在本条中,下列术语的含义如下:
(a)CA 保险 Code § 926.1(a) “区域中位收入”(AMI)指以下任一情况:
(1)CA 保险 Code § 926.1(a)(1) 如果个人或地理区域位于大都市统计区(MSA)内,则指该MSA的家庭收入中位数;如果个人或地理区域位于已细分为大都市分区(metropolitan divisions)的MSA内,则指该大都市分区的家庭收入中位数。
(2)CA 保险 Code § 926.1(a)(2) 如果个人或地理区域位于MSA之外,则指全州非大都市区的家庭收入中位数。
(b)CA 保险 Code § 926.1(b) “社区发展投资”指一项投资,其全部或部分主要目的在于为加州服务不足或中低收入的个人、家庭或社区进行社区发展,或直接使其受益。“社区发展投资”包括但不限于在加州进行的以下投资:
(1)CA 保险 Code § 926.1(b)(1) 为服务不足或中低收入的个人或家庭提供的经济适用房,包括多户租赁和自有住房。
(2)CA 保险 Code § 926.1(b)(2) 直接惠及服务不足或中低收入的个人、家庭或社区的社区设施或社区服务提供者(包括教育、医疗或社会服务提供者)。
(3)CA 保险 Code § 926.1(b)(3) 能够带来惠益的经济发展,包括但不限于为服务不足或中低收入的个人、家庭或社区(包括城市或农村社区),或为服务这些社区的企业或非营利社区服务组织创造、保留或改善就业,或提供所需资本。
(4)CA 保险 Code § 926.1(b)(4) 振兴或稳定服务不足或中低收入社区的活动。
(5)CA 保险 Code § 926.1(b)(5) 投资于或通过加州有组织投资网络(COIN)认证的社区发展金融机构(CDFIs)进行的投资,以及根据联邦、州或地方社区发展投资计划或社区发展投资税收激励计划的要求进行的投资,前提是这些投资直接惠及服务不足或中低收入的个人、家庭和社区,并符合本条规定。
(6)CA 保险 Code § 926.1(b)(6) 社区发展基础设施投资。
(7)CA 保险 Code § 926.1(b)(7) 投资于位于服务不足或中低收入地理区域的商业地产,并符合本条规定。
(8)CA 保险 Code § 926.1(b)(8) 投资于保留地社区。“保留地”指由美洲原住民部落在联邦印第安事务局管辖下管理的土地区域,前提是该部落列于印第安事务局在《联邦公报》上发布的最新“经印第安事务局认可并有资格获得服务的印第安实体”名单或其后续文件中。
(9)CA 保险 Code § 926.1(b)(9) 投资于农村地区。“农村地区”指任何开阔地带或任何地方、城镇、村庄或城市,其本身以及与它所属或相关的任何其他地方、城镇、村庄或城市合计,人口不超过10,000人,或者人口不超过50,000人且位于非大都市区内。“农村地区”也指位于标准MSA内的任何开阔地带、地方、城镇、村庄或城市,如果该地区人口不超过50,000人,该地区不属于或不与城市区域相关联,且该地区具有农村特征。
(c)CA 保险 Code § 926.1(c) “社区发展基础设施”指加州债务,包括由加州或加州州或地方政府机构发行的所有债务,如果该债务的全部或部分主要目的在于为服务不足或中低收入社区进行社区发展,或直接使其受益,并符合 (b) 款的规定。
(d)CA 保险 Code § 926.1(d) “多元化投资经理”指投资管理组织,包括公司、公司内部的团体和个人、合伙企业、有限责任公司以及其他特殊目的载体,这些组织位于加州或积极在加州进行并持有投资,且其投资经理至少有51%由女性、退伍军人、少数族裔、女同性恋、男同性恋、双性恋、跨性别者或酷儿组成,或由这些群体中人员的组合组成。
(e)CA 保险 Code § 926.1(e) “地理区域”指美国人口普查局在最近一次十年期人口普查中划定的人口普查区。
(f)CA 保险 Code § 926.1(f) “Green investments” means investments that emphasize renewable energy projects, economic development, and affordable housing focused on infill sites so as to reduce the degree of automobile dependency and promote the use and reuse of existing urbanized lands supplied with infrastructure for the purpose of accommodating new growth and jobs. “Green investments” also means investments that can help communities grow through new capital investment in the maintenance and rehabilitation of existing infrastructure so that the reuse and reinvention of city centers and existing transportation corridors and community space, including projects offering energy efficiency improvements and renewable energy generation, including, but not limited to, solar and wind power, water and waste management, sustainable agriculture, mixed-use
development, affordable housing opportunities, multimodal transportation systems, and transit-oriented development, can advance economic development, jobs, and housing.
(g)CA 保险 Code § 926.1(g) “Impact investments” means investments that provide a social or environmental benefit to underserved or low-to-moderate-income individuals, families, or communities in California.
(h)CA 保险 Code § 926.1(h) “High-impact investments” means investments that are innovative, responsive to community needs, not routinely provided by insurers, and provide a minimum of 50 percent social or environmental benefits to underserved or low-to-moderate-income individuals, families, or communities in California.
(i)CA 保险 Code § 926.1(i) “Insurer” means an admitted insurer as defined in Section 24,
including the State Compensation Insurance Fund, or a domestic fraternal benefit society as defined in Section 10990.
(j)CA 保险 Code § 926.1(j) “Investment” means a lawful equity or debt investment, or loan, or deposit obligation, or other investment or investment transaction allowed by the Insurance Code.
(k)CA 保险 Code § 926.1(k) “Low-income” means an individual income that is less than 50 percent of the AMI, or a median family income that is less than 50 percent of the AMI in the case of a geographical area.
(l)CA 保险 Code § 926.1(l) “MSA” means a metropolitan statistical area as defined by the Director of the Office of Management and Budget.
(m)CA 保险 Code § 926.1(m) “Moderate-income” means an individual income that is at least 50 percent but
less than 80 percent of the AMI, or a median family income that is at least 50 percent but less than 80 percent of the AMI in the case of a geographical area.
(n)CA 保险 Code § 926.1(n) “Nonmetropolitan area” means any area that is not located in an MSA.
