Section § 849

Explanation

This law gives the court the power and responsibility to find a practical solution for managing water rights in major legal disputes involving multiple parties, especially when other efforts aren't working. Before the court decides on this solution, it must take into account any existing plans for managing groundwater sustainably.

(a)CA Civil Procedure Code § 849(a) The court shall have the authority and the duty to impose a physical solution on the parties in a comprehensive adjudication where necessary and consistent with Article 2 of Section X of the California Constitution.
(b)CA Civil Procedure Code § 849(b) Before adopting a physical solution, the court shall consider any existing groundwater sustainability plan or program.
