Section § 6728

Explanation

This law says that the board has the authority to create special committees of professional engineers to handle various issues, such as disputes or other cases referred to them by the board. These committees will continue to operate as long as the board considers them necessary.

The board, when it deems necessary, may establish professional engineers review committees to hear all matters assigned by the board, including, but not limited to, any contested case which is assigned by the board. Each committee shall exist so long as the board deems that it is necessary.

Section § 6728.1

Explanation

This law states that each review committee must have at least three registered professional engineers who are appointed by the board. These committee members must have the same qualifications and follow the same rules as the board members themselves.

Each review committee shall consist of no fewer than three registered professional engineers appointed by the board. Each member of a committee shall have the same qualifications and shall be subject to the same rules and regulations as if he were a member of the board.

Section § 6728.2

Explanation

This law explains that each committee member is entitled to a daily payment and reimbursement for expenses, which are detailed in another section of the same code.

Each member of a committee shall receive a per diem and expenses as provided in Section 103 of this code.

Section § 6728.3

Explanation

This law specifies that hearings by a committee must follow certain government regulations. If the case is contested, the officer who oversaw the hearing has to be present when the committee discusses the case. The officer also helps and advises the committee if they ask for it.

Except as otherwise provided in this article, all hearings which are conducted by a committee shall be conducted in accordance with the provisions of Chapter 4 (commencing with Section 11370), Chapter 4.5 (commencing with Section 11400) and Chapter 5 (commencing with Section 11500), Part 1, Division 3, Title 2 of the Government Code.
If a contested case is heard by a committee, the hearing officer who presided at the hearing shall be present during the committee’s consideration of the case and, if requested, shall assist and advise the committee.

Section § 6728.4

Explanation

After a committee hearing is finished, the committee must create a suggested decision that can be accepted by the board as the final decision. This proposed decision follows the same rules as those for a hearing officer's proposed decision according to sections of the Government Code.

At the conclusion of any hearing which is conducted by a committee, the committee shall prepare a proposed decision, in such form that it may be adopted by the board as the decision in the case, and shall transmit it to the board. The proposed decision shall be subject to the same procedure as the proposed decision of a hearing officer under subdivisions (b) and (c) of Section 11517 of the Government Code.

Section § 6728.5

Explanation

This law allows the board to create, change, or remove rules as needed, following a specific process outlined in another part of the government code, to ensure these sections are carried out effectively.

The board may adopt, amend, or repeal, in accordance with the provisions of Chapter 3.5 (commencing with Section 11340), Part 1, Division 3, Title 2 of the Government Code, rules and regulations necessary to implement these sections.

Section § 6728.6

Explanation

This law states that members of a professional engineers review committee, and any other board-appointed representatives, have the same legal protections as public employees. This means they are legally protected from being personally sued for actions taken within their official roles, according to certain sections of the Government Code.

Each member of a professional engineers review committee or other board-appointed committee and any board-appointed representative of the board shall be granted the same immunity as is granted to a public employee pursuant to Article 3 (commencing with Section 820) of Chapter 1 of Part 2 of Division 3.6 of Title 1 of the Government Code.
