Section § 26222

Explanation

This law sets out the rules for training and certifying Certified Animal Control Officers (CACOs) in California. The board, working with a CalAnimals training committee, must create these rules, making sure they are at least as strict as what's written in this chapter. The main goal is to improve the professional skills and ethical conduct of animal control officers.

To become certified, people need to complete at least 20 hours of training in animal care and 40 hours in state laws about treating animals humanely and enforcing those laws. They also need to complete 40 hours of ongoing training every three years. If someone completed the required training before January 1, 2020, and within 10 years of working as an animal control officer, the board can count that training. The board can also add more levels of certification.

(a)CA Kalusugan at Kaligtasan Code § 26222(a) The board is mandated to establish and uphold standards applicable to diverse categories of CACOs. The criteria for education, training, and certification shall be formally adopted through administrative rule by the board, and these shall not be less stringent than those detailed within this chapter. A CalAnimals training committee shall undertake the review of these standards and furnish its recommendations to the board for their official adoption.
(b)CA Kalusugan at Kaligtasan Code § 26222(b) The continuous development and advancement of professional standards for animal control officers, alongside the active provision of pertinent educational opportunities designed to enhance professional competence and ethical conduct, shall constitute the paramount priorities for the board in its functions pertaining to licensing, certification, and disciplinary actions. Should the advancement of animal control officer professional standards and the provision of related educational offerings conflict with other interests intended for promotion, the former shall take precedence.
(c)CA Kalusugan at Kaligtasan Code § 26222(c) The foundational requirements for an individual to become a certified animal control officer are delineated as follows:
(1)CA Kalusugan at Kaligtasan Code § 26222(c)(1)  Successful completion of a minimum of 20 hours of a training course focused on animal care, which must be sponsored or provided by an accredited postsecondary institution or any other provider sanctioned by the California Veterinary Medical Association. The primary objective of this course is the identification of disease, injury, and neglect in domestic animals and livestock.
(2)CA Kalusugan at Kaligtasan Code § 26222(c)(2)  Successful completion of a minimum of 40 hours of a training course concerning state laws pertinent to the powers and responsibilities of an officer tasked with enforcing statutes related to the humane treatment of animals. This course must be sponsored or provided by an accredited postsecondary institution, a law enforcement agency, or CalAnimals. Training mandated pursuant to Section 830.9 of the Penal Code, as specified in Section 832 of the Penal Code, does not fulfill the minimum 40 hours of training stipulated by this paragraph. The curriculum for this course shall encompass, but not be restricted to, training and competency requirements in the domains of administrative inspection, relevant food and agricultural legislation, Penal Code provisions governing animal treatment and animal-related offenses, state and local health and safety codes, environmental regulations, public nuisance statutes, applicable constitutional law, investigative and enforcement methodologies, the application of legal remedies, officer safety protocols, and strategies for community engagement.
(3)CA Kalusugan at Kaligtasan Code § 26222(c)(3) During each three-year interval subsequent to the date on which certification was initially obtained, the completion of 40 hours of continuing education and training relevant to the powers and duties of an animal control officer is required. This continuing education shall be sponsored or provided by an accredited postsecondary institution, a law enforcement agency, or CalAnimals. Documentation verifying this completion must be submitted to CalAnimals no later than 21 days following the expiration of each three-year period.
(4)CA Kalusugan at Kaligtasan Code § 26222(c)(4) An individual who has achieved CACO status in accordance with paragraph (1) is obligated to complete the continuing education and training as mandated in this section, commencing from the date their certification is officially granted by the board.
(d)CA Kalusugan at Kaligtasan Code § 26222(d) Should an applicant have, prior to January 1, 2020, successfully completed the training specified in paragraphs (1) and (2) of subdivision (c) within the preceding 10 years of the applicant’s employment as an animal control officer, the board shall consider the applicant to have satisfied the training prerequisites of those paragraphs.
(e)CA Kalusugan at Kaligtasan Code § 26222(e) The board retains the authority, through administrative rule, to designate supplementary levels of certification.

Section § 26223

Explanation

Section § 26224

Explanation

Section § 26226

Explanation

Section § 26230

Explanation
