Section § 9889.50

Explanation

This law recognizes some serious issues with auto body repair shops in California. Car owners often need repairs from accidents, but many shops aren't doing a good job, which harms customers. The problems are due to a lack of proper training, equipment, and industry standards. Right now, California doesn't have basic rules for these shops, and the current regulations need improvement. There's a strong need to raise the level of skill and standards in the auto body repair business.

The Legislature finds the following:
(1)CA Business & Professions Code § 9889.50(1) Thousands of California automobile owners each year require repair of their vehicles as a result of collision or other damage.
(2)CA Business & Professions Code § 9889.50(2) California automobile owners are suffering direct and indirect harm through unsafe, improper, incompetent, and fraudulent auto body repairs.
(3)CA Business & Professions Code § 9889.50(3) There is a lack of proper training and equipment that auto body repair shops need to meet the demands of the highly evolved and sophisticated automobile manufacturing industry.
(4)CA Business & Professions Code § 9889.50(4) California has no minimum standards or requirements for auto body repair shops.
(5)CA Business & Professions Code § 9889.50(5) Existing laws currently regulating the auto body industry could be strengthened.
(6)CA Business & Professions Code § 9889.50(6) There is a compelling need to increase competency and standards for the auto body repair industry.

Section § 9889.51

Explanation
An 'auto body repair shop' is a business run by an automotive repair dealer where the main work involves fixing or rebuilding car and truck bodies after accidents.
“Auto body repair shop” means a place of business operated by an automotive repair dealer where automotive collision repair or reconstruction of automobile or truck bodies is performed.

Section § 9889.52

Explanation

If you want to register as an auto body repair shop in California, your application must clearly state this intention. You also need to include a signed statement, under penalty of perjury, confirming that you have the necessary permits and licenses. These may include a local business license, a resale permit number from the State Board of Equalization, an EPA hazardous waste permit, and an air quality permit for a spray booth, if required.

An application for registration pursuant to Section 9884 shall designate that the applicant is registering as an auto body repair shop if the applicant intends to perform auto body repair. In addition, an application for registration to operate an auto body repair shop shall include a written statement signed under penalty of perjury that the applicant has been issued licenses or permits, if required by law, including, but not limited to, all of the following:
(1)CA Business & Professions Code § 9889.52(1) A city or county business license.
(2)CA Business & Professions Code § 9889.52(2) A State Board of Equalization identification or resale permit number.
(3)CA Business & Professions Code § 9889.52(3) An Environmental Protection Agency hazardous waste permit number.
(4)CA Business & Professions Code § 9889.52(4) An Air Quality Management District spray booth permit number.

Section § 9889.53

Explanation

When an insurance company issues a payment check or draft to a vehicle repair shop for insurance claims, that check must include the repair shop's registration number or tax ID.

A check or draft issued to a repairer pursuant to Section 560 of the Insurance Code shall include the repairer’s registration number or taxpayer identification number.
