Section § 1345

Explanation

If someone accidentally gives unclaimed money or property to the state, and it's put in the Unclaimed Property Fund, it can be returned to them if the Controller orders it.

If any person has erroneously delivered any unclaimed moneys or other unclaimed property to the state or any officer or employee thereof, and the moneys or other property is deposited in the Unclaimed Property Fund or is held by the Controller or Treasurer in the name of any account in that fund pursuant to this title, the moneys or other property delivered in error may be refunded or returned to that person on order of the Controller.

Section § 1346

Explanation

If you've accidentally sent unclaimed money or property to the state, and it ends up in the state's General Fund, there's a way to fix it. The Controller can move money back to the Unclaimed Property Fund or adjust the records for non-cash items. Once that happens, the money or property can be returned to you by order of the Controller.

If any person has erroneously delivered any unclaimed moneys or other unclaimed property to the state or any officer or employee thereof, and the moneys or other property is deposited in, or transferred to, the General Fund, or is held by the Controller or Treasurer in the name of that fund, pursuant to this title, the moneys or other property delivered in error, if cash, shall on order of the Controller, be transferred from the General Fund to the Unclaimed Property Fund, and, if other than cash, the records of the Controller and Treasurer shall be adjusted to show that it is held in the name of the proper account in the Unclaimed Property Fund; and the moneys or other property may be refunded or returned to that person on order of the Controller.

Section § 1347

Explanation

This law describes what happens if money or property in the Unclaimed Property Fund was mistakenly marked as permanently lost to the state and transferred to the General Fund. If it's later found out that the property shouldn't have been permanently marked as such, it should be moved back to the Unclaimed Property Fund. For money, the Controller orders it to be transferred back. For other types of property, records are updated to reflect the change.

Whenever money deposited in the Unclaimed Property Fund is transferred to the General Fund under the provisions of this title, and whenever the records of the Controller and Treasurer covering property other than money held in the name of any account in the Unclaimed Property Fund are adjusted to record such property as held in the name of the General Fund, as permanently escheated property under the provisions of this title, if it is subsequently determined that such money or other property is not, in fact, permanently escheated, such money or other property, if cash, shall, on order of the Controller, be retransferred from the General Fund to the Unclaimed Property Fund; and, if the property is other than money, the records of the Controller and Treasurer shall be adjusted to show that it is held in the name and for the benefit of the proper account in the Unclaimed Property Fund.
