Section § 6580

Explanation

This section explains when a common interest development is officially created. It happens if someone buys a separate property along with a piece of shared property or membership in an association, as long as certain documents are on record. These documents include a declaration, any existing condominium plan, and a map if required by related government rules.

Subject to Section 6582, this act applies and a common interest development is created whenever a separate interest coupled with an interest in the common area or membership in the association is, or has been, conveyed, provided all of the following are recorded:
(a)CA Batas Sibil Code § 6580(a) A declaration.
(b)CA Batas Sibil Code § 6580(b) A condominium plan, if any exists.
(c)CA Batas Sibil Code § 6580(c) A final map or parcel map, if Division 2 (commencing with Section 66410) of Title 7 of the Government Code requires the recording of either a final map or parcel map for the common interest development.

Section § 6582

Explanation

Ang batas na ito ay tungkol sa mga komersyal o industriyal na ari-arian na bahagi ng isang common interest development, na nangangahulugang mayroon silang pinagsasaluhang mga lugar. Nililinaw nito na hindi ito nalalapat sa anumang proyekto ng real estate na walang pinagsasaluhang espasyo.

(a)CA Batas Sibil Code § 6582(a) Ang batas na ito ay nalalapat lamang sa isang komersyal o industriyal na common interest development.
(b)CA Batas Sibil Code § 6582(b) Walang anumang probisyon sa batas na ito ang maaaring bigyang-kahulugan na nalalapat sa isang pagpapaunlad ng real property na walang common area. Ang subdibisyon na ito ay nagpapahayag ng umiiral na batas.
