗或社会服务机构或紧急避难所的书面转介中被如此识别的儿童。
(l)CA 福利和机构 Code § 10213.5(l) “有特殊需求的儿童”是指以下任一情况:
(1)CA 福利和机构 Code § 10213.5(l)(1) 三岁以下婴幼儿,根据《加州早期干预服务法案》(《政府法典》第14卷(自第95000节起))及其执行法规被确定有资格获得早期干预服务的。这些儿童包括有发育迟缓或已确立的风险状况的婴幼儿,或根据《政府法典》第95014节(a)款定义,有高度实质性发育障碍风险的婴幼儿。这些儿童应有积极的个性化家庭服务计划,应正在接受早期干预服务,并且应是需要在托儿环境中获得成人特殊关注的儿童。
(2)CA 福利和机构 Code § 10213.5(l)(2) 3至21岁(含)的儿童,经个别化教育计划团队根据《教育法典》第二编第四部第三十章(第56000条起)所载的特殊教育要求,确定符合特殊教育及相关服务资格,并符合《教育法典》第56026条、《教育法典》第二编第四部第三十章第四章第2.5条(第56333条起)以及《加州法规》第五编第3030条和第3031条中描述的资格标准。这些儿童应拥有有效的个别化教育计划,应正在接受早期干预服务或适当的特殊教育及相关服务,并且应是需要在托儿环境中获得成人特别关注的儿童。这些儿童包括智力障碍、听力障碍(包括耳聋)、言语或语言障碍、视力障碍(包括失明)、严重情绪障碍(亦称情绪障碍)、骨科障碍、自闭症、创伤性脑损伤、其他健康障碍或特定学习障碍的儿童,他们需要符合《美国法典》第二十编第1401(3)(A)条规定的特殊教育及相关服务。
(m)CA 福利和机构 Code § 10213.5(m) “停业成本”是指仅针对流动儿童发展项目,在每个生长季节结束时与运营关闭相关的所有已批准活动的报销。
(n)CA 福利和机构 Code § 10213.5(n) “成本”包括但不限于与托儿和发展项目运营相关的支出。“成本”可包括州和地方对员工福利的合理贡献金额,包括经批准的退休计划、机构行政管理以及任何其他合理的项目运营成本。“成本”还可包括项目服务社区内可许可设施的费用,包括租金支付或折旧、首付款以及为购置、修复或建造可许可设施而产生的贷款本金和利息支付,但这些成本不得超过设施所在社区的现有公平市场租金。“合理且必要的成本”是指其性质和金额不超过普通审慎之人在经营竞争性业务时会产生的成本。
(o)CA 福利和机构 Code § 10213.5(o) “小学”,如《美国法典》第二十编原第425条(经修订的1958年《国防教育法》,公法85-864)所载,为高等院校学生贷款取消条款之目的,包括幼儿教育项目和所有儿童发展项目。
(p)CA 福利和机构 Code § 10213.5(p) “家庭托儿所教育网络”是指依法成立的实体,根据第10250条与部门签订合同,向持牌家庭托儿所提供者支付款项,并向这些提供者以及符合州补贴托儿和发展服务条件的儿童和家庭提供教育和支持服务。家庭托儿所教育网络也可称为家庭托儿所系统。
(q)CA 福利和机构 Code § 10213.5(q) “健康服务”包括但不限于以下所有内容:
(1)CA 福利和机构 Code § 10213.5(q)(1) 在可能的情况下,转介至能够提供持续医疗服务的适当医疗保健提供者。
(2)CA 福利和机构 Code § 10213.5(q)(2) 健康筛查和健康治疗,包括在适当的州免疫表格上记录的全面免疫接种,其范围由《医疗补助法案》(第三部第七章(第14000条起))和《儿童健康与残疾预防计划》(《健康与安全法典》第一零六部第二部第三章第六条(第124025条起))规定,但仅限于无法利用社区资源获得持续护理的情况。
(3)CA 福利和机构 Code § 10213.5(q)(3) 为儿童、家长、员工和提供者提供的健康教育和培训。
(4)CA 福利和机构 Code § 10213.5(q)(4) 通过转介至适当的医疗保健机构或个体医疗保健专业人员进行的后续治疗。
(r)CA 福利和机构 Code § 10213.5(r) “高等教育机构”是指加州大学董事会、加州州立大学董事会、加州社区学院理事会以及任何经认可的私立非营利性高等教育机构的管理机构。
(s)CA 福利和机构 Code § 10213.5(s) “代际员工”是指不同世代的人员。
(t)CA 福利和机构 Code § 10213.5(t) “双语学习者”是指第一语言不是英语的儿童,或正在学习两种或两种以上语言(其中一种可能是英语)的儿童。
(u)CA 福利和机构 Code § 10213.5(u) “Parent” means a biological parent, stepparent, adoptive parent, foster parent, caretaker relative, or any other adult living with a child who has responsibility for the care and welfare of the child.
