Section § 872.110

Explanation

This law explains who has the authority to handle cases under this title and where these cases should be tried. The superior court is in charge of these cases, and the location for the trial depends on what the case is about. If the case involves real estate, it should be held in the county where the property is located. If it involves personal property, the trial should be in the county where the property is primarily located or where any of the defendants live when the case starts.

(a)CA Civil Procedure Code § 872.110(a) The superior court has jurisdiction of actions under this title.
(b)CA Civil Procedure Code § 872.110(b) Subject to the power of the court to transfer actions, the proper county for the trial of actions under this title is:
(1)CA Civil Procedure Code § 872.110(b)(1) Where the subject of the action is real property or real and personal property, the county in which the real property, or some part thereof, is situated.
(2)CA Civil Procedure Code § 872.110(b)(2) Where the subject of the action is personal property, the county in which the personal property is principally located at the commencement of the action or in which the defendants, or any of them, reside at the commencement of the action.

Section § 872.120

Explanation
This law allows the court to handle and decide on any motions, reports, and financial accounts related to a legal case, and to issue any orders needed to achieve the goals of the case and ensure that the court’s decisions are effectively carried out.
In the conduct of the action, the court may hear and determine all motions, reports, and accounts and may make any decrees and orders necessary or incidental to carrying out the purposes of this title and to effectuating its decrees and orders.

Section § 872.130

Explanation

This law allows a court to issue temporary orders to protect property involved in a legal action. These orders can prevent waste, protect ownership, and stop illegal interference with dividing up the property.

In the conduct of the action, the court may issue temporary restraining orders and injunctions, with or without bond, for the purpose of:
(a)CA Civil Procedure Code § 872.130(a) Preventing waste.
(b)CA Civil Procedure Code § 872.130(b) Protecting the property or title thereto.
(c)CA Civil Procedure Code § 872.130(c) Restraining unlawful interference with a partition of the property ordered by the court.

Section § 872.140

Explanation
This law allows a court to make fair adjustments, like sharing costs or compensations, between parties involved in a case to ensure fairness.
The court may, in all cases, order allowance, accounting, contribution, or other compensatory adjustment among the parties according to the principles of equity.
