Section § 5300

Explanation

School and community college district elections follow the rules in the Elections Code, unless there are different rules mentioned here.

School district elections and community college district elections shall be governed by the Elections Code, except as otherwise provided in this code.

Section § 5301

Explanation

This law applies to all school district elections unless another law or a city or county charter specifically takes precedence according to the state Constitution or laws.

The provisions of this chapter shall apply to all district elections, except as otherwise provided by law, or as otherwise provided in the charter of any city or city and county in the matters concerning which the provisions of such charters are afforded controlling force and effect by the Constitution or laws of the state.

Section § 5302

Explanation

This section explains the responsibilities of the county superintendent of schools for managing certain types of elections. They must call elections when necessary, create necessary materials like recommendations or arguments for elections, and handle petitions that are allowed by the education code.

The duties of the county superintendent of schools having jurisdiction of a school district election or community college district election shall be:
(a)CA Education Code § 5302(a) To call elections when ordered under the provisions of this code.
(b)CA Education Code § 5302(b) To prepare recommendations, statements, or arguments for any election in which they are required, as provided in this code.
(c)CA Education Code § 5302(c) To receive petitions as authorized by this code.

Section § 5303

Explanation

This law says that the county elections official is responsible for managing all tasks related to preparing for and conducting district elections. If a district or an election involves areas across multiple counties, then the elections officials from each of those counties have to work together to decide how they will handle the responsibilities.

The county elections official shall perform the duties incident to the preparation for, and holding of, all district elections.
In districts situated in two or more counties, or in elections to organize or reorganize districts in territory situated in two or more counties, the county elections officials in the counties in which any part of the district territory is situated, shall, by mutual agreement, provide for the performance of those duties.

Section § 5304

Explanation

This law explains that the school district or community college district's governing board must handle elections by ordering them when needed and settling any ties in board member elections.

The duties of the governing board of any school district or community college district with respect to school district elections shall be:
(a)CA Education Code § 5304(a) To order elections as authorized by this code.
(b)CA Education Code § 5304(b) To resolve tie votes in governing board member elections.
