就本章而言,下列术语具有以下含义:
(a)CA 商业与专业 Code § 4999.12(a) “委员会”指行为科学委员会。
(b)CA 商业与专业 Code § 4999.12(b) “经认可的”指经美国教育部认可的区域性或全国性机构认证机构认证的学校、学院或大学。
(c)CA 商业与专业 Code § 4999.12(c) “经批准的”指申请人从该学校、学院或大学毕业时,已获得私立高等教育局无条件批准的学校、学院或大学。
(d)CA 商业与专业 Code § 4999.12(d) “执照申请人”指已完成执照所需教育和所需监督经验时数的无执照人员。
(e)CA 商业与专业 Code § 4999.12(e) “持证专业临床咨询师”或“LPCC”指根据本章获准执业专业临床咨询的人员,其定义见第4999.20节。
(f)CA 商业与专业 Code § 4999.12(f) “助理”指符合第4999.42节要求并在委员会注册的无执照人员。
(g)CA 商业与专业 Code § 4999.12(g) “临床咨询师实习生”指目前就读于第4999.32节或第4999.33节规定的硕士或博士学位项目,旨在使该人员获得执照资格,并且已在任何符合资格的学位项目中完成不少于12个学期学分或18个季度学分的课程的无执照人员。
(h)CA 商业与专业 Code § 4999.12(h) “督导”指符合以下所有要求的人员:
(1)CA 商业与专业 Code § 4999.12(h)(1) 在任何督导之前紧邻的五年内,作为以下任一身份持有有效执照至少两年:
(A)CA 商业与专业 Code § 4999.12(h)(1)(A) 持证专业临床咨询师、持证婚姻与家庭治疗师、根据第6.6章(自第2900节起)获得执照的心理学家、持证临床社会工作者、持证教育心理学家,或同等的州外执照。持证教育心理学家只能督导与教育相关的心理健康服务,且该服务须符合第4989.14节规定的教育心理学家的执业范围。
(B)CA 商业与专业 Code § 4999.12(h)(1)(B) 经美国精神病学和神经病学委员会认证的精神病学专科医师,或经美国精神病学和神经病学委员会认证的州外持证精神病学专科医师。
(2)CA 商业与专业 Code § 4999.12(h)(2) 在任何督导之前紧邻的五年内,至少两年从事心理治疗、根据第4989.14节(a)款(5)项提供心理咨询,或对婚姻与家庭治疗师实习生、助理婚姻与家庭治疗师、助理专业临床咨询师或助理临床社会工作者进行的心理治疗提供直接临床督导。如果对社会工作实习生或专业临床咨询师实习生进行的心理治疗提供的督导与对注册人员要求的督导基本等同,则应予接受。
(3)CA 商业与专业 Code § 4999.12(h)(3) 已根据本章和法规的规定接受督导培训。
(4)CA 商业与专业 Code § 4999.12(h)(4) 未向被督导者提供治疗服务。
(5)CA 商业与专业 Code § 4999.12(h)(5) 持有并保持以下任一当前有效的、未被暂停或处于缓刑期的执照:
(A)CA 商业与专业 Code § 4999.12(h)(5)(A) 由委员会颁发的婚姻与家庭治疗师、专业临床咨询师、临床社会工作者或持证教育心理学家执照。
(B)CA 商业与专业 Code § 4999.12(h)(5)(B) 根据第6.6章(自第2900节起)获得执照的心理学家。
(C)CA 商业与专业 Code § 4999.12(h)(5)(C) 经美国精神病学和神经病学委员会认证的精神病学专科医师。
(6)CA 商业与专业 Code § 4999.12(h)(6) 不是被督导者的配偶、同居伴侣或亲属。
(7)CA 商业与专业 Code § 4999.12(h)(7) 目前或以前未与被督导者存在损害督导权威性或有效性的个人、专业或商业关系。
(i)CA 商业与专业 Code § 4999.12(i) “以客户为中心的倡导”包括但不限于研究、识别和获取资源,或与为接受心理治疗或咨询服务的客户或客户群体获取或提供服务和支持相关的其他活动。
(j)CA 商业与专业 Code § 4999.12(j) “Advertising” or “advertise” includes, but is not limited to, the issuance of any card, sign, or device to any person, or the causing, permitting, or allowing of any sign or marking on, or in, any
building or structure, or in any newspaper or magazine or in any directory, or any printed matter whatsoever, with or without any limiting qualification. It also includes business solicitations communicated by radio or television broadcasting. Signs within church buildings or notices in church bulletins mailed to a congregation are not advertising within the meaning of this chapter.
(k)CA 商业与专业 Code § 4999.12(k) “Referral” means evaluating and identifying the needs of a client to determine whether it is advisable to refer the client to other specialists, informing the client of that judgment, and communicating that determination as requested or deemed appropriate to referral sources.
(l)CA 商业与专业 Code § 4999.12(l) “Research” means a systematic effort to collect, analyze, and interpret quantitative and qualitative data that describes how
social characteristics, behavior, emotion, cognitions, disabilities, mental disorders, and interpersonal transactions among individuals and organizations interact.
(m)CA 商业与专业 Code § 4999.12(m) “Supervision” means responsibility for, and control of, the quality of mental health and related services provided by the supervisee. Consultation or peer discussion shall not be considered supervision and shall not qualify as supervised experience. Supervision includes, but is not limited to, all of the following:
(1)CA 商业与专业 Code § 4999.12(m)(1) Ensuring the extent, kind, and quality of counseling performed is consistent with the education, training, and experience of the supervisee.
(2)CA 商业与专业 Code § 4999.12(m)(2) Monitoring and evaluating the supervisee’s assessment, diagnosis, and treatment
decisions and providing regular feedback.
(3)CA 商业与专业 Code § 4999.12(m)(3) Monitoring and evaluating the supervisee’s ability to provide services at the site or sites where the supervisee is practicing and to the particular clientele being served.
(4)CA 商业与专业 Code § 4999.12(m)(4) Monitoring and addressing clinical dynamics, including, but not limited to, countertransference-, intrapsychic-, interpersonal-, or trauma-related issues that may affect the supervisory or the practitioner-patient relationship.
(5)CA 商业与专业 Code § 4999.12(m)(5) Ensuring the supervisee’s compliance with laws and regulations governing the practice of licensed professional clinical counseling.
(6)CA 商业与专业 Code § 4999.12(m)(6) Reviewing the supervisee’s progress notes, process notes, and other patient
treatment records, as deemed appropriate by the supervisor.
(7)CA 商业与专业 Code § 4999.12(m)(7) With the client’s written consent, providing direct observation or review of audio or video recordings of the supervisee’s counseling or therapy, as deemed appropriate by the supervisor.
(n)CA 商业与专业 Code § 4999.12(n) “Clinical setting” means any setting that meets both of the following requirements:
(1)CA 商业与专业 Code § 4999.12(n)(1) Lawfully and regularly provides mental health counseling or psychotherapy.
(2)CA 商业与专业 Code § 4999.12(n)(2) Provides oversight to ensure that the associate’s work meets the experience and supervision requirements set forth in this chapter and in regulation and is within the scope of practice of the profession.
