This law states that if an agricultural drainage system in the San Joaquin Valley is constructed and releases water into specific nearby water bodies, the state will only permit it if certain requirements are fulfilled. These requirements include ensuring that the discharge protects the valuable uses of the water bodies it enters, like the Delta and Suisun Marsh. This protection might involve providing alternative water supplies without imposing additional costs on users.
The drainage system must be flexible enough to manage and treat the discharged water, and a monitoring program is required to observe its environmental effects. Furthermore, a funded initiative is needed to investigate using the drain's water to establish wetlands for waterfowl. When setting up repayment plans, the facility should also take into account factors such as the volume of wastewater and its salt content.
The permit must include enforceable provisions to guarantee that any leaks are confined within designated boundaries, and if a leak occurs, the drainage system must cease operation until it is repaired. The route of the drainage facility should, wherever feasible, be planned to minimize disruption to existing infrastructure and access to land.
