(a)CA 政府 Code § 13332.19(a) 本节中,下列定义适用:
(1)CA 政府 Code § 13332.19(a)(1) “设计-建造”是指一种施工采购流程,其中项目的设计和施工均从单一实体采购。
(2)CA 政府 Code § 13332.19(a)(2) “渐进式设计-建造”是指一种项目交付流程,其中项目的设计和施工均从单一实体采购,该实体在项目最早可行阶段通过基于资质的遴选方式选定。
(3)CA 政府 Code § 13332.19(a)(3) “设计-建造项目”是指采用设计-建造施工采购流程的资本支出项目。
(4)CA 政府 Code § 13332.19(a)(4) “渐进式设计-建造项目”是指采用渐进式设计-建造施工采购流程的资本支出项目。
(5)CA 政府 Code § 13332.19(a)(5) “设计-建造实体”是指能够根据需要提供具备适当执照的承包、建筑和工程服务的合伙企业、公司或其他法律实体。
(6)CA 政府 Code § 13332.19(a)(6) “设计-建造招标包”是指绩效标准、任何概念图、合同形式以及所有其他文件和信息,这些文件和信息作为从设计-建造实体征集设计-建造项目投标或建议书的依据。
(7)CA 政府 Code § 13332.19(a)(7) “设计-建造阶段”是指在设计-建造项目合同授予设计-建造实体之后的一段时期,在此期间,设计-建造实体完成为完全按照合同条款完成项目所需的设计和施工活动。

(9)CA 政府 Code § 13332.19(a)(9) “基于资质的遴选”是指州机构为渐进式设计-建造项目从设计-建造实体征集服务的流程。
(10)CA 政府 Code § 13332.19(a)(10) “预施工阶段”是指在渐进式设计-建造项目合同授予设计-建造实体之后的一段时期,在此期间,设计-建造实体完成设计活动和任何为确定保证最高价格所需的预施工活动。
(11)CA 政府 Code § 13332.19(a)(11) “保证最高价格”是指总务部与设计-建造实体之间商定的最高支付金额,用于设计-建造实体完成所有剩余的设计、预施工和施工活动,以足以完成并结清渐进式设计-建造项目。如果完成所有剩余的设计、预施工和施工活动以足以完成并结清渐进式设计-建造项目的成本超过保证最高价格,则超出保证最高价格的成本应由设计-建造实体承担。如果这些活动的成本低于保证最高价格,设计-建造实体无权获得成本与保证最高价格之间的差额。这些金额应归还至拨款来源基金。
(12)CA 政府 Code § 13332.19(a)(12) “渐进式设计-建造阶段”是指预施工阶段之后所需的剩余设计和预施工活动,以及为完成渐进式设计-建造项目的施工和结清所需的所有施工活动。
(b)Copy CA 政府 Code § 13332.19(b)
(1)Copy CA 政府 Code § 13332.19(b)(1) 除第 (2) 和 (3) 款所述情况外,任何州机构,包括但不限于加州大学、加州州立大学、加州社区学院和司法委员会,不得支出为设计-建造项目或渐进式设计-建造项目拨付的资金,除非财政部和州公共工程委员会已批准绩效标准或保证最高价格。
(2)CA 政府 Code § 13332.19(b)(2) 第 (1) 款不适用于为设计-建造项目拨付的资金的以下任何情况:
(A)CA 政府 Code § 13332.19(b)(2)(A) 购置不动产的金额,无论是永久产权还是任何较小权益。
(B)CA 政府 Code § 13332.19(b)(2)(B) 设备的金额。
(C)CA 政府 Code § 13332.19(b)(2)(C) 为绩效标准拨付的金额。
(D)CA 政府 Code § 13332.19(b)(2)(D) 为初步计划拨付的金额,如果该拨款是在2005年1月1日之前进行的。
(A)CA 政府 Code § 13332.19(A) Amounts for acquisition of real property, in fee or any lesser
interest.

(C)CA 政府 Code § 13332.19(C) Amounts appropriated for qualification-based selection.
(D)CA 政府 Code § 13332.19(D) Amounts appropriated for the preconstruction phase.
(c)Copy CA 政府 Code § 13332.19(c)
(1)Copy CA 政府 Code § 13332.19(c)(1) If funds have been expended on the design-build phase or the progressive design-build phase of a project by any state agency prior to the approval
of the performance criteria or the guaranteed maximum price by the Department of Finance and the State Public Works Board, all appropriated amounts for the design-build phase or the progressive design-build phase of a project, including all amounts expended on design-build or progressive design-build activities, shall revert to the fund from which the appropriation was made.
(2)CA 政府 Code § 13332.19(c)(2) A design-build project for which a capital outlay appropriation is made shall not be put out to design-build solicitation until the bid package has been approved by the Department of Finance. A substantial change shall not be made to the performance
criteria as approved by the board and the Department of Finance without written approval by the Department of Finance. The Department of Finance shall approve any proposed bid or proposal alternates set forth in the design-build solicitation package.
(d)CA 政府 Code § 13332.19(d) The State Public Works Board may augment a design-build project or a progressive design-build project in an amount of up to 20 percent of the capital outlay appropriations for the project, irrespective of whether any such appropriation has reverted. For projects authorized through multiple fund sources, including, but not limited to, general obligation bonds and lease-revenue bonds, to the extent permissible, the Department of Finance shall have full authority to determine which of the fund sources will bear all or part of an augmentation. The board shall defer all augmentations in excess
of 20 percent of the amount appropriated for each design-build project or a progressive design-build project until the Legislature makes additional funds available for the specific project.
(e)CA 政府 Code § 13332.19(e) In addition to the powers provided by Section 15849.6, the State Public Works Board may further increase the additional amount in Section 15849.6 to include a reasonable construction reserve within the construction fund for any capital outlay project without augmenting the project. The amount of the construction reserve shall be within the 20 percent augmentation limitation. The board may use this amount to augment the project, when and if necessary, after the lease-revenue bonds are sold to ensure completion of the project.
(f)CA 政府 Code § 13332.19(f) Any augmentation in excess of 10 percent of the amounts
appropriated for each design-build project or a progressive design-build project shall be reported to the Chairperson of the Joint Legislative Budget Committee, or their designee, 20 days prior to board approval, or not sooner than whatever lesser time the chairperson, or their designee, may in each instance determine.

(1)Copy CA 政府 Code § 13332.19(g)(1) The Department of Finance may change the administratively or legislatively approved scope for major design-build projects or a progressive design-build projects.
(2)CA 政府 Code § 13332.19(g)(2) If the Department of Finance changes the approved scope pursuant to paragraph (1), the department shall report the changes and associated cost implications to the Chairperson of the Joint Legislative Budget Committee, the chairpersons of the respective fiscal committees, and the legislative members of the State Public Works Board 20 days prior to the proposed board
action to recognize the scope change.
(h)CA 政府 Code § 13332.19(h) The Department of Finance shall report to the Chairperson of the Joint Legislative Budget Committee, the chairpersons of the respective fiscal committees, and the legislative members of the State Public Works Board 20 days prior to the proposed board approval of performance criteria or guaranteed maximum price for any project when it is determined that the estimated cost of the total project is in excess of 20 percent of the amount recognized by the Legislature.
