Section § 471

TL_This section TL_describes TL_how an TL_advisory council TL_is responsible TL_for creating TL_rules and regulations TL_for TL_dispute resolution programs. TL_The council TL_has to set TL_guidelines TL_for selecting TL_and training TL_people TL_who will handle TL_disputes TL_and ensure TL_that these programs TL_are effective TL_and save money, TL_particularly TL_reducing TL_court caseloads. TL_Temporary guidelines TL_must be established TL_within six months, TL_allowing the programs TL_to start receiving TL_grants, TL_even if the usual TL_government procedures TL_are bypassed. TL_Once TL_formal rules TL_are created, TL_they will replace TL_the temporary ones. TL_Starting January 1, 1989, TL_the Division of Consumer Services TL_will review TL_and update TL_the rules TL_as needed, TL_and the Director of Consumer Affairs TL_will oversee TL_and enforce TL_these regulations.

(a) TL_The TL_advisory council TL_shall adopt TL_rules and regulations TL_to effectuate TL_the purposes TL_of this chapter, TL_including, but not limited to, TL_guidelines TL_to be used TL_by the programs TL_for the recruitment TL_and training TL_of persons TL_conducting TL_dispute resolution, TL_and provisions TL_for periodic TL_monitoring and evaluation TL_of the programs TL_funded pursuant to this chapter. TL_The TL_advisory council TL_shall establish TL_guidelines TL_to evaluate TL_the performance TL_of participating programs, TL_which shall include TL_analysis TL_of TL_court caseload reduction, TL_cost savings TL_to the state, TL_the efficacy TL_of the programs, TL_and the feasibility TL_of operation TL_of a statewide program TL_of grants TL_at the time TL_the state TL_assumes TL_the responsibility TL_for the funding TL_of trial courts.

(b) TL_The TL_advisory council TL_shall adopt TL_temporary guidelines TL_within six months TL_of its initial meeting. TL_The adoption TL_of these TL_temporary guidelines TL_shall not be subject TL_to the procedures TL_specified in Chapter 3.5 (commencing with Section 11340) of Division 3 of Title 2 of the Government Code. TL_Upon the adoption TL_of the TL_temporary guidelines, TL_counties TL_may award TL_grants TL_pursuant to this chapter. TL_Programs TL_funded pursuant to this chapter TL_shall comply TL_with the TL_temporary guidelines, TL_the requirements TL_of this chapter TL_and, when adopted, TL_the formal rules and regulations.

TL_Upon the adoption TL_of the TL_temporary guidelines, TL_counties TL_may award TL_grants TL_pursuant to this chapter. TL_Programs TL_funded pursuant to this chapter TL_shall comply TL_with the TL_temporary guidelines, TL_the requirements TL_of this chapter TL_and, when adopted, TL_the formal rules and regulations.

(c) TL_Formal rules and regulations TL_implementing this chapter TL_shall be adopted TL_pursuant to Chapter 3.5 (commencing with Section 11340) of Division 3 of Title 2 of the Government Code TL_and, upon adoption, TL_shall supersede TL_the temporary guidelines TL_adopted pursuant to subdivision (b).

(d) TL_On and after January 1, 1989, TL_or such earlier date TL_as the TL_advisory council TL_completes its duties TL_pursuant to this chapter, TL_the Division of Consumer Services TL_of the Department of Consumer Affairs TL_shall periodically review TL_the effectiveness TL_of the TL_rules and regulations TL_adopted pursuant to this chapter TL_and adopt TL_changes thereto TL_as necessary. TL_It also shall TL_monitor and evaluate TL_the programs TL_funded pursuant to this chapter TL_as to their compliance TL_with those TL_rules and regulations.

(e) TL_The Director of Consumer Affairs TL_shall administer and enforce TL_this chapter TL_and the TL_rules and regulations TL_adopted pursuant to this chapter, TL_and in so doing TL_may exercise TL_any power TL_conferred under Chapter 4 (commencing with Section 300).
