Section § 13953.2
This law states that if an agricultural drainage system in the San Joaquin Valley is constructed and releases water into specific nearby water bodies, the state will only permit it if certain requirements are fulfilled. These requirements include ensuring that the discharge protects the valuable uses of the water bodies it enters, like the Delta and Suisun Marsh. This protection might involve providing alternative water supplies without imposing additional costs on users.
The drainage system must be flexible enough to manage and treat the discharged water, and a monitoring program is required to observe its environmental effects. Furthermore, a funded initiative is needed to investigate using the drain's water to establish wetlands for waterfowl. When setting up repayment plans, the facility should also take into account factors such as the volume of wastewater and its salt content.
The permit must include enforceable provisions to guarantee that any leaks are confined within designated boundaries, and if a leak occurs, the drainage system must cease operation until it is repaired. The route of the drainage facility should, wherever feasible, be planned to minimize disruption to existing infrastructure and access to land.
If an agricultural drain in the San Joaquin Valley, including the drainage facility approved as part of the San Luis Unit of the federal Central Valley Project, is built and releases water into the Delta, Suisun Bay, or Carquinez Straits, the state board will only allow this discharge under this division if the state board determines that these additional conditions are met:
(a)CA Tubig Code § 13953.2(a) The drain's discharge, which is intended to carry only subsurface agricultural drainage wastewater, must be positioned and release water at flow rates that protect the beneficial uses of the Delta, Suisun Marsh, and the bays extending west to the Golden Gate. If it is decided that providing an alternative water supply to water users is in the public interest, instead of changing how the drain operates or where it discharges, water users will not face any additional financial costs simply because of that substitution.
(b)CA Tubig Code § 13953.2(b) The drainage facility must incorporate inherent operational flexibility, control mechanisms, and treatment capabilities to safeguard the beneficial uses of the Delta, Suisun Marsh, and the bays extending west to the Golden Gate.
(c)CA Tubig Code § 13953.2(c) An acceptable comprehensive monitoring program must be established before and during the drain's operation to assess any impact of the discharged wastewater on the Delta, Suisun Marsh, and the bays extending west to the Golden Gate.
(d)CA Tubig Code § 13953.2(d) A program has been developed, funded, and started to assess whether it is practical to use drain water to create wetland habitats that can provide food for wintering waterfowl.
(e)CA Tubig Code § 13953.2(e) The repayment plan for the drain must consider the following:
(1)CA Tubig Code § 13953.2(e)(1) The amount of wastewater discharged into the drain by the entity releasing it.
(2)CA Tubig Code § 13953.2(e)(2) The salt concentration in the wastewater from the entity releasing it.
(3)CA Tubig Code § 13953.2(e)(3) The distance the wastewater from the entity releasing it travels within the drain.
(4)CA Tubig Code § 13953.2(e)(4) The amount of water used in the areas that contribute to the drainage issue.
(f)CA Tubig Code § 13953.2(f) The permit must include an enforceable clause stating that any surface or subsurface wastewater leakage must be contained within the drainage facility's right-of-way, and if this condition is breached, the drainage facility must cease operation until the leakage is halted.
(g)CA Tubig Code § 13953.2(g) The route of the drainage facility, as much as possible, should be designed to reduce issues with dividing land and restricting access to properties, roads, and other structures along its right-of-way.

Section § 13953.4
