Section § 1146

Explanation

This law explains that a gift occurs when someone voluntarily gives their personal belongings to someone else without expecting anything in return.

A gift is a transfer of personal property, made voluntarily, and without consideration.

Section § 1147

Explanation

A verbal gift isn't legally considered valid unless the person receiving it is given control or ownership of the gift. If the gift can be delivered, it must be given directly or symbolically to the recipient to count as a real gift.

A verbal gift is not valid, unless the means of obtaining possession and control of the thing are given, nor, if it is capable of delivery, unless there is an actual or symbolical delivery of the thing to the donee.

Section § 1148

Explanation

If you give someone a gift, you can't take it back unless it was specifically given because you thought you were about to die.

A gift, other than a gift in view of impending death, cannot be revoked by the giver.
