Section § 22435.10

Explanation

This section defines terms used in laws related to the retrieval of shopping carts or laundry carts. If you're in the business of returning these carts to their owners for money, this is considered 'cart retrieval.' A 'shopping cart' is like the wheeled baskets you use in stores to carry items. A 'laundry cart' is a similar basket on wheels used in laundromats for moving clothes and cleaning supplies. As used in this article:
(a)CA Business & Professions Code § 22435.10(a) “In the business of shopping cart or laundry cart retrieval” means to search for, gather, and restore possession to the owner, or an agent thereof, for compensation or in expectation of compensation, of shopping carts or laundry carts located outside the premises or parking area of a retail establishment.
(b)CA Business & Professions Code § 22435.10(b) “Shopping cart” means a basket which is mounted on wheels or a similar device generally used in a retail establishment by a customer for the purpose of transporting goods of any kind.
(c)CA Business & Professions Code § 22435.10(c) “Laundry cart” means a basket which is mounted on wheels and used in a coin-operated laundry or drycleaning retail establishment by a customer or an attendant for the purpose of transporting fabrics and the supplies necessary to process them.
(d)CA Business & Professions Code § 22435.10(d) “Parking area” means a parking lot or other property provided by a retailer for use by a customer for parking an automobile or other vehicle.

Section § 22435.11

Explanation

If you're in the business of collecting shopping carts or laundry carts, you need to keep records showing permission from the cart owner to do so. Additionally, you must keep a copy of this authorization in every vehicle used for cart collection.

(a)CA Business & Professions Code § 22435.11(a) Any person who engages in the business of shopping cart or laundry cart retrieval shall retain records showing written authorization from the cart owner, or an agent thereof, to retrieve the cart or carts and to be in possession of the cart or carts retrieved.
(b)CA Business & Professions Code § 22435.11(b) A copy of the record showing written authorization shall be maintained in each vehicle used for shopping cart or laundry cart retrieval.

Section § 22435.12

Explanation
Every vehicle used to collect shopping or laundry carts must have a sign showing which company or service is responsible for collecting the carts.
Each vehicle employed for the retrieval of shopping carts or laundry carts shall display a sign that clearly identifies the retrieval service.

Section § 22435.13

Explanation

This law states that if someone breaks the rules outlined in this article, they are committing a misdemeanor, which is a minor crime. It also clarifies that this doesn't prevent the person from being charged with theft or any other crime if applicable.

Any person who violates the provisions of this article is guilty of a misdemeanor.
The provisions of this section are not intended to preclude the application of any other laws relating to prosecution for theft.
