Section § 33030

Explanation

Section § 33031

Explanation

This section explains that the board is responsible for creating rules and regulations for its own operations and for various schools in the state, including elementary, secondary, technical, and vocational schools, as long as those rules don’t clash with existing California laws. The rules and regulations adopted shall be published for distribution as soon as practicable after adoption.

Section § 33032

Section § 33033

(a)CA Education Code § 33033(a) Establish at the request of the governing authorities of any state institution, courses of instruction for the inmates of the institution.
(b)CA Education Code § 33033(b) Examine under arrangements with the governing authorities of the institution the progress of students taking the courses and grant high school diplomas to students meeting the requirements for high school graduation. Certificates of completion previously awarded by the State Board of Education to students who, at the time of the award of a certificate of completion, met the requirements for high school graduation, shall be deemed for all purposes to be the equivalent of diplomas of high school graduation.

Section § 33034

Explanation

In California, the board has the power to issue subpoenas to require witnesses to appear and testify on important matters it is reviewing. This is similar to how courts in California operate. The board's president can ensure witnesses attend and testify, and the board may cover their expenses up to the same rate as civil case witness fees. However, if a witness is supporting a claimant, the board won't pay their allowance. This rule doesn't apply to certain government proceedings outlined elsewhere.

The board shall issue subpoenas to compel the attendance of witnesses before the board, or any member thereof, in the same manner as any court in this state. Whenever the testimony of any witness upon any matter pending before it is material, the president shall cause the attendance of the witnesses before the board, or a member of the board, to testify concerning the matter, and the board may make a reasonable allowance for this purpose not exceeding the fees of witnesses in civil cases. The allowance shall be paid for out of the appropriation for the expense of the board, but in no instance shall an allowance be made in favor of a witness who appears in behalf of a claimant. The provisions of this section shall not apply to proceedings conducted in accordance with Chapter 5 of Part 1 of Division 3 of Title 2 of the Government Code.

Section § 33035

Explanation

Section § 33036

Explanation

This law requires the board to have any of its needed printing done by the Department of General Services, and all printing orders must be approved by this department first.

Section § 33037

Explanation

Every two years, by September 15th, the board must give the Governor a report of what it has done over the last two years. This report should also include what the board needs for the next two years and any suggestions for changes or new laws in education that it thinks are necessary.

The board shall submit to the Governor biennially on or before the fifteenth day of September next preceding the regular session of the Legislature, a report of its transactions for the preceding two years, together with recommendations of its needs for the coming biennium, and such recommendations as to changes in laws or new educational legislation as may seem to it to be necessary.

Section § 33039

Explanation
The State Board of Education is responsible for creating guidelines that school districts can use to evaluate teachers. These guidelines aim to help the districts develop their own teacher evaluation procedures. Once prepared, the guidelines are sent to every school district.
The State Board of Education shall develop guidelines which school districts may use in the development of teacher evaluation procedures pursuant to Article 11 (commencing with Section 44660) of Chapter 1 of Part 25 of Division 3 of this title, and shall distribute such guidelines to every school district.

Section § 33040

Explanation

This law allows the State Board of Education and local government bodies, like counties or cities, to make agreements where fire department employees can teach fire training programs. The state will pay the local governments for these employees, using funds set aside for vocational education.

The State Board of Education and the governing bodies of any county, city, and fire protection district are authorized to enter into agreements providing for the assignment of employees of the fire departments of such counties, cities, and fire protection districts to serve as instructors in fire training programs conducted under the auspices of the State Board of Education and providing for the payment to such counties, cities, and fire protection districts by the State Board of Education from the funds appropriated for vocational education of such amount as may be agreed upon for the services of such employees.

Section § 33041

Explanation

The State Board of Education must update the health instruction guidelines from 1977 to cover two major areas for students aged 12 to 18. First, it should include how proper health and nutrition during pregnancy can affect the baby's health. Second, it should address violence as a public health issue, emphasizing that it is learned and preventable, and collaborate with community experts to develop relevant educational content.

The State Board of Education shall revise the health instruction framework adopted by the board in 1977 to include instructional guidelines on the following:
(a)CA Education Code § 33041(a) The relationship of proper health and nutritional practices during pregnancy to the health of the newborn child for pupils that are 12 to 18 years of age.
(b)CA Education Code § 33041(b) The recognition that violence is a public health issue and a condition that is learned and may be prevented through education and community-based intervention. In helping to carry out this requirement, the State Department of Education shall consult with existing community resources that have expertise in these matters when developing a curriculum for violence as a public health issue.

Section § 33042

Explanation

This law encourages schools to follow guidelines set by the State Board of Education for teaching students to write in cursive both smoothly and clearly. Schools are suggested to teach various handwriting techniques, such as the D’Nealian or Palmer methods.

The Legislature encourages school districts to comply with the State Board of Education’s English Language and Arts Writing Arts Strategies on cursive handwriting standards whereby pupils are expected to write fluidly and legibly. School districts are encouraged to teach methods of penmanship that may include, but are not limited to, the D’Nealian Method and the Palmer Method of penmanship.

Section § 33043

Explanation

The Governor of California can choose up to six deputies for the executive director of the state board, and these deputies don't have to follow the usual state employment rules. The law aims to ensure that picking these deputies won't lead to the state board spending more than what's already planned in the yearly budget or cost more overall.

(a)CA Education Code § 33043(a) The Governor may appoint a total of six deputies to the executive director of the state board. A deputy to the executive director appointed pursuant to this section shall be exempt from state civil service pursuant to subdivision (f) of Section 4 of Article VII of the California Constitution.
(b)CA Education Code § 33043(b) It is the intent of the Legislature that appointments to these exempt positions do not result in an increase in the amount appropriated to the state board in the annual Budget Act or a net increase in the expenditures of the state board.
