(a)CA 加利福尼亚宪法 Code § 2(a) 自2003-04财政年度及此后每个财政年度起,在该财政年度内根据《销售和使用税法》(《收入和税收法典》第2编第1部分(第6001条起))或该法的任何后续法律,对本州机动车燃料(根据《机动车燃料牌照税法》(《收入和税收法典》第2编第2部分(第7301条起))的定义)的销售、储存、使用或其他消费征收的所有税收收入,应存入交通投资基金或其后续基金,该基金特此在州财政部设立,并特此宣布为信托基金。州立法机关不得改变交通投资基金作为信托基金的地位。
(b)Copy CA 加利福尼亚宪法 Code § 2(b)
(1)Copy CA 加利福尼亚宪法 Code § 2(b)(1) 对于包括2003-04至2007-08财政年度在内的期间,交通投资基金中的资金应在立法机关拨款后,依照《收入和税收法典》第7104条(该条在2002年3月6日的文本)的规定进行分配。
(2)CA 加利福尼亚宪法 Code § 2(b)(2) 自2008-09财政年度及此后每个财政年度起,交通投资基金中的资金应仅用于以下目的:
(A)CA 加利福尼亚宪法 Code § 2(b)(2)(A) 公共交通和大众运输。拨给公共交通和大众运输的资金应按以下方式分配:(i) 百分之二十五依照《公共事业法典》第99312条 (b) 款(该条在2009年7月30日的文本);(ii) 百分之二十五依照《公共事业法典》第99312条 (c) 款(该条在2009年7月30日的文本);以及 (iii) 百分之五十用于《公共事业法典》第99315条 (a) 款和 (b) 款的目的(该条在2009年7月30日的文本)。
(B)CA 加利福尼亚宪法 Code § 2(b)(2)(B) 交通基本建设工程项目,受制于管理州交通改善计划或其任何后续计划的法律。
(C)CA 加利福尼亚宪法 Code § 2(b)(2)(C) 由城市(包括市县)实施的街道和公路的维护、修复、重建或风暴损坏修复。
(D)CA 加利福尼亚宪法 Code § 2(b)(2)(D) 由县(包括市县)实施的街道和公路的维护、修复、重建或风暴损坏修复。
(c)CA 加利福尼亚宪法 Code § 2(c) 自2008-09财政年度及此后每个财政年度起,交通投资基金中的资金特此持续拨付给审计长,不考虑财政年度,并应按以下方式分配:
(A)CA 加利福尼亚宪法 Code § 2(c)(A) 百分之二十的资金用于 (b) 款第 (2) 项 (A) 目中规定的目的。
(B)CA 加利福尼亚宪法 Code § 2(c)(B) 百分之四十的资金用于 (b) 款第 (2) 项 (B) 目中规定的目的。
(C)CA 加利福尼亚宪法 Code § 2(c)(C) 百分之二十的资金用于 (b) 款第 (2) 项 (C) 目中规定的目的。
(D)CA 加利福尼亚宪法 Code § 2(c)(D) 百分之二十的资金用于 (b) 款第 (2) 项 (D) 目中规定的目的。
(d)CA 加利福尼亚宪法 Code § 2(d) 州立法机关不得制定修改 (c) 款中规定的百分比份额的法规,除非发生以下所有情况:
(1)CA 加利福尼亚宪法 Code § 2(d)(1) 加州交通委员会已在本州不同地区举行不少于四次公开听证会,以征求公众对公共交通、大众运输、交通基本建设工程项目以及街道和公路维护需求的意见;
(2)CA 加利福尼亚宪法 Code § 2(d)(2) 加州交通委员会已发布一份报告,说明在公开听证会上收到的意见,以及对法定拨款的修改如何符合有序实现地方、区域和全州公共交通、大众运输、交通基本建设以及街道和公路维护的目标,且该方式与地方总体规划、区域交通规划和加州交通规划相符;
(3)CA 加利福尼亚宪法 Code § 2(d)(3) 自加州交通委员会发布报告之日起已满九十天。
(4)CA 加利福尼亚宪法 Code § 2(d)(4) 州立法机关根据本款制定的法规必须通过一项法案,该法案须经立法机关两院点名表决通过并载入议事记录,且获得三分之二成员的同意,但该法案不得包含任何其他无关条款,且 (a) 款所述的收入应仅用于 (b) 款第 (2) 项中规定的目的。
(e)Copy CA 加利福尼亚宪法 Code § 2(e)
(1)Copy CA 加利福尼亚宪法 Code § 2(e)(1) An amount equivalent to the total amount of revenues that were not transferred from the General Fund of the State to the Transportation Investment Fund, as of July 1, 2007, because of a suspension of transfer of revenues pursuant to this section as it read on January 1, 2006, but excluding the amount to be paid to the Transportation Deferred Investment Fund pursuant to Section 63048.65 of the Government Code, shall be transferred from the General Fund to the Transportation Investment Fund no later than June 30, 2016. Until this total amount has been transferred, the amount of transfer payments to be made in each fiscal year shall not be less than one-tenth of the total amount required to be transferred by June 30, 2016. The transferred revenues shall be allocated solely for the purposes set forth in this section as if they had been received in the absence of a suspension of transfer of revenues.
