Chapter 5
Section § 17610
Section § 17611
This regulation empowers the commissioner to conduct inquiries into whether any individual is violating or is likely to violate the provisions of this section, and to assist in its enforcement. The commissioner is also authorized to disclose details regarding any detected violations. During such inquiries, the commissioner may assume temporary custody of the records belonging to escrow or control agents for a maximum period of 30 days, preventing their removal. This measure is intended to prevent any alteration of records, while still allowing the business's personnel to access them for routine operations.
Furthermore, the commissioner has the authority to issue formal requests for information (subpoenas), collect evidence, and mandate the appearance of witnesses as part of the investigation. Should an individual decline to comply with a subpoena, the court can issue an order compelling their compliance. Although individuals are required to provide testimony or documents, they will not face penalties based on those statements, unless they provide false testimony under oath (perjury) during their appearance.
Section § 17612
