Section § 1080

Explanation

This section allows the county board of supervisors to hand over certain responsibilities to the county board of education. These responsibilities include managing the budget estimates of the county superintendent and approving travel and operational expenses related to the superintendent's office. Additionally, the board can transfer other education-related duties or recreational functions by agreement. Even after the transfer, the associated expenses should still be paid from the county's general fund unless otherwise agreed. The law ensures that any transferred expenses can be managed within the county education board's budget, funded by county taxes.

The county board of supervisors, by resolution, may transfer all of the following duties and functions of the county board of supervisors to the county board of education:
(a)CA Education Code § 1080(a) Approval of the county superintendent’s estimate of anticipated revenue and expenditures pursuant to Section 1042 following which it shall be filed with the county board of supervisors.
(b)CA Education Code § 1080(b) Allowance of the actual and necessary travel expenses, the expenses of the office of the county superintendent of schools, and the expenses of providing housing for all the services of the county superintendent of schools pursuant to Sections 1200, 1201, 1202, and 1203.
(c)CA Education Code § 1080(c) By agreement with the county board of education, any other duties and functions of an educational, or educational and recreational, nature which by law are required or permitted to be performed by the county board of supervisors.
(d)CA Education Code § 1080(d)  By agreement with the county board of education, the community recreation functions authorized by Chapter 10 (commencing with Section 10900) of Part 7 of this division.
The transfer of duties and functions under the provisions of this article shall not alter the requirement that the expenses for those duties and functions be paid out of the county general fund as provided elsewhere in this code, provided however that the county board of supervisors and the county board of education may agree that all or any portion of the expenses for those duties and functions that are by law required or permitted to be paid from the county general fund shall be included in that part of the single budget prepared by the county board of education for which a county tax is levied pursuant to Section 1623.

Section § 1081

Explanation

This section explains that when responsibilities are moved to the county board of education, the county superintendent can get approval to cover their travel expenses. These expenses must be necessary and are regulated by the county board. The board can advance money for these costs, but any advance given needs to be settled with an expense claim later on.

Upon the transfer of duties and functions to the county board of education pursuant to Section 1080, the county superintendent of schools may, with the approval of the county board of education, pay actual and necessary travel expenses incurred by the county superintendent of schools or by his designated staff members in accordance with regulations established by the county board of education. The board may authorize an advance of funds to cover such necessary traveling expenses. Such advance shall be repaid or adjusted upon the filing of a regular claim for the actual and necessary traveling expenses incurred.

Section § 1082

Explanation

This law allows county boards of education in California to make agreements for buying property or making improvements, according to the rules set by the County Employees Retirement Law of 1937.

A county board of education to which functions and duties under this article have been transferred may enter into agreements for the acquisition of real property or improvements as authorized by the County Employees Retirement Law of 1937.
