Section § 9888.1

Explanation

This section explains some terms used in the chapter. A 'station' refers to places that adjust lamps or brakes on vehicles. A 'licensed station' is one that has a license issued by the bureau. A 'licensed adjuster' is a person who is authorized by the bureau to adjust lamps or brakes at these stations.

As used in this chapter:
(a)CA Business & Professions Code § 9888.1(a) “Station” means a lamp adjusting station or a brake adjusting station.
(b)CA Business & Professions Code § 9888.1(b) “Licensed station” means a station licensed by the bureau pursuant to this chapter.
(c)CA Business & Professions Code § 9888.1(c)  “Licensed adjuster” means a person licensed by the bureau for adjusting lamps in licensed lamp adjusting stations or for adjusting brakes in licensed brake adjusting stations.

Section § 9888.2

Explanation

This law requires the director to set rules for the equipment and qualifications needed for stations to be officially licensed to adjust car lamps or brakes. The director can also approve equipment that tests and calibrates these standards after consulting with the California Highway Patrol, and certify the labs and tools used for this testing.

The director shall adopt regulations which prescribe the equipment and other qualifications of any station as a condition to licensing the station as an official station for adjusting lamps or brakes and shall prescribe the qualifications of adjusters employed therein.
After consulting with the Department of the California Highway Patrol, the director may, by regulation, approve testing and calibrating equipment, which is capable of measuring or calibrating the standards imposed by statute and by rules and regulations, for use in official stations, and may approve the testing laboratories and the equipment they use to certify the performance of testing and calibrating equipment.

Section § 9888.3

Explanation

This law states that you can't run an official lamp or brake adjustment station without a proper license. Additionally, only licensed lamp or brake adjusters can issue certificates that claim to be official lamp or brake adjustment certificates.

No person shall operate an “official” lamp or brake adjusting station unless a license therefor has been issued by the director. No person shall issue, or cause or permit to be issued, any certificate purporting to be an official lamp adjustment certificate unless he or she is a licensed lamp adjuster or an official brake adjustment certificate unless he or she is a licensed brake adjuster.

Section § 9888.4

Explanation

If you own a fleet of at least three vehicles and don't operate across state lines, you can be licensed to operate a vehicle inspection station, but you can only certify lamp or brake adjustments on your own vehicles.

An owner of a fleet of three or more vehicles who is not an interstate carrier may be licensed by the director as a licensed station, if the owner complies with the rules and regulations of the bureau. Those fleet owner stations shall not certify the adjustment of lamps or brakes except on vehicles which constitute the owner’s fleet.

Section § 9888.4

Explanation
This section of the law will only be in effect until six months after new regulations are put into place by the director, starting from Section 9888.5. After that, it will no longer apply.
This article shall remain operative only until six months after the effective date of the regulations adopted by the director pursuant to Article 6.5 (commencing with Section 9888.5) and as of that date is repealed.
