(a)CA 民法 Code § 3071(a) 留置权人应根据本条规定,就任何价值被确定超过四千美元($4,000)的车辆,向部门申请签发进行留置权出售的授权。部门将收取申请费,如果进行留置权出售或车辆被赎回,留置权人可以收回该费用。申请应在伪证罪处罚下签署,并应包括以下所有信息:
(1)CA 民法 Code § 3071(a)(1) 车辆描述,包括品牌、年份型号、识别号、牌照号和注册州。对于摩托车,还应包括发动机号。如果车辆识别号不可用,部门在接受申请之前,应要求治安官、持证车辆核查员或部门员工对车辆进行检查。
(2)CA 民法 Code § 3071(a)(2) 车辆注册车主和法定车主的姓名和地址(如果可从车辆内的注册证书中查明),以及留置权人已知或理应知道对车辆声称拥有权益的任何人的姓名和地址。
(3)CA 民法 Code § 3071(a)(3) 留置权金额的声明以及产生留置权的事实。
(b)CA 民法 Code § 3071(b) 收到根据 (a) 款提交的申请后,部门应执行以下所有事项:
(1)CA 民法 Code § 3071(b)(1) 如果车辆在该州有注册标志,则通知外国的车辆登记机构待决的留置权出售。
(2)CA 民法 Code § 3071(b)(2) 通过挂号信,向在部门备案的注册车主和法定车主,以及申请中列出的任何其他人的姓名和地址,发送通知、申请副本以及预先写好部门地址的回邮信封。
(c)CA 民法 Code § 3071(c) 根据 (b) 款要求的通知应包括以下所有声明和信息:
(1)CA 民法 Code § 3071(c)(1) 已向部门提交进行留置权出售的授权申请。
(2)CA 民法 Code § 3071(c)(2) 该人有权在法庭上获得听证。
(3)CA 民法 Code § 3071(c)(3) 如果希望在法庭上获得听证,一份在伪证罪处罚下签署的反对声明表,应在根据 (b) 款要求的通知邮寄之日起 10 天内签署并返回部门。
(4)CA 民法 Code § 3071(c)(4) 如果反对声明表已签署并返回部门,留置权人只有在获得法院判决、从声明人处获得后续解除,或者声明人无法按照 (e) 款所述送达的情况下,才被允许出售车辆。
(5)CA 民法 Code § 3071(c)(5) 如果提起法院诉讼,声明人应在其反对声明表上所示地址收到诉讼通知,并可出庭对该主张提出异议。
(6)CA 民法 Code § 3071(c)(6) 如果判决有利于留置权人,该人可能需要承担诉讼费用。
(d)CA 民法 Code § 3071(d) 如果部门在规定时间内收到反对声明表,部门应在收到表格后 16 天内通知留置权人,除非留置权人在部门根据本款发出通知后 30 天内向法院提起诉讼,否则不得进行留置权出售。除非随后作出有利于留置权人的判决,或声明人随后解除其对车辆的权益,否则不得进行车辆的留置权出售。如果作出有利于留置权人的金钱判决,且该判决在生效后五天内未支付,则该判决可通过根据 (f) 款进行的留置权出售程序强制执行。
(e)CA 民法 Code § 3071(e) Service on the declarant in person or by certified mail with return receipt requested, signed by the declarant or an authorized agent of the declarant at the address shown on the Declaration of Opposition form, shall be effective for the serving of process. If the lienholder has served the declarant by certified mail at the address shown on the Declaration of Opposition form and the mail has been returned unclaimed, or if the lienholder has attempted to effect service on the declarant in person with a marshal, sheriff, or licensed process server and the marshal, sheriff, or licensed process server has been unable to effect service on the declarant, the lienholder may proceed with the judicial proceeding or proceed with the lien sale without a judicial proceeding. The lienholder shall notify the department of the inability to effect service on the declarant and shall provide the department with a copy of the documents with which service on the declarant was attempted. Upon receipt of the notification of unsuccessful service, the department shall send authorization of the sale to the lienholder and send notification of the authorization to the declarant.
(f)CA 民法 Code § 3071(f) Upon receipt of authorization to conduct the lien sale from the department, the lienholder shall immediately do all of the following:
(1)CA 民法 Code § 3071(f)(1) At least five days, but not more than 20 days, prior to the lien sale, not counting the day of the sale, give notice of the sale by advertising once in a newspaper of general circulation published in the county in which the vehicle is located. If there is no newspaper published in the county, notice shall be given by posting a Notice of Sale form in three of the most public places in the town in which the vehicle is located and at the place where the vehicle is to be sold for 10 consecutive days prior to and including the day of the sale.
(2)CA 民法 Code § 3071(f)(2) Send a Notice of Pending Lien Sale form 20 days prior to the sale but not counting the day of sale, by certified mail with return receipt requested, to each of the following:
(A)CA 民法 Code § 3071(f)(2)(A) The registered and legal owners of the vehicle, if registered in this state.
(B)CA 民法 Code § 3071(f)(2)(B) All persons known to have an interest in the vehicle.
(C)CA 民法 Code § 3071(f)(2)(C) The department.
(g)CA 民法 Code § 3071(g) All notices required by this section, including the notice forms prescribed by the department, shall specify the make, year model, vehicle identification number, license number, and state of registration, if available, and the specific date, exact time, and place of sale. For motorcycles, the engine number shall also be included.
(h)CA 民法 Code § 3071(h) Following the sale of a vehicle, the person who conducts the sale shall do both of the following:
(1)CA 民法 Code § 3071(h)(1) Remove and destroy the vehicle’s license plates.
(2)CA 民法 Code § 3071(h)(2) Within five days of the sale, submit a completed “Notice of Release of Liability” form to the Department of Motor Vehicles.
(i)CA 民法 Code § 3071(i) The Department of Motor Vehicles shall retain all submitted forms described in paragraph (2) of subdivision (h) for two years.
(j)CA 民法 Code § 3071(j) No lien sale shall be undertaken pursuant to this section unless the vehicle has been available for inspection at a location easily accessible to the public for at least one hour before the sale and is at the place of sale at the time and date specified on the notice of sale. Sealed bids shall not be accepted. The lienholder shall conduct the sale in a commercially reasonable manner.
(k)CA 民法 Code § 3071(k) Within 10 days after the sale of any vehicle pursuant to this section, the legal or registered owner may redeem the vehicle upon the payment of the amount of the sale, all costs and expenses of the sale, together with interest on the sum at the rate of 12 percent per annum from the due date thereof or the date when that sum was advanced until the repayment. If the vehicle is not redeemed, all lien sale documents required by the department shall then be completed and delivered to the buyer.
(l)CA 民法 Code § 3071(l) Any lien sale pursuant to this section shall be void if the lienholder does not comply with this chapter. Any lien for fees or storage charges for parking and storage of a motor vehicle shall be subject to Section 10652.5 of the Vehicle Code.