(2)CA 加利福尼亚宪法 Code § 2(e)(2) The Legislature may provide by statute for the issuance of bonds by the state or local agencies, as applicable, that are secured by the minimum transfer payments required by paragraph (1). Proceeds from the sale of those bonds shall be allocated solely for the purposes set forth in this section as if they were revenues subject to allocation pursuant to paragraph (2) of subdivision (b).
(f)CA 加利福尼亚宪法 Code § 2(f) This section constitutes the sole method of allocating, distributing, and using the revenues described in subdivision (a). The purposes described in paragraph (2) of subdivision (b) are the sole purposes for which the revenues described in subdivision (a) may be used. The Legislature may not enact a statute or take any other action which, permanently or temporarily, does any of the following:
(1)CA 加利福尼亚宪法 Code § 2(f)(1) Transfers, diverts, or
appropriates the revenues described in subdivision (a) for any other purposes than those described in paragraph (2) of subdivision (b);
(2)CA 加利福尼亚宪法 Code § 2(f)(2) Authorizes the expenditures of the revenues described in subdivision (a) for any other purposes than those described in paragraph (2) of subdivision (b) or;
(3)CA 加利福尼亚宪法 Code § 2(f)(3) Borrows or loans the revenues described in subdivision (a), regardless of whether these revenues remain in the Transportation Investment Fund or are transferred to another fund or account such as the Public Transportation Account, a trust fund in the State Transportation Fund.
(g)CA 加利福尼亚宪法 Code § 2(g) For purposes of this article, “mass transportation,” “public transit” and “mass transit” have the same meanings as “public transportation.” “Public transportation” means:

(A)Copy CA 加利福尼亚宪法 Code § 2(g)(1)(A) Surface transportation service provided to the general public, complementary paratransit service provided to persons with disabilities as required by 42 U.S.C. 12143, or similar transportation provided to people with disabilities or the elderly; (B) operated by bus, rail, ferry, or other conveyance on a fixed route, demand response, or otherwise regularly available basis; (C) generally for which a fare is charged; and (D) provided by any transit district, included transit district, municipal operator, included municipal operator, eligible municipal operator, or transit development board, as those terms were defined in Article 1 of Chapter 4 of Part 11 of Division 10 of the Public Utilities Code on January 1, 2009, a joint powers authority formed to provide mass transportation services, an agency described in subdivision (f) of Section 15975 of the Government Code, as that section read on January 1, 2009, any recipient of funds under Sections 99260, 99260.7, 99275,
or subdivision (c) of Section 99400 of the Public Utilities Code, as those sections read on January 1, 2009, or a consolidated agency as defined in Section 132353.1 of the Public Utilities Code, as that section read on January 1, 2009.
(2)CA 加利福尼亚宪法 Code § 2(g)(2) Surface transportation service provided by the Department of Transportation pursuant to subdivision (a) of Section 99315 of the Public Utilities Code, as that section read on July 30, 2009.
(3)CA 加利福尼亚宪法 Code § 2(g)(3) Public transit capital improvement projects, including those identified in subdivision (b) of Section 99315 of the Public Utilities Code, as that section read on July 30, 2009.
(h)CA 加利福尼亚宪法 Code § 2(h) If the Legislature reduces or repeals the taxes described in subdivision (a) and adopts an alternative source of revenue to replace the moneys derived from those taxes, the replacement revenue shall be deposited
into the Transportation Investment Fund, dedicated to the purposes listed in paragraph (2) of subdivision (b), and allocated pursuant to subdivision (c). All other provisions of this article shall apply to any revenues adopted by the Legislature to replace the moneys derived from the taxes described in subdivision (a).
