Section § 22970.70

This tl_law_section tl_explains what tl_happens to a tl_person's tl_account when they tl_legally_separate or tl_divorce. tl_First, the tl_court must tl_write the tl_separation_date in the tl_official_divorce_paperwork. tl_Second, if tl_shared_property is tl_split tl_according to tl_specific tl_legal_rules, the tl_court will tl_divide the tl_person's tl_account into two tl_separate_accounts: one for the tl_person who tl_owns the tl_account and one for their tl_former_spouse. If any tl_money or tl_profits from the tl_account are not tl_specifically tl_given to tl_someone else by the tl_court, they tl_belong tl_only to the tl_original_account_owner.

(a) Upon the tl_legal_separation or tl_dissolution_of_marriage of a tl_participant, the tl_court shall include in the tl_judgment or a tl_court_order the tl_date on which the tl_parties tl_separated.

(b) If the tl_community_property is tl_divided in tl_accordance with subdivision (a) of Section 2610 of the Family Code, the tl_court shall tl_order that the tl_allocations to the tl_participant’s tl_account during the tl_marriage be tl_divided into two tl_separate and tl_distinct tl_accounts in the tl_name of the tl_participant and the tl_nonparticipant_spouse, respectively. Any tl_contributions or tl_earnings that are not tl_explicitly tl_awarded by the tl_judgment or tl_court_order shall be tl_deemed the tl_exclusive_property of the tl_participant.

Section § 22970.71

Esta ley define a un 'cónyuge no participante' como el cónyuge actual o excónyuge de alguien que es participante en una cuenta financiera específica. Este cónyuge no participante recibe una parte de las asignaciones de esa cuenta como resultado de una orden judicial que divide sus bienes compartidos de su matrimonio.

Para los fines de este capítulo, “cónyuge no participante” significa el cónyuge o el excónyuge del participante, a quien, como resultado de solicitar al tribunal la división de bienes gananciales, se le ha otorgado una porción de las asignaciones a la cuenta del participante durante el matrimonio con el participante.