(v)CA 福利和机构 Code § 10213.5(v) “Program director” means a person who, pursuant to Sections 10242 and
10380.5, is qualified to serve as a program director.
(w)CA 福利和机构 Code § 10213.5(w) “Proprietary childcare agency” means an organization or facility providing childcare, which is operated for profit.
(x)CA 福利和机构 Code § 10213.5(x) “Resource and referral programs” means programs that provide information to parents, including referrals and coordination of community resources for parents and public or private providers of care. Services frequently include, but are not limited to: technical assistance for providers, toy-lending libraries, equipment-lending libraries, toy- and equipment-lending libraries, staff development programs, health and nutrition education, and referrals to social services.
(y)CA 福利和机构 Code § 10213.5(y) “Severely disabled children” are children with exceptional needs from birth to 21 years of age, inclusive, who require intensive instruction and training in programs serving
pupils with the following profound disabilities: autism, blindness, deafness, severe orthopedic impairments, serious emotional disturbances, or severe intellectual disabilities. “Severely disabled children” also include those individuals who would have been eligible for enrollment in a developmental center for handicapped pupils under Chapter 7 (commencing with Section 56800) of Part 30 of Division 4 of Title 2 of the Education Code as it read on January 1, 1980.
(z)CA 福利和机构 Code § 10213.5(z) “Short-term respite childcare” means childcare service to assist families whose children have been identified through written referral from a legal, medical, or social service agency, or emergency shelter as being neglected, abused, exploited, or homeless, or at risk of being neglected, abused, exploited, or homeless. Childcare is provided for less than 24 hours per day in childcare centers, treatment centers for abusive parents, family childcare homes, or in the child’s own
home.
(aa) “Site supervisor” means a person who, regardless of their title, has operational program responsibility for a childcare and development program at a single site. A site supervisor shall hold a permit issued by the Commission on Teacher Credentialing that authorizes supervision of a childcare and development program operating in a single site. The department may waive the requirements of this subdivision if the department determines that the existence of compelling need is appropriately documented.
(ab) “Standard reimbursement rate” means that rate established by the department pursuant to Section 10280.
(ac) “Startup costs” means those expenses an agency incurs in the process of opening a new or additional facility before the full enrollment of children.
(ad) “California state preschool program” means part-day and full-day educational programs for low-income or otherwise disadvantaged three- and four-year-old children.
(ae) “Support services” means those services that, when combined with childcare and development services, help promote the healthy physical, mental, social, and emotional growth of children. Support services include, but are not limited to: protective services, parent training, provider and staff training, transportation, parent and child counseling, child development resource and referral services, and child placement counseling.
(af) “Teacher” means a person with the appropriate permit issued by the Commission on Teacher Credentialing who provides program supervision and instruction that includes supervision of a number of aides, volunteers, and groups of children.
(ag) “Underserved area” means a county or subcounty area, including, but not limited to, school districts, census tracts, or ZIP Code areas, where the ratio of publicly subsidized childcare and development program services to the need for these services is low, as determined by the department.
(ah) “Workday” means the time that the parent requires temporary care for a child for any of the following reasons:
(1)CA 福利和机构 Code § 10213.5(ah)(1) To undertake training in preparation for a job.
(2)CA 福利和机构 Code § 10213.5(ah)(2) To undertake or retain a job.
(3)CA 福利和机构 Code § 10213.5(ah)(3) To undertake other activities that are essential to maintaining or improving the social and economic function of the family, are beneficial to the community, or are required because of health problems
in the family.
(ai) “Homeless children and youth” has the same meaning as defined in Section 11434a(2) of the federal McKinney-Vento Homeless Assistance Act (42 U.S.C. Sec. 11301 et seq.).
(aj) “Local educational agency” means a school district, a county office of education, a community college district, or a school district acting on behalf of one or more schools within the school district.

(1)Copy CA 福利和机构 Code § 10213.5(al)(1) 最迟于2024年3月1日生效,“非全日制照护”是指经认证为儿童提供的每周少于25小时的照护。
(2)CA 福利和机构 Code § 10213.5(al)(2) 最迟于2024年3月1日生效,“全日制照护”是指经认证为儿童提供的每周25小时或以上的照护。
(3)CA 福利和机构 Code § 10213.5(al)(3) 尽管有《行政程序法》(《政府法典》第2篇第3部第1编第3.5章(自第11340节起))的规章制定条款,部门可以通过全县信函、公告或类似的书面指示实施和管理本款,直至法规通过。
(4)CA 福利和机构 Code § 10213.5(al)(4) 部门应最迟于2026年7月1日启动规章制定行动,以通过实施本款的法规。
(5)CA 福利和机构 Code § 10213.5(al)(5) 如果本款的规定与根据第10426节达成的谅解备忘录的规定相冲突,则该谅解备忘录应具有约束力,无需进一步立法行动,但如果谅解备忘录的此类规定需要资金支出,则除非经立法机关在年度预算案中批准,否则这些规定不生效。
