(a)Copy CA 健康与安全 Code § 51335(a)
(1)Copy CA 健康与安全 Code § 51335(a)(1) 根据本章获得融资,或已获得融资延期或承诺的,多户租赁住房开发项目中的单元总数,应有不低于20%的单元优先供低收入家庭居住。如果多户租赁住房开发项目位于《美国法典》第26卷第143(j)条所述的目标区域内,则根据本章获得融资,或已获得融资延期或承诺的单元总数,应有不低于15%的单元优先供低收入家庭居住。低收入家庭优先居住所需的单元中,应有不低于一半的单元优先供极低收入家庭居住。但是,经董事会批准,如果机构认定在州内指定地理区域内,大量低收入家庭的住房需求无法通过其他方式得到满足,则机构可以免除极低收入家庭的优先居住要求。
极低收入家庭居住单元的租金(不包括州、联邦政府或任何其他公共机构向这些人员或代表这些单元提供的任何补充租金援助)不得超过区域中位收入的50%的30%。如果发起人选择为全部或部分低收入家庭和极低收入家庭单元设定基准租金,则基准租金应根据家庭规模进行调整。在根据家庭规模调整租金时,机构应假定一人居住单间公寓单元,两人居住一居室单元,三人居住两居室单元,四人居住三居室单元,五人居住四居室单元;或者,自2016年9月1日起,采用其认为根据本章提供的融资适当且商业合理的入住假设。
(2)CA 健康与安全 Code § 51335(2) 负责为多户租赁住房开发项目发放许可证的地方机构,应考虑通过以下优惠和鼓励措施,为单元的经济可行性以及为极低收入家庭提供单元做出贡献:
(A)CA 健康与安全 Code § 51335(2)(A) 减少施工和设计要求。
(B)CA 健康与安全 Code § 51335(2)(B) 减少退界和建筑面积要求,以及原本所需的车辆停车位比例。
(C)CA 健康与安全 Code § 51335(2)(C) 授予密度奖励。
(D)CA 健康与安全 Code § 51335(2)(D) 提供快速许可证办理。
(E)CA 健康与安全 Code § 51335(2)(E) 修改分区法规要求以允许混合用途分区。
(F)CA 健康与安全 Code § 51335(2)(F) 减少或取消申请、请愿、许可证、规划服务、水和污水连接以及其他费用和收费的提交和办理费用。
(G)CA 健康与安全 Code § 51335(2)(G) 减少或取消与金钱征收、土地奉献、土地保留或公共设施建设相关的要求。
(H)CA 健康与安全 Code § 51335(2)(H) 机构确定的,导致可识别成本降低的多户租赁住房开发项目的其他财政激励或优惠。机构应确保负责为开发项目发放许可证的地方机构,考虑其在本节下的责任,并真诚努力提高项目的可行性,为低收入家庭和极低收入家庭提供住房。

(5)CA 健康与安全 Code § 51335(5) It is the intent of the Legislature that the agency finance projects that assist in meeting the urgent need for providing shelter for families. To that end, developments with three- and four-bedroom units affordable to larger families shall have priority over competing developments.
(b)CA 健康与安全 Code § 51335(b) As a condition of financing pursuant to this chapter, the housing sponsor shall enter into a regulatory agreement
with the agency providing that units reserved for occupancy by lower income households remain available on a priority basis for occupancy until the bonds are retired. The regulatory agreement shall contain a provision making the covenants and conditions of the agreement binding upon successors in interest of the housing sponsor and, notwithstanding any other provision of law, these burdens of the regulatory agreement shall run with the land. The regulatory agreement shall be recorded in the office of the county recorder of the county in which the multifamily rental housing development is located. The regulatory agreement shall be recorded in the grantor-grantee index to the name of the property owner as grantor and to the name of the agency as grantee.
(c)CA 健康与安全 Code § 51335(c) The agency shall ensure that units occupied by lower income households are of
comparable quality and offer a range of sizes and number of bedrooms comparable to those units which are available to other tenants.
(d)Copy CA 健康与安全 Code § 51335(d)
(1)Copy CA 健康与安全 Code § 51335(d)(1) The agency shall give priority to processing construction loans and mortgage loans or may take other steps such as reducing loan fees for multifamily rental housing developments which incorporate innovative and energy-efficient techniques which reduce development or operating costs and which have the lowest feasible per unit cost, as determined by the agency, based on efficiency of design, the elimination of improvements that are not required by applicable building standards, or a reduction in the amount of local fees imposed on the development.
(2)CA 健康与安全 Code § 51335(d)(2) The agency shall give equal priority to processing construction loans
and mortgage loans or may take other steps such as reducing loan fees on multifamily rental housing developments which do any of the following:
(A)CA 健康与安全 Code § 51335(d)(2)(A) Utilize federal housing or development assistance.
(B)CA 健康与安全 Code § 51335(d)(2)(B) Utilize redevelopment funds or other local financial assistance, including, but not limited to, contributions of land, or for which local fees have been reduced.
(C)CA 健康与安全 Code § 51335(d)(2)(C) Are sponsored by a nonprofit housing organization.
(D)CA 健康与安全 Code § 51335(d)(2)(D) Provide a significant number of housing units, as determined by the agency, as part of a coordinated jobs and housing plan adopted by a local government.
(E)CA 健康与安全 Code § 51335(d)(2)(E) Exceed a ratio whereby 20
percent of the units are reserved for occupancy by lower income households, or whereby 10 percent of the units are reserved for occupancy by very low income households, or which provide units for lower income households or very low income households for the longest period of time beyond the minimum number of years.
(e)Copy CA 健康与安全 Code § 51335(e)
(1)Copy CA 健康与安全 Code § 51335(e)(1) New and existing rental housing developments may be syndicated after prior written approval of the agency. The agency shall grant that approval only after the agency determines that the terms and conditions of the syndication comply with this section.
(2)CA 健康与安全 Code § 51335(e)(2) The terms and conditions of the syndication shall not reduce or limit any of the requirements of this chapter or regulations adopted or documents executed pursuant to this chapter. No requirements
of the state shall be subordinated to the syndication agreement. A syndication shall not result in the provision of fewer assisted units, or the reduction of any benefits or services, than were in existence prior to the syndication agreement.
