Explanation

This law applies to the sale of upholstered furniture, bedding, filling materials, and insulation in California, no matter where they come from.

This chapter applies to upholstered furniture, bedding and filling materials, and insulation sold in California regardless of its point of origin.

Section § 19071

Explanation

If you're bringing used bedding or its filling materials from outside California, they must be cleaned according to state rules before you can accept, sell, or deliver them.

Secondhand bedding, or secondhand filling materials to be used or that could be used in bedding received from outside of this state shall comply with all the sanitization provisions of this chapter before it is accepted, sold or delivered, either directly or indirectly by any person.

Section § 19072

Explanation

If you're dealing with upholstered furniture, bedding, or filling materials, it's not just the manufacturer who needs to follow the rules in this chapter. Anyone who imports, wholesales, retails, or even possesses these items with the intent to resell them must also comply with the regulations.

Responsibility for compliance with this chapter rests not only with the manufacturer but also with the importer, wholesaler, retailer, or any person having in his or her possession any article of upholstered furniture or bedding, or filling materials with intent to resell contrary to the provisions of this chapter.

Section § 19072.5

Explanation

If you’re selling upholstered furniture or bedding in California—whether you're an importer, wholesaler, or retailer—you must ensure those items have labels from the manufacturer before selling them. This rule does not apply to furniture used solely for exercise or fitness purposes.

Importers, wholesalers, and retailers shall not sell or resell in California unlabeled upholstered furniture or bedding. Importers, wholesalers, and retailers shall obtain labels from the manufacturer of those articles and shall affix the labels before offering any upholstered furniture or bedding for sale. This does not include furniture used exclusively for the purpose of physical fitness and exercise.

Section § 19072.6

Explanation

If you make or buy slip seats for chairs or benches, you're in charge of making sure they are properly labeled.

The manufacturer of chairs and benches and similar articles, using slip seats that are manufactured by himself or herself or purchased from another, is responsible for the labeling of those articles.

Section § 19072.7

Explanation

If someone helps or joins forces with an unlicensed person to break the rules of a regulated business, or lets an unlicensed person use their license number to do so, they can face punishment.

Aiding, abetting, or knowingly combining or conspiring with an unlicensed person engaged in a business regulated by this chapter, to evade the provisions of this chapter, or allowing one’s license or registry number to be used by an unlicensed person to evade the provisions of this chapter is grounds for disciplinary action.

Section § 19073

Explanation

This law states that the rules in this chapter do not apply to upholstered furniture, bedding, or insulation if they are made and sold in California, but are meant for delivery outside the state.

This chapter does not apply to upholstered furniture, bedding, or insulation manufactured and sold at wholesale in California for delivery outside the borders of this state.

Section § 19074

Explanation

This law states that any rules in this chapter do not affect companies that make or use insulating window or door glass products.

This chapter does not apply to the manufacturer of insulating window or door glass or products containing insulating window or door glass.
