Section § 10000

Explanation

This section allows California State University trustees and school or community college districts to exchange personnel for up to one year. School districts, community colleges, county boards, and the State Department of Education can partner with teacher-training institutions to assign certificated personnel for teaching duties, either full-time or part-time. Such agreements must cover the assigned personnel's salary and employment costs, though a direct personnel exchange can also be arranged. Throughout the assignment, staff members keep their employment status with their original employer.

(a)CA Education Code § 10000(a) Notwithstanding any other provision of law, the Trustees of the California State University and any school district or community college district may enter into an agreement for the exchange of personnel between the state university and the district.
(b)CA Education Code § 10000(b) The governing board of any school district, or community college district, a county board of education, or the State Department of Education may execute a contract with any California teacher-training institution whereby certificated personnel of the school district, county, or the State Department of Education may be assigned to the teacher-training institution for full-time or part-time duty for a period not to exceed one year.
(c)CA Education Code § 10000(c) Any teacher-training institution in California may execute a contract with the governing board of any school district, or community college district, a county board of education, or the State Board of Education whereby certificated personnel of the institution may be assigned to school districts, community college districts, county boards of education, or the State Department of Education for full-time or part-time duty for a period not to exceed one year.
(d)CA Education Code § 10000(d) Any such contract shall provide for the payment, by the entity to which a person is assigned to the employer, of a sum equivalent to the salary and other employment costs of the employee. In place of that payment, the contract may provide for the exchange of certificated personnel between the district, county, or State Department of Education and the teacher-training institution. Any such employee shall retain his or her status as an employee of the school district, community college district, county, State Department of Education, or teacher-training institution from which he or she is assigned in all respects during the period of the assignment.

Section § 10001

Explanation

This law allows a teacher in training at California State University to temporarily take over the classroom teaching duties of a current district teacher. Meanwhile, the district teacher can take on the duties of the university employee who is training teachers.

An agreement authorized by Section 10000 shall provide that an employee of the California State University engaged in teacher training may assume the duties of one of the certificated employees of the district engaged in classroom teaching, and that the certificated employee of the district may assume the duties of the state university employee engaged in teacher training.

Section § 10003

Explanation

If a person who works for the California State University, a school district, or a community college district temporarily takes on duties in another organization, they still remain an employee of their original employer. This means they keep all their rights and benefits, like salary, retirement membership, and job security.

During such time as an employee has assumed duties in another entity, pursuant to this chapter, he or she shall continue to be an employee of the California State University, the school district, or the community college district, as the case may be, for all purposes, including, but not limited to, salary, membership in a retirement system, tenure rights, and all other incidents of employment.
