Explanation

Basically, you can transfer ownership of any property unless there are specific rules in this Article that say otherwise.

Property of any kind may be transferred, except as otherwise provided by this Article.

Section § 1045

Explanation

This section means that you can't give or sell someone else a chance at owning something unless you actually have a concrete stake or interest in it to begin with.

A mere possibility, not coupled with an interest, cannot be transferred.

Section § 1046

Explanation

This law explains that if someone has the right to take back possession of property due to a broken agreement, they can transfer that right to someone else.

A right of reëntry, or of repossession for breach of condition subsequent, can be transferred.

Section § 1047

Explanation

If you claim ownership of a piece of property that's currently occupied by someone else, you can still sell or transfer it as if you were actually living there yourself.

Any person claiming title to real property in the adverse possession of another may transfer it with the same effect as if in actual possession.
