Section § 12541

Explanation

This law outlines the creation of a seven-member advisory committee by the department, which will advise on the registration of service agencies. The committee includes representatives from different sectors: two from registered service agencies, two from county sealers or directors of weights and measures, one from device manufacturers, one from industry clients of service agencies, and one from the general public. Members typically serve for three years, but initial appointments will have staggered terms of one, two, or three years to start. If a position becomes vacant before a term is complete, the department will fill it for the remainder of the term.

(a)CA Business & Professions Code § 12541(a) The department shall establish a seven-member advisory committee consisting of the following members:
(1)CA Business & Professions Code § 12541(a)(1) Two members representing registered service agencies.
(2)CA Business & Professions Code § 12541(a)(2) Two members representing county sealers or directors of weights and measures.
(3)CA Business & Professions Code § 12541(a)(3) One member representing device manufacturers.
(4)CA Business & Professions Code § 12541(a)(4) One member representing industry clients of service agencies.
(5)CA Business & Professions Code § 12541(a)(5) One member representing the general public.
(b)CA Business & Professions Code § 12541(b) Except as provided in subdivision (c), the term of office of the members of the committee is three years. Vacancies shall be filled by the department for any unexpired term.
(c)CA Business & Professions Code § 12541(c) Initial appointments to the committee shall be made as follows:
(1)CA Business & Professions Code § 12541(c)(1) One representative of registered service agencies, and one representative of county sealers or directors of weights and measures shall be appointed for one year.
(2)CA Business & Professions Code § 12541(c)(2) One representative of device manufacturers, one representative of county sealers or directors of weights and measures, and one representative of industry clients of service agencies shall be appointed for two years.
(3)CA Business & Professions Code § 12541(c)(3) One representative of registered service agencies, and one representative of the general public shall be appointed for three years.
(d)CA Business & Professions Code § 12541(d) The committee shall be advisory to the department in all matters concerning the registration of service agencies.
