Section § 25910

Explanation

This enactment principally prohibits the dispersion by spraying, vending, or fabrication of materials containing any asbestos within edifices during their erection, modification, or rectification, save where specific exceptions are applicable. Portland cement plaster comprising less than 0.5% asbestos was initially exempted until July 1, 1979, contingent upon the unavailability of safer alternatives. Public convocations were to be conducted to categorize exempted utilizations.

Coatings and resins incorporating encapsulated asbestos, cold process asphalt roof coverings, and substances with inherent impurities below 0.25% asbestos were likewise exempted until July 1, 1979, subject to an analogous review process. Safety directives established exposure thresholds for laborers during the manipulation of these materials.

Subsequent to July 1, 1979, exemptions could be revised based on novel regulatory provisions. Examinations by the Division of Industrial Safety are not constrained by these exemptions, and extant safety and reporting protocols must continue to be observed.

(a)CA Kalusugan at Kaligtasan Code § 25910(a) Save as stipulated in subdivision (c), (d), or (e), no individual shall instigate or permit the dispersion by spraying of any substance containing any measure of asbestos within or upon a edifice or other structure during its erection, modification, or rectification.
(b)CA Kalusugan at Kaligtasan Code § 25910(b) Save as stipulated in subdivision (c), (d), or (e), no individual shall vend, transfer, procure, or fabricate, including intermix, compound, form into slurry, suspend, or in any other manner prepare any substance containing any measure of asbestos which would, if dispersed by spraying within or upon a edifice or other structure during its erection, modification, or rectification, be regulated pursuant to subdivision (a).
(c)Copy CA Kalusugan at Kaligtasan Code § 25910(c)
(1)Copy CA Kalusugan at Kaligtasan Code § 25910(c)(1) Portland cement plaster comprising less than one-half of 1 percent asbestos shall be exempted from the stipulations of this chapter until July 1, 1979.
(2)CA Kalusugan at Kaligtasan Code § 25910(c)(2) Pursuant to the stipulations of Chapter 6 (commencing with Section 140) of Division 1 of the Labor Code, on or prior to June 1, 1979, the Occupational Safety and Health Standards Board shall conduct public convocations for the purpose of establishing categorizations of methodologies and processes which are exempted from the prohibition of subdivision (a) for the utilization of portland cement plaster which comprises less than one-half of 1 percent asbestos if no economically viable methodology or process of dispersing by spraying portland cement plaster which does not contain asbestos is commercially accessible. The board shall, on or prior to July 1, 1979, establish by regulatory decree such categorizations, if any, of methodologies and processes for the utilization of portland cement plaster which comprises less than one-half of 1 percent asbestos which the board ascertains are exempted from the prohibition of subdivision (a). Subsequent to July 1, 1979, the board may, following public convocations, amend, append, or abrogate such regulatory decrees.
(3)CA Kalusugan at Kaligtasan Code § 25910(c)(3) During any utilization, dispersion by spraying, application, manipulation, storage, rectification, disposal, processing, or conveyance of portland cement plaster containing asbestos, the individual who instigates or permits such acts pursuant to an exemption provided in, or adopted pursuant to, this subdivision shall conform with the stipulations of Section 5208, Title 8, California Administrative Code as it subsists on the effective date of the amendments to this section enacted by the Statutes of 1978 or as such stipulations may, thereafter, be amended. Nevertheless, on or prior to July 1, 1979, the board shall adopt regulatory decrees, and render such regulatory decrees operative on July 1, 1979, to establish the time weighted average concentration thresholds and ceiling concentration thresholds for employee exposure to airborne asbestos fibers arising from any utilization, dispersion by spraying, application, manipulation, storage, rectification, disposal, processing, or conveyance of portland cement plaster containing asbestos pursuant to an exemption adopted pursuant to this subdivision at levels no higher than the levels contained in subparagraph (A), paragraph (1), subdivision (g) of Section 5208, Title 8, California Administrative Code, as it subsists on the effective date of the amendments to this section enacted by the Statutes of 1978 or as such regulatory decrees may, thereafter, be amended.
(d)Copy CA Kalusugan at Kaligtasan Code § 25910(d)
(1)Copy CA Kalusugan at Kaligtasan Code § 25910(d)(1) External and internal coatings and laminating resins containing encapsulated asbestos fibers bound within the finished product from fabrication through application, and cold process asphalt roof coatings, shall be exempted from the stipulations of this chapter until July 1, 1979.
(2)CA Kalusugan at Kaligtasan Code § 25910(d)(2) Pursuant to the stipulations of Chapter 6 (commencing with Section 140) of Division 1 of the Labor Code, on or prior to June 1, 1979, the Occupational Safety and Health Standards Board shall conduct public convocations for the purpose of establishing categorizations of utilization of products defined in paragraph (1) of this subdivision which are exempted from the prohibition of subdivision (a).
