(a)CA 公用事业 Code § 130232(a) 除(f)和(g)款另有规定外,所有物资、设备和材料的采购,以及所有设施和工程的建设,当所需支出超过两万五千美元 ($25,000) 时,应当通过合同授予最低的负责任投标人。招标公告应至少在一家发行量大的报纸上刊登一次。刊登应在收到投标书之日前至少10天进行。委员会可自行决定拒绝任何及所有投标并重新招标。
(b)CA 公用事业 Code § 130232(b) 除(f)和(g)款另有规定外,凡预期所需支出超过一千美元 ($1,000) 但不超过两万五千美元 ($25,000) 时,委员会应获取至少三份书面或口头报价,以便比较价格和条款。
(c)CA 公用事业 Code § 130232(c) 如果投标价格所需的支出低于五万美元 ($50,000),执行董事可代表委员会行事。
(d)CA 公用事业 Code § 130232(d) 根据本节提交的所有建筑工程投标书应以密封形式提交,并附有以下任一种形式的投标人保证金:
(1)CA 公用事业 Code § 130232(d)(1) 现金。
(2)CA 公用事业 Code § 130232(d)(2) 开给委员会的银行本票。
(3)CA 公用事业 Code § 130232(d)(3) 开给委员会的保付支票。
(4)CA 公用事业 Code § 130232(d)(4) 由获准的担保保险公司出具的、开给委员会的投标保证金。
(e)CA 公用事业 Code § 130232(e) 在授予最低投标人后,未中标投标人的保证金应在合理时间内退还,但在任何情况下,委员会持有该保证金的时间不得超过授予合同之日起60天。
(f)CA 公用事业 Code § 130232(f) 以下规定仅适用于洛杉矶县大都会交通管理局:
(1)CA 公用事业 Code § 130232(f)(1) 当所有物资、设备和材料的采购价格超过十五万美元 ($150,000) 时,合同应授予最低的负责任投标人,或由管理局自行决定,授予根据招标文件中确定的因素向委员会提供最佳价值的提案提交人。“最佳价值”是指提案中质量、价格和其他要素的综合组合,当这些要素综合考虑时,能够根据招标文件中描述的要求提供最大的整体利益。当所有设施建设的采购价格超过两万五千美元 ($25,000) 时,合同应授予最低的负责任投标人。

(B)CA 公用事业 Code § 130232(f)(4)(B) 联邦、州或地方公共实体。

(A)Copy CA 公用事业 Code § 130232(f)(5)(A) 尽管有任何其他法律要求管理局将合同授予最低的负责任投标人,但管理局在促进与小型企业、中型企业、地方小型企业和残疾退伍军人企业签订合同时,除涉及《政府法典》第4525和4529.10节定义的私人建筑、景观建筑、工程、环境、土地测量或建设项目管理专业服务合同外,可以采取以下任何措施:
(i)CA 公用事业 Code § 130232(f)(5)(A)(i) 在建筑、设计-建造团队的建筑部分、货物采购或服务交付中,为小型企业提供优先权。对小型企业的优先权应为符合规范并提供小型企业参与的最低负责任投标人的5%。
(ii)CA 公用事业 Code § 130232(f)(5)(A)(ii) Provide for a local small business enterprise preference in construction, the construction component of a design-build team, the procurement of goods, or the delivery of services. The preference to a local small business enterprise shall be 5 percent of the lowest responsible bidder meeting specifications that provides for local small business enterprise participation. The authority may also offer the preference to a nonlocal business if the bid includes a 30-percent participation by local small business enterprises.
(iii)CA 公用事业 Code § 130232(f)(5)(A)(iii) Establish a subcontracting participation goal for small business enterprises on contracts financed with nonfederal funds and grant a preference of 5 percent to the lowest responsible bidders who meet the goal.
(iv)CA 公用事业 Code § 130232(f)(5)(A)(iv) Require bidders, before the time bids are opened, to comply with the small business enterprise and disabled veteran business enterprise goals and requirements established by the authority on contracts financed with nonfederal funds.
(v)CA 公用事业 Code § 130232(f)(5)(A)(v) In awarding contracts to the lowest responsible bidder, award the contract to the lowest responsible bidder meeting the small business enterprise and disabled veteran business enterprise goals.
(vi)CA 公用事业 Code § 130232(f)(5)(A)(vi) Until January
1, 2028, set aside work for competition among certified small business enterprises and award each contract to the lowest responsible bidder whenever the expected expenditure required exceeds five thousand dollars ($5,000) but is less than five million dollars ($5,000,000), as long as price quotations are solicited by the authority from three or more certified small business enterprises.
(vii)CA 公用事业 Code § 130232(f)(5)(A)(vii) Until January 1, 2028, set aside work for competition among medium business enterprises for no more than 20 contracts and award each contract to the lowest responsible bidder whenever the expected expenditure required exceeds five million dollars ($5,000,000) but is less than thirty million dollars ($30,000,000), as long as price quotations are solicited by the authority from three or more medium business enterprises.
(B)CA 公用事业 Code § 130232(f)(5)(A)(B) If the authority awards contracts pursuant to clause (vi) or (vii) of subparagraph (A), the authority, for purposes of legislative oversight, shall prepare and submit the reports described in this subparagraph to the Legislature regarding contracts awarded pursuant to clauses (vi) and (vii) of subparagraph (A). The reports shall be submitted in compliance with Section 9795 of the Government Code and shall be submitted in accordance with the following:
(i)CA 公用事业 Code § 130232(f)(5)(A)(B)(i) By December 31, 2023, for contracts issued between January 1, 2019, and December 31, 2023.
(ii)CA 公用事业 Code § 130232(f)(5)(A)(B)(ii) By December 31, 2026, for contracts issued between January 1, 2019, and December 31, 2026. The report shall note the number of employees working at a medium business
enterprise receiving awards pursuant to this section.
(C)CA 公用事业 Code § 130232(f)(5)(A)(C) A small or medium business enterprise recommended for a contract award through use of a set aside shall be performing a commercially useful function. A small business enterprise shall be presumed to be performing a commercially useful function if it performs and exercises responsibility of at least 30 percent of the total cost of the contract work with its own workforce.
(D)CA 公用事业 Code § 130232(f)(5)(A)(D) “Small business enterprise” as used in this paragraph, means a business enterprise that is classified as a small business under United States Small Business Administration rules and meets the current small business enterprise size standards found in Part 121 of Title 13 of the Code of Federal Regulations appropriate to the type of work the enterprise
seeks to perform. The authority may establish limitations regarding the average annual gross receipts of a small business over the previous three fiscal years and establish limitations regarding the personal net worth of the owner of the small business, exclusive of the value of the owner’s personal residence.
(E)CA 公用事业 Code § 130232(f)(5)(A)(E) “Local small business enterprise” as used in this paragraph, means a business enterprise that is classified as a small business under United States Small Business Administration rules, meets the current small business enterprise size standards found in Part 121 of Title 13 of the Code of Federal Regulations appropriate to the type of work the enterprise seeks to perform, and is headquartered in the County of Los Angeles.
(F)CA 公用事业 Code § 130232(f)(5)(A)(F) “Medium business enterprise” as used in this
paragraph means a company that is not a subsidiary of another company and that has a maximum of 250 employees and a maximum of two hundred fifty million dollars ($250,000,000) in gross annual receipts averaged over three years.
(G)CA 公用事业 Code § 130232(f)(5)(A)(G) “Disabled veteran business enterprise” as used in this paragraph has the meaning as defined in Section 999 of the Military and Veterans Code.
