Explanation
This law is known as the 'State Project Area School Construction Law.'
This chapter may be cited as the “State Project Area School Construction Law.”

Section § 16501

Explanation

This law states that when the state builds major projects like highways or government buildings, it will help pay for school buildings in the nearby areas to support any additional needs that arise because of these projects.

In recognition of the impact which certain major state construction projects have on local school district building needs in the areas in which the projects are constructed, the Legislature declares that it is the policy of the state to bear a proportionate share of the construction costs of school buildings in the area affected in the manner and to the extent provided by this chapter.

Section § 16502

Explanation

This law defines key terms used in a chapter related to construction projects in California when there's a sudden population increase due to state or joint state-federal projects. The Governor can declare a construction as a 'state project' if it leads to people moving into the area and it's requested by the county board. As used in this chapter:
(a)CA Education Code § 16502(a) “State project” means any construction project undertaken by the state, or the state and federal government jointly, which will cause a sudden influx of people into the area affected and where sufficient housing, schools, and other community facilities are not available. For the purposes of this subdivision, the Governor is hereby empowered to proclaim any major construction project undertaken by the state as a “state project” and define the area affected or likely to be affected thereby if both of the following conditions are satisfied:
(1)CA Education Code § 16502(a)(1) The Governor finds that the construction project will cause a sudden influx of people into the area.
(2)CA Education Code § 16502(a)(2) The Governor is requested to do so by the county board of supervisors.
The proclamation shall be in writing and shall take effect immediately. As soon thereafter as possible it shall be filed in the office of the Secretary of State.
(b)CA Education Code § 16502(b) “Board” means the State Allocation Board.
(c)CA Education Code § 16502(c) “Director” means the Director of Education for kindergarten and grades 1 to 12, inclusive.
(d)CA Education Code § 16502(d) “Project” means the purposes for which a school district has applied for an apportionment.
(e)CA Education Code § 16502(e) “Construction project” means the purposes for which a school district has applied for an apportionment at a given location.
(f)CA Education Code § 16502(f) “Grade level maintained by a district” means any of the following:
(1)CA Education Code § 16502(f)(1) The kindergarten, if any, and grades 1 to 6, or grades 1 to 8, inclusive, maintained by an elementary school district or a unified school district.
(2)CA Education Code § 16502(f)(2) Grades 7 to 12, inclusive, grades 9 to 12, inclusive, or grades 7 to 10, inclusive, maintained by a high school district or unified school district, but not more than one grade level shall be claimed by any district under any one of the paragraphs of this subdivision.
(g)CA Education Code § 16502(g) “Apportionment” means an apportionment made under this chapter unless the context otherwise requires.
(h)CA Education Code § 16502(h) “Project children” means children of parents who have come to the district subsequent to the start of the state project and who are employed by the State of California or the federal government in connection with a state project and children of parents employed by any contractor or subcontractor of a state project.
(i)CA Education Code § 16502(i) “Indirect project children” means children of parents who have come to the district subsequent to the start of the state project and who are not employed by a contractor or subcontractor of a state project but who are children in the area in addition to those which would be expected as a result of normal development and growth of the area as determined pursuant to regulations of the director which he or she is hereby authorized to adopt.
(j)CA Education Code § 16502(j) “Parent” includes a legal guardian or other person standing in loco parentis.
(k)CA Education Code § 16502(k) “Department” means the State Department of Education.

Section § 16503

Explanation
The Director of General Services is responsible for overseeing this chapter and must help the board with any support they need.
The Director of General Services shall administer this chapter and shall provide any assistance to the board that it may require.

Section § 16504

Explanation

This law establishes the State School Construction Fund, which is a fund in the California State Treasury. This fund is used to finance school construction projects in the state. Money deposited into this fund, from any source and since September 11, 1957, is immediately set aside for use, regardless of the fiscal year, to support projects outlined in this chapter.

A fund in the State Treasury is hereby created, to be known as the State School Construction Fund. All money in the State School Construction Fund, including any money deposited in the fund from any source whatsoever after September 11, 1957, is hereby continuously appropriated without regard to fiscal years for expenditure pursuant to apportionments made under this chapter.
