Section § 151001

Explanation

Section § 151002

Explanation

This statute establishes criteria for sexual health education initiatives within California. All such initiatives are mandated to furnish information that is medically precise and current, employing the most recent scientific findings on sexual health subjects. They must also be suitable for the age and cultural background of the audience, and refrain from advocating religious doctrines or prejudices. Furthermore, they should address contraception and methods for preventing sexually transmitted diseases that are approved by the FDA. For initiatives directed at young individuals, it is compulsory to include information that refraining from sexual activity ensures the avoidance of pregnancy and STDs; however, for those under 12, discussing FDA-approved methods is not obligatory. Initiatives conducted in public schools must conform to particular educational regulations depending on the subjects covered, such as HIV/AIDS or pregnancy prevention. Those seeking funding are required to attest to their adherence, and any breaches could result in the cessation of funds. These directives do not impact private health consultations, nor do they supersede more extensive sexual education legislation.

(a)CA Kalusugan At Kaligtasan Code § 151002(a) Each program for sexual health education must fulfill all of the subsequent stipulations:
(1)CA Kalusugan At Kaligtasan Code § 151002(a)(1) All provided information must be medically precise, up-to-date, and impartial.
(2)CA Kalusugan At Kaligtasan Code § 151002(a)(2) Persons delivering instruction or information are required to be knowledgeable of and utilize the most recent scientific data concerning human sexuality, human development, pregnancy, and sexually transmitted illnesses.
(3)CA Kalusugan At Kaligtasan Code § 151002(a)(3) The content of the program must be suitable for the age group of its intended audience.
(4)CA Kalusugan At Kaligtasan Code § 151002(a)(4) The program must be culturally and linguistically fitting for its intended populations.
(5)CA Kalusugan At Kaligtasan Code § 151002(a)(5) The program is prohibited from teaching or advocating religious dogma.
(6)CA Kalusugan At Kaligtasan Code § 151002(a)(6) The program must not exhibit or foster prejudice against any individual based on disability, gender, nationality, race or ethnicity, religion, or sexual orientation, as specified in Section 422.56 of the Penal Code.
(7)CA Kalusugan At Kaligtasan Code § 151002(a)(7) The program is to furnish information regarding the efficacy and safety of at least one or more medications or devices sanctioned by the federal Food and Drug Administration for the prevention of pregnancy and for diminishing the risk of acquiring sexually transmitted diseases.
(b)CA Kalusugan At Kaligtasan Code § 151002(b) A sexual health education program specifically aimed at minors must adhere to all criteria outlined in subdivision (a) and must additionally satisfy both of the subsequent requirements:
(1)CA Kalusugan At Kaligtasan Code § 151002(b)(1) It must incorporate information stating that the sole definitive method to prevent pregnancy is to refrain from sexual intercourse, and that the sole definitive method to prevent sexually transmitted diseases is to refrain from activities demonstrated to transmit sexually transmitted diseases.
(2)CA Kalusugan At Kaligtasan Code § 151002(b)(2) Should the program be directed towards minors below the age of 12 years, it may, though is not obligated to, include information otherwise mandated in accordance with paragraph (7) of subdivision (a).
(c)CA Kalusugan At Kaligtasan Code § 151002(c) A sexual health education program delivered by an external agency at a publicly funded school must conform to the stipulations of Section 51934 of the Education Code if the program pertains to HIV/AIDS, and must conform to Section 51933 of the Education Code if the program pertains to pregnancy prevention and sexually transmitted diseases other than HIV/AIDS.
(d)CA Kalusugan At Kaligtasan Code § 151002(d) An entity applying for funds to manage a sexual health education program must certify in writing that its program adheres to all funding conditions, including those specified in this section. A publicly funded school that receives only general funds for providing comprehensive sexual health instruction or HIV/AIDS prevention instruction will not be considered an applicant for the intent of this subdivision.
(e)CA Kalusugan At Kaligtasan Code § 151002(e) If the program is carried out by an external agency at a publicly funded school, the applicant must state in writing how the program integrates with the school’s strategy to fully meet the requirements of the California Comprehensive Sexual Health and HIV/AIDS Prevention Education Act, Chapter 5.6 (commencing with Section 51930) of the Education Code. Irrespective of Section 47610 of the Education Code, “publicly funded school” encompasses a charter school for the objectives of this subdivision.
(f)CA Kalusugan At Kaligtasan Code § 151002(f) Oversight of adherence to this division must be incorporated into the procedures for grant monitoring and compliance. If the agency becomes aware that a grantee is not in compliance with this section, the agency is obligated to terminate the contract or undertake other suitable measures.
(g)CA Kalusugan At Kaligtasan Code § 151002(g) This section is not to be interpreted as restricting the requirements of the California Comprehensive Sexual Health and HIV/AIDS Prevention Education Act (Chapter 5.6 (commencing with Section 51930) of Part 28 of the Education Code).
(h)CA Kalusugan At Kaligtasan Code § 151002(h) This section does not pertain to individual interactions between a health practitioner and their patient within a clinical environment.
